<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id357ec784-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44702"><num value="44702">§ 44702.</num><heading> Issuance of certificates</heading><subsection style="-uslm-lc:I11" class="indent0" id="id357ec785-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44702/a"><num value="a">(a)</num><heading> <inline class="small-caps">General Authority and Applications</inline>.—</heading><chapeau>The Administrator of the Federal Aviation Administration may issue airman certificates, design organization certificates, type certificates, production certificates, airworthiness certificates, air carrier operating certificates, airport operating certificates, air agency certificates, and air navigation facility certificates under this chapter. An application for a certificate must—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id357ec786-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44702/a/1"><num value="1">(1)</num><content> be under oath when the Administrator requires; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id357ec787-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44702/a/2"><num value="2">(2)</num><content> be in the form, contain information, and be filed and served in the way the Administrator prescribes.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id357ec788-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44702/b"><num value="b">(b)</num><heading> <inline class="small-caps">Considerations</inline>.—</heading><chapeau>When issuing a certificate under this chapter, the Administrator shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id357ec789-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44702/b/1"><num value="1">(1)</num><chapeau> consider—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id357ec78a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44702/b/1/A"><num value="A">(A)</num><content> the duty of an air carrier to provide service with the highest possible degree of safety in the public interest; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id357ec78b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44702/b/1/B"><num value="B">(B)</num><content> differences between air transportation and other air commerce; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id357ec78c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44702/b/2"><num value="2">(2)</num><content> classify a certificate according to the differences between air transportation and other air commerce.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id357ec78d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44702/c"><num value="c">(c)</num><heading> <inline class="small-caps">Prior Certification</inline>.—</heading><content>The Administrator may authorize an aircraft, aircraft engine, propeller, or appliance for which a certificate has been issued authorizing the use of the aircraft, aircraft engine, propeller, or appliance in air transportation to be used in air commerce without another certificate being issued.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id357ec78e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44702/d"><num value="d">(d)</num><heading> <inline class="small-caps">Delegation</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id357ec78f-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44702/d/1"><num value="1">(1)</num><chapeau> Subject to regulations, supervision, and review the Administrator may prescribe, the Administrator may delegate to a qualified private person, or to an employee under the supervision of that person, a matter related to—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id357ec790-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44702/d/1/A"><num value="A">(A)</num><content> the examination, testing, and inspection necessary to issue a certificate under this chapter; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id357ec791-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44702/d/1/B"><num value="B">(B)</num><content> issuing the certificate.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id357ec792-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44702/d/2"><num value="2">(2)</num><content> The Administrator may rescind a delegation under this subsection at any time for any reason the Administrator considers appropriate.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id357ec793-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44702/d/3"><num value="3">(3)</num><content> A person affected by an action of a private person under this subsection may apply for reconsideration of the action by the Administrator. On the Administrator’s own initiative, the Administrator may reconsider the action of a private person at any time. If the Administrator decides on reconsideration that the action is unreasonable or unwarranted, the Administrator shall change, modify, or reverse the action. If the Administrator decides the action is warranted, the Administrator shall affirm the action.</content>

<p style="-uslm-lc:I21" class="indent0">In subsection (a), the reference to a type certificate and production certificate is added for clarity.</p>
