<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id893f3b12-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508"><num value="44508">§ 44508.</num><heading> Research advisory committee</heading><subsection style="-uslm-lc:I11" class="indent0" id="id893f3b13-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/a"><num value="a">(a)</num><heading> <inline class="small-caps">Establishment and Duties</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id893f3b14-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/a/1"><num value="1">(1)</num><chapeau> There is a research advisory committee in the Federal Aviation Administration. The committee shall—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id893f3b15-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/a/1/A"><num value="A">(A)</num><content> provide advice and recommendations to the Administrator of the Federal Aviation Administration and Congress about needs, objectives, plans, approaches, content, and accomplishments of all aviation research and development activities and programs carried out, including those under sections 40119,<ref class="footnoteRef" idref="fn002133">1</ref><note type="footnote" id="fn002133"><num>1</num> See References in Text note below.</note> 44504, 44505, 44507, 44511–44513, and 44912 of this title;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id893f3b16-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/a/1/B"><num value="B">(B)</num><content> assist in ensuring that the research is coordinated with similar research being conducted outside the Administration;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id893f3b17-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/a/1/C"><num value="C">(C)</num><content> review the operations of the regional centers of air transportation excellence established under <ref href="/us/usc/t49/s44513">section 44513 of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id893f3b18-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/a/1/D"><num value="D">(D)</num><content> annually review the allocation made by the Administrator of the amounts authorized by <ref href="/us/usc/t49/s48102/a">section 48102(a) of this title</ref> among the major categories of research and development activities carried out by the Administration and provide advice and recommendations to the Administrator on whether such allocation is appropriate to meet the needs and objectives identified under subparagraph (A).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id893f3b19-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/a/2"><num value="2">(2)</num><content> The Administrator may establish subordinate committees to provide advice on specific areas of research conducted under sections 40119,<sup>1</sup> 44504, 44505, 44507, 44511–44513, and 44912 of this title.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id893f3b1a-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/b"><num value="b">(b)</num><heading> <inline class="small-caps">Members, Chairman, Pay, and Expenses</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id893f3b1b-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/b/1"><num value="1">(1)</num><content> The committee is composed of not more than 30 members appointed by the Administrator from among individuals who are not employees of the Administration and who are specially qualified to serve on the committee because of their education, training, or experience. In appointing members of the committee, the Administrator shall ensure that the regional centers of air transportation excellence, universities, corporations, associations, consumers, and other departments, agencies, and instrumentalities of the United States Government are represented.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id893f3b1c-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/b/2"><num value="2">(2)</num><content> The Administrator shall designate the chairman of the committee.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id893f3b1d-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/b/3"><num value="3">(3)</num><content> A member of the committee serves without pay. However, the Administrator may allow a member, when attending meetings of the committee or a subordinate committee, expenses as authorized under <ref href="/us/usc/t5/s5703">section 5703 of title 5</ref>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id893f3b1e-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/c"><num value="c">(c)</num><heading> <inline class="small-caps">Support Staff, Information, and Services</inline>.—</heading><content>The Administrator shall provide support staff for the committee. On request of the committee, the Administrator shall provide information, administrative services, and supplies that the Administrator considers necessary for the committee to carry out its duties and powers.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id893f3b1f-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/d"><num value="d">(d)</num><heading> <inline class="small-caps">Nonapplication</inline>.—</heading><content>Section 14 of the Federal Advisory Committee Act (5 App. U.S.C.) does not apply to the committee.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id893f3b20-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/e"><num value="e">(e)</num><heading> <inline class="small-caps">Use and Limitation of Amounts</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id893f3b21-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/e/1"><num value="1">(1)</num><content> Not more than .1 percent of the amounts made available to conduct research under sections 40119,<sup>1</sup> 44504, 44505, 44507, 44511–44513, and 44912 of this title may be used by the Administrator to carry out this section.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id893f3b22-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/e/2"><num value="2">(2)</num><content> A limitation on amounts available for obligation by or for the committee does not apply to amounts made available to carry out this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id893f3b23-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/f"><num value="f">(f)</num><heading> <inline class="small-caps">Written Reply.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id893f3b24-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/f/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Not later than 60 days after receiving any recommendation from the research advisory committee, the Administrator shall provide a written reply to the research advisory committee that, at a minimum—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id893f3b25-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/f/1/A"><num value="A">(A)</num><content> clearly states whether the Administrator accepts or rejects the recommendation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id893f3b26-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/f/1/B"><num value="B">(B)</num><content> explains the rationale for the Administrator’s decision;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id893f3b27-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/f/1/C"><num value="C">(C)</num><content> sets forth the timeframe in which the Administrator will implement the recommendation; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id893f3b28-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/f/1/D"><num value="D">(D)</num><content> describes the steps the Administrator will take to implement the recommendation.</content>
</subparagraph>

<paragraph style="-uslm-lc:I12" class="indent1" id="id893f3b29-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/f/2"><num value="2">(2)</num><heading> <inline class="small-caps">Transparency</inline>.—</heading><chapeau>The written reply to the research advisory committee, when transmitted to the research advisory committee, shall be—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id893f3b2a-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/f/2/A"><num value="A">(A)</num><content> made publicly available on the research advisory committee website; and</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="id893f3b2b-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s44508/f/2/B"><num value="B">(B)</num><content> transmitted to the Committee on Science, Space, and Technology of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate.</content>
