<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id3c38d31e-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s44103"><num value="44103">§ 44103.</num><heading> Registration of aircraft</heading><subsection style="-uslm-lc:I11" class="indent0" id="id3c38d31f-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s44103/a"><num value="a">(a)</num><heading> <inline class="small-caps">General</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id3c38d320-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s44103/a/1"><num value="1">(1)</num><chapeau> On application of the owner of an aircraft that meets the requirements of <ref href="/us/usc/t49/s44102">section 44102 of this title</ref>, the Administrator of the Federal Aviation Administration shall—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id3c38d321-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s44103/a/1/A"><num value="A">(A)</num><content> register the aircraft; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id3c38d322-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s44103/a/1/B"><num value="B">(B)</num><content> issue a certificate of registration to its owner.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id3c38d323-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s44103/a/2"><num value="2">(2)</num><content> The Administrator may prescribe the extent to which an aircraft owned by the holder of a dealer’s certificate of registration issued under <ref href="/us/usc/t49/s44104/2">section 44104(2) of this title</ref> also is registered under this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3c38d324-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s44103/b"><num value="b">(b)</num><heading> <inline class="small-caps">Controlled Substance Violations</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id3c38d325-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s44103/b/1"><num value="1">(1)</num><chapeau> The Administrator may not issue an owner’s certificate of registration under subsection (a)(1) of this section to a person whose certificate is revoked under <ref href="/us/usc/t49/s44106">section 44106 of this title</ref> during the 5-year period beginning on the date of the revocation, except—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id3c38d326-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s44103/b/1/A"><num value="A">(A)</num><content> as provided in <ref href="/us/usc/t49/s44106/e/2">section 44106(e)(2) of this title</ref>; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id3c38d327-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s44103/b/1/B"><num value="B">(B)</num><chapeau> that the Administrator may issue the certificate to the person after the one-year period beginning on the date of the revocation if the Administrator decides that the aircraft otherwise meets the requirements of <ref href="/us/usc/t49/s44102">section 44102 of this title</ref> and that denial of a certificate for the 5-year period—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id3c38d328-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s44103/b/1/B/i"><num value="i">(i)</num><content> would be excessive considering the nature of the offense or the act committed and the burden the denial places on the person; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id3c38d329-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s44103/b/1/B/ii"><num value="ii">(ii)</num><content> would not be in the public interest.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id3c38d32a-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s44103/b/2"><num value="2">(2)</num><content> A decision of the Administrator under paragraph (1)(B)(i) or (ii) of this subsection is within the discretion of the Administrator. That decision or failure to make a decision is not subject to administrative or judicial review.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3c38d32b-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s44103/c"><num value="c">(c)</num><heading> <inline class="small-caps">Certificates as Evidence</inline>.—</heading><chapeau>A certificate of registration issued under this section is—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3c38d32c-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s44103/c/1"><num value="1">(1)</num><content> conclusive evidence of the nationality of an aircraft for international purposes, but not conclusive evidence in a proceeding under the laws of the United States; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3c38d32d-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s44103/c/2"><num value="2">(2)</num><content> not evidence of ownership of an aircraft in a proceeding in which ownership is or may be in issue.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3c38d32e-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s44103/d"><num value="d">(d)</num><heading> <inline class="small-caps">Certificates Available for Inspection</inline>.—</heading><content>An operator of an aircraft shall make available for inspection a certificate of registration for the aircraft when requested by a United States Government, State, or local law enforcement officer.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Existing Memoranda To Be Conformed</inline>.—</heading><content>Not later than 30 days after the date of the enactment of this Act [<date date="2000-04-05">Apr. 5, 2000</date>], the Administrator shall conform any memoranda of agreement, in effect on such date of enactment, between the Federal Aviation Administration and a person under which that person obtains aircraft situational display data to incorporate the requirements of subsection (a).”</content>
