<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id4b239078-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704"><num value="44704">§ 44704.</num><heading> Type certificates, production certificates, airworthiness certificates,,<ref class="footnoteRef" idref="fn002138">1</ref><note type="footnote" id="fn002138"><num>1</num> So in original.</note> and design and production organization certificates</heading><subsection style="-uslm-lc:I11" class="indent0" id="id4b239079-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/a"><num value="a">(a)</num><heading> <inline class="small-caps">Type Certificates</inline>.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id4b23907a-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">Issuance, investigations, and tests</inline>.—</heading><content>The Administrator of the Federal Aviation Administration shall issue a type certificate for an aircraft, aircraft engine, or propeller, or for an appliance specified under paragraph (2)(A) of this subsection when the Administrator finds that the aircraft, aircraft engine, propeller, or appliance is properly designed and manufactured, performs properly, and meets the regulations and minimum standards prescribed under <ref href="/us/usc/t49/s44701/a">section 44701(a) of this title</ref>. On receiving an application for a type certificate, the Administrator shall investigate the application and may conduct a hearing. The Administrator shall make, or require the applicant to make, tests the Administrator considers necessary in the interest of safety.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b23907b-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/a/2"><num value="2">(2)</num><heading> <inline class="small-caps">Specifications</inline>.—</heading><chapeau>The Administrator may—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id4b23907c-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/a/2/A"><num value="A">(A)</num><content> specify in regulations those appliances that reasonably require a type certificate in the interest of safety;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4b23907d-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/a/2/B"><num value="B">(B)</num><content> include in a type certificate terms required in the interest of safety; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4b23907e-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/a/2/C"><num value="C">(C)</num><content> record on the certificate a numerical specification of the essential factors related to the performance of the aircraft, aircraft engine, or propeller for which the certificate is issued.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b23b78f-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/a/3"><num value="3">(3)</num><heading> <inline class="small-caps">Special rules for new aircraft and appliances</inline>.—</heading><content>Except as provided in paragraph (4), if the holder of a type certificate agrees to permit another person to use the certificate to manufacture a new aircraft, aircraft engine, propeller, or appliance, the holder shall provide the other person with written evidence, in a form acceptable to the Administrator, of that agreement. Such other person may manufacture a new aircraft, aircraft engine, propeller, or appliance based on a type certificate only if such other person is the holder of the type certificate or has permission from the holder.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b23b790-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/a/4"><num value="4">(4)</num><heading> <inline class="small-caps">Limitation for aircraft manufactured before <date date="2004-08-05">august 5, 2004</date></inline>.—</heading><content>Paragraph (3) shall not apply to a person who began the manufacture of an aircraft before <date date="2004-08-05">August 5, 2004</date>, and who demonstrates to the satisfaction of the Administrator that such manufacture began before <date date="2004-08-05">August 5, 2004</date>, if the name of the holder of the type certificate for the aircraft does not appear on the airworthiness certificate or identification plate of the aircraft. The holder of the type certificate for the aircraft shall not be responsible for the continued airworthiness of the aircraft. A person may invoke the exception provided by this paragraph with regard to the manufacture of only one aircraft.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b23b791-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/a/5"><num value="5">(5)</num><heading> Release of data.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id4b23b792-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/a/5/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Notwithstanding any other provision of law, the Administrator may make available upon request, to a person seeking to maintain the airworthiness or develop product improvements of an aircraft, engine, propeller, or appliance, engineering data in the possession of the Administration relating to a type certificate or a supplemental type certificate for such aircraft, engine, propeller, or appliance, without the consent of the owner of record, if the Administrator determines that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id4b23b793-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/a/5/A/i"><num value="i">(i)</num><content> the certificate containing the requested data has been inactive for 3 or more years, except that the Administrator may reduce this time if required to address an unsafe condition associated with the product;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id4b23b794-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/a/5/A/ii"><num value="ii">(ii)</num><content> after using due diligence, the Administrator is unable to find the owner of record, or the owner of record’s heir, of the type certificate or supplemental type certificate; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id4b23b795-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/a/5/A/iii"><num value="iii">(iii)</num><content> making such data available will enhance aviation safety.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4b23b796-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/a/5/B"><num value="B">(B)</num><heading> <inline class="small-caps">Engineering data defined</inline>.—</heading><content>In this section, the term “engineering data” as used with respect to an aircraft, engine, propeller, or appliance means type design drawing and specifications for the entire aircraft, engine, propeller, or appliance or change to the aircraft, engine, propeller, or appliance, including the original design data, and any associated supplier data for individual parts or components approved as part of the particular certificate for the aircraft, engine, propeller, or appliance.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4b23b797-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/a/5/C"><num value="C">(C)</num><heading> <inline class="small-caps">Requirement to maintain data</inline>.—</heading><content>The Administrator shall maintain engineering data in the possession of the Administration relating to a type certificate or a supplemental type certificate that has been inactive for 3 or more years.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b23b798-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/b"><num value="b">(b)</num><heading> Supplemental Type Certificates.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id4b23b799-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">Issuance</inline>.—</heading><content>The Administrator may issue a type certificate designated as a supplemental type certificate for a change to an aircraft, aircraft engine, propeller, or appliance.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b23deaa-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Contents</inline>.—</heading><content>A supplemental type certificate issued under paragraph (1) shall consist of the change to the aircraft, aircraft engine, propeller, or appliance with respect to the previously issued type certificate for the aircraft, aircraft engine, propeller, or appliance.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b23deab-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/b/3"><num value="3">(3)</num><heading> <inline class="small-caps">Requirement</inline>.—</heading><content>If the holder of a supplemental type certificate agrees to permit another person to use the certificate to modify an aircraft, aircraft engine, propeller, or appliance, the holder shall provide the other person with written evidence, in a form acceptable to the Administrator, of that agreement. A person may change an aircraft, aircraft engine, propeller, or appliance based on a supplemental type certificate only if the person requesting the change is the holder of the supplemental type certificate or has permission from the holder to make the change.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b23deac-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/c"><num value="c">(c)</num><heading> <inline class="small-caps">Production Certificates</inline>.—</heading><content>The Administrator shall issue a production certificate authorizing the production of a duplicate of an aircraft, aircraft engine, propeller, or appliance for which a type certificate has been issued when the Administrator finds the duplicate will conform to the certificate. On receiving an application, the Administrator shall inspect, and may require testing of, a duplicate to ensure that it conforms to the requirements of the certificate. The Administrator may include in a production certificate terms required in the interest of safety.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b23dead-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/d"><num value="d">(d)</num><heading> <inline class="small-caps">Airworthiness Certificates</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id4b23deae-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/d/1"><num value="1">(1)</num><content> The registered owner of an aircraft may apply to the Administrator for an airworthiness certificate for the aircraft. The Administrator shall issue an airworthiness certificate when the Administrator finds that the aircraft conforms to its type certificate and, after inspection, is in condition for safe operation. The Administrator shall register each airworthiness certificate and may include appropriate information in the certificate. The certificate number or other individual designation the Administrator requires shall be displayed on the aircraft. The Administrator may include in an airworthiness certificate terms required in the interest of safety.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id4b2405bf-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/d/2"><num value="2">(2)</num><content> A person applying for the issuance or renewal of an airworthiness certificate for an aircraft for which ownership has not been recorded under section 44107 or 44110 of this title must submit with the application information related to the ownership of the aircraft the Administrator decides is necessary to identify each person having a property interest in the aircraft and the kind and extent of the interest.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b2405c0-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/e"><num value="e">(e)</num><heading> Design and Production Organization Certificates.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id4b2405c1-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/e/1"><num value="1">(1)</num><heading> <inline class="small-caps">Issuance</inline>.—</heading><content>Beginning <date date="2013-01-01">January 1, 2013</date>, the Administrator may issue a certificate to a design organization, production organization, or design and production organization to authorize the organization to certify compliance of aircraft, aircraft engines, propellers, and appliances with the requirements and minimum standards prescribed under section 44701(a). An organization holding a certificate issued under this subsection shall be known as a certified design and production organization (in this subsection referred to as a “CDPO”).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b2405c2-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/e/2"><num value="2">(2)</num><heading> <inline class="small-caps">Applications</inline>.—</heading><content>On receiving an application for a CDPO certificate, the Administrator shall examine and rate the organization submitting the application, in accordance with regulations to be prescribed by the Administrator, to determine whether the organization has adequate engineering, design, and production capabilities, standards, and safeguards to make certifications of compliance as described in paragraph (1).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b2405c3-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/e/3"><num value="3">(3)</num><heading> <inline class="small-caps">Issuance of certificates based on cdpo findings</inline>.—</heading><content>The Administrator may rely on certifications of compliance by a CDPO when making determinations under this section.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b2405c4-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/e/4"><num value="4">(4)</num><heading> <inline class="small-caps">Public safety</inline>.—</heading><content>The Administrator shall include in a CDPO certificate terms required in the interest of safety.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b2405c5-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44704/e/5"><num value="5">(5)</num><heading> <inline class="small-caps">No effect on power of revocation</inline>.—</heading><content>Nothing in this subsection affects the authority of the Secretary of Transportation to revoke a certificate.</content>

<section style="-uslm-lc:I580467"><num value="2">“SEC. 2.</num><heading> FINDINGS.</heading><chapeau>“Congress makes the following findings:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> A healthy small aircraft industry is integral to economic growth and to maintaining an effective transportation infrastructure for communities and countries around the world.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> Small airplanes comprise nearly 90 percent of general aviation aircraft certified by the Federal Aviation Administration.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> General aviation provides for the cultivation of a workforce of engineers, manufacturing and maintenance professionals, and pilots who secure the economic success and defense of the United States.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> General aviation contributes to well-paying jobs in the manufacturing and technology sectors in the United States and products produced by those sectors are exported in great numbers.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> Technology developed and proven in general aviation aids in the success and safety of all sectors of aviation and scientific competence.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><content> The average small airplane in the United States is now 40 years old and the regulatory barriers to bringing new designs to the market are resulting in a lack of innovation and investment in small airplane design.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="7">“(7)</num><content> Since 2003, the United States lost 10,000 active private pilots per year on average, partially due to a lack of cost-effective, new small airplanes.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="8">“(8)</num><content> General aviation safety can be improved by modernizing and revamping the regulations relating to small airplanes to clear the path for technology adoption and cost-effective means to retrofit the existing fleet with new safety technologies.</content>
</paragraph>
</section>
<section style="-uslm-lc:I580467"><num value="3">“SEC. 3.</num><heading> SAFETY AND REGULATORY IMPROVEMENTS FOR GENERAL AVIATION.</heading><subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><chapeau>Not later than <date date="2015-12-15">December 15, 2015</date>, the Administrator of the Federal Aviation Administration shall issue a final rule—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> to advance the safety and continued development of small airplanes by reorganizing the certification requirements for such airplanes under part 23 to streamline the approval of safety advancements; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> that meets the objectives described in subsection (b).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Objectives Described</inline>.—</heading><chapeau>The objectives described in this subsection are based on the recommendations of the Part 23 Reorganization Aviation Rulemaking Committee:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> The establishment of a regulatory regime for small airplanes that will improve safety and reduce the regulatory cost burden for the Federal Aviation Administration and the aviation industry.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> The establishment of broad, outcome-driven safety objectives that will spur innovation and technology adoption.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> The replacement of current, prescriptive requirements under part 23 with performance-based regulations.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> The use of consensus standards accepted by the Federal Aviation Administration to clarify how the safety objectives of part 23 may be met using specific designs and technologies.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Consensus-Based Standards</inline>.—</heading><content>In prescribing regulations under this section, the Administrator shall use consensus standards, as described in section 12(d) of the National Technology Transfer and Advancement Act of 1996 [1995] (<ref href="/us/usc/t15/s272">15 U.S.C. 272</ref> note), to the extent practicable while continuing traditional methods for meeting part 23.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Safety Cooperation</inline>.—</heading><content>The Administrator shall lead the effort to improve general aviation safety by working with leading aviation regulators to assist them in adopting a complementary regulatory approach for small airplanes.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> Consensus standards.—</heading><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The term ‘consensus standards’ means standards developed by an organization described in subparagraph (B) that may include provisions requiring that owners of relevant intellectual property have agreed to make that intellectual property available on a nondiscriminatory, royalty-free, or reasonable royalty basis to all interested persons.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><heading> <inline class="small-caps">Organizations described</inline>.—</heading><chapeau>An organization described in this subparagraph is a domestic or international organization that—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> plans, develops, establishes, or coordinates, through a process based on consensus and using agreed-upon procedures, voluntary standards; and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> operates in a transparent manner, considers a balanced set of interests with respect to such standards, and provides for due process and an appeals process with respect to such standards.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Part 23</inline>.—</heading><content>The term ‘part 23’ means part 23 of title 14, Code of Federal Regulations.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Part 23 reorganization aviation rulemaking committee</inline>.—</heading><content>The term ‘Part 23 Reorganization Aviation Rulemaking Committee’ means the aviation rulemaking committee established by the Federal Aviation Administration in August 2011 to consider the reorganization of the regulations under part 23.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><heading> <inline class="small-caps">Small airplane</inline>.—</heading><content>The term ‘small airplane’ means an airplane which is certified to part 23 standards.”</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Contents</inline>.—</heading><chapeau>In conducting the assessment, the Administrator shall consider—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> the expected number of applications for product certifications and approvals the Administrator will receive under section 44704 of such title in the 1-year, 5-year, and 10-year periods following the date of enactment of this Act [<date date="2012-02-14">Feb. 14, 2012</date>];</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> process reforms and improvements necessary to allow the Administrator to review and approve the applications in a fair and timely fashion;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> the status of recommendations made in previous reports on the Administration’s certification process;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> methods for enhancing the effective use of delegation systems, including organizational designation authorization;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> methods for training the Administration’s field office employees in the safety management system and auditing; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><content> the status of updating airworthiness requirements, including implementing recommendations in the Administration’s report entitled ‘Part 23—Small Airplane Certification Process Study’ (OK–09–3468, dated July 2009).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Recommendations</inline>.—</heading><content>In conducting the assessment, the Administrator shall make recommendations to improve efficiency and reduce costs through streamlining and reengineering the certification process under section 44704 of such title to ensure that the Administrator can conduct certifications and approvals under such section in a manner that supports and enables the development of new products and technologies and the global competitiveness of the United States aviation industry.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Report to Congress</inline>.—</heading><content>Not later than 180 days after the date of enactment of this Act [<date date="2012-02-14">Feb. 14, 2012</date>], the Administrator shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the results of the assessment, together with an explanation of how the Administrator will implement recommendations made under subsection (c) and measure the effectiveness of the recommendations.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Implementation of Recommendations</inline>.—</heading><content>Not later than 1 year after the date of enactment of this Act [<date date="2012-02-14">Feb. 14, 2012</date>], the Administrator shall begin to implement the recommendations made under subsection (c).”</content>

Such revision shall prohibit the destruction of the historical aircraft documents identified in paragraph (1).</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Consultation</inline>.—</heading><content>The Administrator may carry out paragraph (1) in consultation with the Archivist of the United States and the Administrator of General Services.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> Availability of Documents.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Freedom of information act requests</inline>.—</heading><chapeau>The Administrator shall make the documents to be preserved under subsection (a)(1) available to a person—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> upon receipt of a request made by the person pursuant to <ref href="/us/usc/t5/s552">section 552 of title 5</ref>, United States Code; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> subject to a prohibition on use of the documents for commercial purposes.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Trade secrets, commercial, and financial information</inline>.—</heading><content>Section 552(b)(4) of such title shall not apply to requests for documents to be made available pursuant to paragraph (1).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> Holder of Type Certificate.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Rights of holder</inline>.—</heading><content>Nothing in this section shall affect the rights of a holder or owner of a type certificate identified in subsection (a)(1), nor require the holder or owner to provide, surrender, or preserve any original or duplicate engineering or technical data to or for the Federal Aviation Administration, a person, or the public.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Liability</inline>.—</heading><content>There shall be no liability on the part of, and no cause of action of any nature shall arise against, a holder of a type certificate, its authorized representative, its agents, or its employees, or any firm, person, corporation, or insurer related to the type certificate data and documents identified in subsection (a)(1).</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Airworthiness</inline>.—</heading><content>Notwithstanding any other provision of law, the holder of a type certificate identified in subsection (a)(1) shall only be responsible for Federal Aviation Administration regulation requirements related to type certificate data and documents identified in subsection (a)(1) for aircraft having a standard airworthiness certificate issued prior to the date the documents are released to a person by the Federal Aviation Administration under subsection (b)(1).”</content>
