<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id02e75fe9-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501"><num value="44501">§ 44501.</num><heading> Plans and policy</heading><subsection style="-uslm-lc:I11" class="indent0" id="id02e75fea-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/a"><num value="a">(a)</num><heading> <inline class="small-caps">Long Range Plans and Policy Requirements</inline>.—</heading><content>The Administrator of the Federal Aviation Administration shall make long range plans and policy for the orderly development and use of the navigable airspace, and the orderly development of air navigation facilities and services, that will best meet the needs of, and serve the interests of, civil aeronautics and the national defense, except for needs of the armed forces that are peculiar to air warfare and primarily of military concern.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id02e75feb-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/b"><num value="b">(b)</num><heading> <inline class="small-caps">Airway Capital Investment Plan</inline>.—</heading><chapeau>The Administrator of the Federal Aviation Administration shall review, revise, and publish a national airways system plan, known as the Airway Capital Investment Plan, before the beginning of each fiscal year. The plan shall set forth—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id02e75fec-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/b/1"><num value="1">(1)</num><chapeau> for a 10-year period, the research, engineering, procurement, and development programs and the facilities, services, and equipment that the Administrator considers necessary for a system of airways, air traffic services, and navigation aids that will—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id02e75fed-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/b/1/A"><num value="A">(A)</num><content> meet the forecasted needs of civil aeronautics;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id02e75fee-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/b/1/B"><num value="B">(B)</num><content> meet the requirements that the Secretary of Defense establishes for the support of the national defense; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id02e75fef-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/b/1/C"><num value="C">(C)</num><content> provide the highest degree of safety in air commerce;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id02e75ff0-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/b/2"><num value="2">(2)</num><chapeau> for the first and second years of the plan, detailed annual estimates of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id02e75ff1-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/b/2/A"><num value="A">(A)</num><content> the number, type, location, and cost of acquiring, operating, and maintaining required facilities and services;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id02e75ff2-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/b/2/B"><num value="B">(B)</num><content> the cost of research, engineering, procurement, and development required to improve safety, system capacity, and efficiency; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id02e75ff3-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/b/2/C"><num value="C">(C)</num><content> personnel levels required for the activities described in subparagraphs (A) and (B);</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id02e75ff4-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/b/3"><num value="3">(3)</num><content> for the third, fourth, and fifth years of the plan, estimates of the total cost of each major program for the 3-year period, and additional major research programs, acquisition of systems, services, and facilities, and changes in personnel levels that may be required to meet long range objectives and that may have significant impact on future funding requirements;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id02e75ff5-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/b/4"><num value="4">(4)</num><chapeau> a 10-year investment plan that considers long range objectives that the Administrator considers necessary to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id02e75ff6-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/b/4/A"><num value="A">(A)</num><content> ensure that safety is given the highest priority in providing for a safe and efficient airway system; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id02e75ff7-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/b/4/B"><num value="B">(B)</num><content> meet the current and projected growth of the aerospace industry and the requirements of interstate commerce, the United States Postal Service, and the national defense; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id02e75ff8-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/b/5"><num value="5">(5)</num><content> a list of capital projects that are part of the Next Generation Air Transportation System and funded by amounts appropriated under section 48101(a).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id02e75ff9-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/c"><num value="c">(c)</num><heading> <inline class="small-caps">National Aviation Research Plan</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id02e75ffa-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/c/1"><num value="1">(1)</num><content> The Administrator of the Federal Aviation Administration shall prepare and publish annually a national aviation research plan and submit the plan to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Science of the House of Representatives. The plan shall be submitted not later than the date that is 30 days after the date of submission of the President’s budget to Congress. If such report cannot be prepared and submitted by the date that is 30 days after the date of submission of the President’s budget to Congress, the Administrator shall submit, before such date, a letter to the Chairman and Ranking Member of the Committee on Commerce, Science, and Transportation of the Senate and the Committee of <ref class="footnoteRef" idref="fn002151">1</ref><note type="footnote" id="fn002151"><num>1</num> So in original. Probably should be “on”.</note> Science, Space, and Technology of the House of Representatives stating the reason for delayed submission, impacts of the delay, and actions taken to address circumstances that led to the delay.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id02e75ffb-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/c/2"><num value="2">(2)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id02e75ffc-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/c/2/A"><num value="A">(A)</num><chapeau> The plan shall describe, for a 5-year period, the research, engineering, and development that the Administrator of the Federal Aviation Administration considers necessary—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="id02e75ffd-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/c/2/A/i"><num value="i">(i)</num><content> to ensure the continued capacity, safety, and efficiency of aviation in the United States, considering emerging technologies and forecasted needs of civil aeronautics; and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id02e75ffe-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/c/2/A/ii"><num value="ii">(ii)</num><content> to provide the highest degree of safety in air travel.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id02e75fff-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/c/2/B"><num value="B">(B)</num><chapeau> The plan shall—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="id02e76000-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/c/2/B/i"><num value="i">(i)</num><content> provide estimates by year of the schedule, cost, and work force levels for each active and planned major research and development project under sections 44504, 44505, 44507, 44509, 44511–44513, and 44912 of this title, including activities carried out under cooperative agreements with other Federal departments and agencies;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id02e76001-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/c/2/B/ii"><num value="ii">(ii)</num><content> specify the goals and the priorities for allocation of resources among the major categories of research and development activities, including the rationale for the priorities identified;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id02e76002-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/c/2/B/iii"><num value="iii">(iii)</num><content> identify the allocation of resources among long-term research, near-term research, and development activities;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id02e76003-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/c/2/B/iv"><num value="iv">(iv)</num><content> identify the individual research and development projects in each funding category that are described in the annual budget request;</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id02e76004-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/c/2/B/v"><num value="v">(v)</num><content> highlight the research and development activities that address specific recommendations of the research advisory committee established under <ref href="/us/usc/t49/s44508">section 44508 of this title</ref>, and document the recommendations of the committee that are not accepted, specifying the reasons for nonacceptance; and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id02e76005-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/c/2/B/vi"><num value="vi">(vi)</num><content> highlight the research and development technology transfer activities that promote technology sharing among government, industry, and academia through the Stevenson-Wydler Technology Innovation Act of 1980.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id02e76006-2931-11f1-84cf-986a8fef9c11" identifier="/us/usc/t49/s44501/c/3"><num value="3">(3)</num><content> Subject to section 44912(d)(2) and regulations prescribed under such section, the Administrator of the Federal Aviation Administration shall submit to the committees named in paragraph (1) of this subsection an annual report on the accomplishments of the research completed during the prior fiscal year, including a description of the dissemination to the private sector of research results and a description of any new technologies developed. The report shall be submitted with the plan required under paragraph (1) and be organized to allow comparison with the plan in effect for the prior fiscal year. The report shall be prepared in accordance with requirements of <ref href="/us/usc/t31/s1116">section 1116 of title 31</ref>.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Contents</inline>.—</heading><chapeau>The report shall include—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> recommendations of the Administrator on realignment and consolidation of services and facilities (including regional offices) of the FAA; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><chapeau> for each of the recommendations, a description of—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> the Administrator’s justification;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> the projected costs and savings; and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iii">“(iii)</num><content> the proposed timing for implementation.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><heading> <inline class="small-caps">Input</inline>.—</heading><chapeau>The report shall be prepared by the Administrator (or the Administrator’s designee) with the participation of—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> representatives of labor organizations representing air traffic control system employees of the FAA; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> industry stakeholders.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><heading> <inline class="small-caps">Submission to congress</inline>.—</heading><content>Not later than 120 days after the date of enactment of this Act [<date date="2012-02-14">Feb. 14, 2012</date>], the Administrator shall submit the report to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><heading> <inline class="small-caps">Public notice and comment</inline>.—</heading><content>The Administrator shall publish the report in the Federal Register and allow 45 days for the submission of public comments.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Report to Congress Containing Recommendations of Administrator</inline>.—</heading><chapeau>Not later than 60 days after the last day of the period for public comment under subsection (a)(6), the Administrator shall submit to the committees specified in subsection (a)(5)—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> a report containing the recommendations of the Administrator on realignment and consolidation of services and facilities (including regional offices) of the FAA; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> copies of any public comments received by the Administrator under subsection (a)(6).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Realignment and Consolidation of FAA Services and Facilities</inline>.—</heading><content>Except as provided in subsection (d), the Administrator shall realign and consolidate the services and facilities of the FAA in accordance with the recommendations included in the report submitted under subsection (b).</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Congressional Disapproval.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>The Administrator may not carry out a recommendation for realignment or consolidation of services or facilities of the FAA that is included in the report submitted under subsection (b) if a joint resolution of disapproval is enacted disapproving such recommendation before the earlier of—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> the last day of the 30-day period beginning on the date of submission of the report; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> the adjournment of Congress sine die for the session during which the report is transmitted.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Computation of 30-day period</inline>.—</heading><content>For purposes of paragraph (1)(A), the days on which either House of Congress is not in session because of an adjournment of more than 3 days to a day certain shall be excluded in computation of the 30-day period.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Military Operations Exclusion.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Administrator may not realign or consolidate a combined TRACON and tower with radar facility of the FAA under this section if, in 2015, the total annual military operations at the facility comprised at least 40 percent of the total annual TRACON operations at the facility.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">TRACON defined</inline>.—</heading><content>In this subsection, the term ‘TRACON’ means terminal radar approach control.</content>
