<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id92a6cf25-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s44511"><num value="44511">§ 44511.</num><heading> Aviation research grants</heading><subsection style="-uslm-lc:I11" class="indent0" id="id92a6cf26-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s44511/a"><num value="a">(a)</num><heading> General Authority.—</heading><content>The Administrator of the Federal Aviation Administration may make grants to institutions of higher education and nonprofit research organizations to conduct aviation research in areas the Administrator considers necessary for the long-term growth of civil aviation.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id92a6cf27-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s44511/b"><num value="b">(b)</num><heading> Applications.—</heading><content>An institution of higher education or nonprofit research organization interested in receiving a grant under this section may submit an application to the Administrator. The application must be in the form and contain the information the Administrator requires.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id92a6cf28-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s44511/c"><num value="c">(c)</num><heading> Solicitation, Review, and Evaluation Process.—</heading><chapeau>The Administrator shall establish a solicitation, review, and evaluation process that ensures—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id92a6cf29-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s44511/c/1"><num value="1">(1)</num><content> providing grants under this section for proposals having adequate merit and relevancy to the mission of the Administration;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id92a6cf2a-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s44511/c/2"><num value="2">(2)</num><content> a fair geographical distribution of grants under this section; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id92a6cf2b-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s44511/c/3"><num value="3">(3)</num><content> the inclusion of historically black institutions of higher education and other minority nonprofit research organizations for grant consideration under this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id92a6cf2c-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s44511/d"><num value="d">(d)</num><heading> Records.—</heading><content>Each person receiving a grant under this section shall maintain records that the Administrator requires as being necessary to facilitate an effective audit and evaluation of the use of money provided under the grant.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id92a6cf2d-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s44511/e"><num value="e">(e)</num><heading> Annual Report.—</heading><content>The Administrator shall submit an annual report to the Committee on Science of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on carrying out this section.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id92a6cf2e-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s44511/f"><num value="f">(f)</num><heading> Airport Cooperative Research Program.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id92a6cf2f-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s44511/f/1"><num value="1">(1)</num><heading> Establishment.—</heading><chapeau>The Secretary of Transportation shall maintain an airport cooperative research program to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id92a6cf30-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s44511/f/1/A"><num value="A">(A)</num><content> identify problems that are shared by airport operating agencies and can be solved through applied research but that are not being adequately addressed by existing Federal research programs; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id92a6cf31-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s44511/f/1/B"><num value="B">(B)</num><content> fund research to address those problems.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id92a6cf32-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s44511/f/2"><num value="2">(2)</num><heading> Governance.—</heading><content>The Secretary of Transportation shall appoint an independent governing board for the research program established under this subsection. The governing board shall be appointed from candidates nominated by national associations representing public airport operating agencies, airport executives, State aviation officials, and the scheduled airlines, and shall include representatives of appropriate Federal agencies. Section 14 of the Federal Advisory Committee Act shall not apply to the governing board.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id92a6cf33-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s44511/f/3"><num value="3">(3)</num><heading> Implementation.—</heading><content>The Secretary of Transportation shall enter into an arrangement with the National Academy of Sciences to provide staff support to the governing board established under paragraph (2) and to carry out projects proposed by the governing board that the Secretary considers appropriate.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id92a6cf34-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s44511/f/4"><num value="4">(4)</num><heading> Report.—</heading><content>Not later than <date date="2012-09-30">September 30, 2012</date>, the Secretary shall transmit to the Congress a report on the program.</content>
