<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id3572e092-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44101"><num value="44101">§ 44101.</num><heading> Operation of aircraft</heading><subsection style="-uslm-lc:I11" class="indent0" id="id3572e093-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44101/a"><num value="a">(a)</num><heading> <inline class="small-caps">Registration Requirement</inline>.—</heading><content>Except as provided in subsection (b) of this section, a person may operate an aircraft only when the aircraft is registered under <ref href="/us/usc/t49/s44103">section 44103 of this title</ref>.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3572e094-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44101/b"><num value="b">(b)</num><heading> <inline class="small-caps">Exceptions</inline>.—</heading><chapeau>A person may operate an aircraft in the United States that is not registered—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3572e095-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44101/b/1"><num value="1">(1)</num><content> when authorized under section 40103(d) or 41703 of this title;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3572e096-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44101/b/2"><num value="2">(2)</num><content> when it is an aircraft of the national defense forces of the United States and is identified in a way satisfactory to the Administrator of the Federal Aviation Administration; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3572e097-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44101/b/3"><num value="3">(3)</num><content> for a reasonable period of time after a transfer of ownership, under regulations prescribed by the Administrator.</content>

<p style="-uslm-lc:I21" class="indent0">In this section, the word “navigate” is omitted as being included in the definition of “operate aircraft” in section 40102(a) of the revised title.</p>
<p style="-uslm-lc:I21" class="indent0">In subsection (a), the words “Except as provided in subsection (b) of this section” are added for clarity. </subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> Expedited Rulemaking Process.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Final rule</inline>.—</heading><content>The Administrator shall issue regulations under this section by publishing a final rule by <date date="2004-12-31">December 31, 2004</date>.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Effective date</inline>.—</heading><content>The final rule shall not be effective before the date the Cape Town Treaty enters into force with respect to the United States [<date date="2006-03-01">Mar. 1, 2006</date>, see Effective Date of 2004 Amendment note above].</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Economic analysis</inline>.—</heading><content>The Administrator shall not be required to prepare an economic analysis of the cost and benefits of the final rule.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Applicability of Treaty</inline>.—</heading><content>Notwithstanding parts 47.37(a)(3)(ii) and 47.47(a)(2) of title 14, of the Code of Federal Regulations, Articles IX(5) and XIII of the Cape Town Treaty shall apply to the matters described in subsection (b) until the earlier of the effective date of the final rule under this section or <date date="2004-12-31">December 31, 2004</date>.”</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> The legal and financing framework of the Cape Town Treaty will provide substantial economic benefits to the aviation and aerospace sectors, including the promotion of exports, and will facilitate the acquisition of newer, safer aircraft around the world.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> Only technical changes to United States law and regulations are required since the asset-based financing and leasing concepts embodied in the Cape Town Treaty are already reflected in the United States in the Uniform Commercial Code.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> The new electronic registry system established under the Cape Town Treaty will work in tandem with current aircraft document recordation systems of the Federal Aviation Administration, which have served United States industry well.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><content> The United States Government was a leader in the development of the Cape Town Treaty.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Purpose</inline>.—</heading><content>Accordingly, the purpose of this Act [see Short Title of 2004 Amendment note set out under <ref href="/us/usc/t49/s40101">section 40101 of this title</ref>] is to provide for the implementation of the Cape Town Treaty in the United States by making certain technical amendments to the provisions of chapter 441 of title 49, United States Code, directing the Federal Aviation Administration to complete the necessary rulemaking processes as expeditiously as possible, and clarifying the applicability of the Treaty during the rulemaking process.”</content>
