<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id35709722-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s42112"><num value="42112">§ 42112.</num><heading> Labor requirements of air carriers</heading><subsection style="-uslm-lc:I11" class="indent0" id="id35709723-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s42112/a"><num value="a">(a)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id35709724-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s42112/a/1"><num value="1">(1)</num><content> “copilot” means an employee whose duties include assisting or relieving the pilot in manipulating an aircraft and who is qualified to serve as, and has in effect an airman certificate authorizing the employee to serve as, a copilot.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id35709725-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s42112/a/2"><num value="2">(2)</num><chapeau> “pilot” means an employee who is—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id35709726-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s42112/a/2/A"><num value="A">(A)</num><content> responsible for manipulating or who manipulates the flight controls of an aircraft when under way, including the landing and takeoff of an aircraft; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id35709727-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s42112/a/2/B"><num value="B">(B)</num><content> qualified to serve as, and has in effect an airman certificate authorizing the employee to serve as, a pilot.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id35709728-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s42112/b"><num value="b">(b)</num><heading> <inline class="small-caps">Duties of Air Carriers</inline>.—</heading><chapeau>An air carrier shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id35709729-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s42112/b/1"><num value="1">(1)</num><content> maintain rates of compensation, maximum hours, and other working conditions and relations for its pilots and copilots who are providing interstate air transportation in the 48 contiguous States and the District of Columbia to conform with decision number 83, <date date="1934-05-10">May 10, 1934</date>, National Labor Board, notwithstanding any limitation in that decision on the period of its effectiveness;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3570972a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s42112/b/2"><num value="2">(2)</num><content> maintain rates of compensation for its pilots and copilots who are providing foreign air transportation or air transportation only in one territory or possession of the United States; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3570972b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s42112/b/3"><num value="3">(3)</num><content> comply with title II of the Railway Labor Act (<ref href="/us/usc/t45/s181">45 U.S.C. 181</ref> et seq.) as long as it holds its certificate.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3570972c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s42112/c"><num value="c">(c)</num><heading> <inline class="small-caps">Minimum Annual Rate of Compensation</inline>.—</heading><content>A minimum annual rate under subsection (b)(2) of this section may not be less than the annual rate required to be paid for comparable service to a pilot or copilot under subsection (b)(1) of this section.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3570972d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s42112/d"><num value="d">(d)</num><heading> <inline class="small-caps">Collective Bargaining</inline>.—</heading><content>This section does not prevent pilots or copilots of an air carrier from obtaining by collective bargaining higher rates of compensation or more favorable working conditions or relations.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">Labor Integration</inline>.—</heading><chapeau>With respect to any covered transaction involving two or more covered air carriers that results in the combination of crafts or classes that are subject to the Railway Labor Act (<ref href="/us/usc/t45/s151">45 U.S.C. 151</ref> et seq.), sections 3 and 13 of the labor protective provisions imposed by the Civil Aeronautics Board in the Allegheny-Mohawk merger (as published at 59 C.A.B. 45) shall apply to the integration of covered employees of the covered air carriers; except that—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> if the same collective bargaining agent represents the combining crafts or classes at each of the covered air carriers, that collective bargaining agent’s internal policies regarding integration, if any, will not be affected by and will supersede the requirements of this section; and</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> the requirements of any collective bargaining agreement that may be applicable to the terms of integration involving covered employees of a covered air carrier shall not be affected by the requirements of this section as to the employees covered by that agreement, so long as those provisions allow for the protections afforded by sections 3 and 13 of the Allegheny-Mohawk provisions.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section, the following definitions apply:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Air carrier</inline>.—</heading><content>The term ‘air carrier’ means an air carrier that holds a certificate issued under chapter 411 of title 49, United States Code.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Covered air carrier</inline>.—</heading><content>The term ‘covered air carrier’ means an air carrier that is involved in a covered transaction.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Covered employee</inline>.—</heading><chapeau>The term ‘covered employee’ means an employee who—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> is not a temporary employee; and</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Application</inline>.—</heading><content>This section shall not apply to any covered transaction involving a covered air carrier that took place before the date of enactment of this Act [<date date="2007-12-26">Dec. 26, 2007</date>].</content>
