<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idbe5213c5-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111"><num value="44111">§ 44111.</num><heading> Modifications in registration and recordation system for aircraft not providing air transportation</heading><subsection style="-uslm-lc:I11" class="indent0" id="idbe5213c6-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/a"><num value="a">(a)</num><heading> <inline class="small-caps">Application</inline>.—</heading><content>This section applies only to aircraft not used to provide air transportation.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idbe5213c7-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/b"><num value="b">(b)</num><heading> <inline class="small-caps">Authority To Make Modifications</inline>.—</heading><chapeau>The Administrator of the Federal Aviation Administration shall make modifications in the system for registering and recording aircraft necessary to make the system more effective in serving the needs of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idbe5213c8-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/b/1"><num value="1">(1)</num><content> buyers and sellers of aircraft;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbe5213c9-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/b/2"><num value="2">(2)</num><content> officials responsible for enforcing laws related to the regulation of controlled substances (as defined in section 102 of the Comprehensive Drug Abuse Prevention and Control Act of 1970 (<ref href="/us/usc/t21/s802">21 U.S.C. 802</ref>)); and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbe5213ca-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/b/3"><num value="3">(3)</num><content> other users of the system.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idbe5213cb-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/c"><num value="c">(c)</num><heading> <inline class="small-caps">Nature of Modifications</inline>.—</heading><chapeau>Modifications made under subsection (b) of this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idbe5213cc-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/c/1"><num value="1">(1)</num><content> may include a system of titling aircraft or registering all aircraft, even aircraft not operated;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbe5213cd-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/c/2"><num value="2">(2)</num><content> shall ensure positive, verifiable, and timely identification of the true owner; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbe5213ce-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/c/3"><num value="3">(3)</num><chapeau> shall address at least each of the following deficiencies in and abuses of the existing system:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idbe5213cf-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/c/3/A"><num value="A">(A)</num><content> the registration of aircraft to fictitious persons.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbe5213d0-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/c/3/B"><num value="B">(B)</num><content> the use of false or nonexistent addresses by persons registering aircraft.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbe5213d1-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/c/3/C"><num value="C">(C)</num><content> the use by a person registering an aircraft of a post office box or “mail drop” as a return address to evade identification of the person’s address.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbe5213d2-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/c/3/D"><num value="D">(D)</num><content> the registration of aircraft to entities established to facilitate unlawful activities.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbe5213d3-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/c/3/E"><num value="E">(E)</num><content> the submission of names of individuals on applications for registration of aircraft that are not identifiable.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbe5213d4-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/c/3/F"><num value="F">(F)</num><content> the ability to make frequent legal changes in the registration markings assigned to aircraft.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbe5213d5-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/c/3/G"><num value="G">(G)</num><content> the use of false registration markings on aircraft.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbe5213d6-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/c/3/H"><num value="H">(H)</num><content> the illegal use of “reserved” registration markings on aircraft.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbe5213d7-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/c/3/I"><num value="I">(I)</num><content> the large number of aircraft classified as being in “self-reported status”.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbe5213d8-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/c/3/J"><num value="J">(J)</num><content> the lack of a system to ensure timely and adequate notice of the transfer of ownership of aircraft.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbe5213d9-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/c/3/K"><num value="K">(K)</num><content> the practice of allowing temporary operation and navigation of aircraft without the issuance of a certificate of registration.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idbe5213da-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/d"><num value="d">(d)</num><heading> <inline class="small-caps">Regulations</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idbe5213db-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/d/1"><num value="1">(1)</num><content> The Administrator of the Federal Aviation Administration shall prescribe regulations to carry out this section and provide a written explanation of how the regulations address each of the deficiencies and abuses described in subsection (c) of this section. In prescribing the regulations, the Administrator of the Federal Aviation Administration shall consult with the Administrator of Drug Enforcement, the Commissioner of U.S. Customs and Border Protection, other law enforcement officials of the United States Government, representatives of State and local law enforcement officials, representatives of the general aviation aircraft industry, representatives of users of general aviation aircraft, and other interested persons.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idbe5213dc-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/d/2"><num value="2">(2)</num><chapeau> Regulations prescribed under this subsection shall require that—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idbe5213dd-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/d/2/A"><num value="A">(A)</num><content> each individual listed in an application for registration of an aircraft provide with the application the individual’s driver’s license number; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idbe5213de-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s44111/d/2/B"><num value="B">(B)</num><content> each person (not an individual) listed in an application for registration of an aircraft provide with the application the person’s taxpayer identifying number.</content>
