In clause (3), the words “in his opinion” are omitted as surplus.</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"id894b222b-a3d3-11e9-a7cd-8d0abbe94c89\"><heading class=\"centered smallCaps\">Aircraft Repair and Maintenance Advisory Panel</heading><p><ref href=\"/us/pl/106/181/tVII/s734\">Pub. L. 106–181, title VII, § 734</ref>, <date date=\"2000-04-05\">Apr. 5, 2000</date>, <ref href=\"/us/stat/114/170\">114 Stat. 170</ref>, provided that:<quotedContent origin=\"/us/pl/106/181/tVII/s734\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Establishment of Panel</inline>.—</heading><chapeau>The Administrator [of the Federal Aviation Administration]—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> shall establish an aircraft repair and maintenance advisory panel to review issues related to the use and oversight of aircraft and aviation component repair and maintenance facilities (in this section referred to as ‘aircraft repair facilities’) located within, or outside of, the United States; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> may seek the advice of the panel on any issue related to methods to increase safety by improving the oversight of aircraft repair facilities.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Membership</inline>.—</heading><chapeau>The panel shall consist of—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><chapeau> nine members appointed by the Administrator as follows:</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> three representatives of labor organizations representing aviation mechanics;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> one representative of cargo air carriers;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> one representative of passenger air carriers;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"D\">“(D)</num><content> one representative of aircraft repair facilities;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"E\">“(E)</num><content> one representative of aircraft manufacturers;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"F\">“(F)</num><content> one representative of on-demand passenger air carriers and corporate aircraft operations; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"G\">“(G)</num><content> one representative of regional passenger air carriers;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> one representative from the Department of Commerce, designated by the Secretary of Commerce;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> one representative from the Department of State, designated by the Secretary of State; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> one representative from the Federal Aviation Administration, designated by the Administrator.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Responsibilities</inline>.—</heading><chapeau>The panel shall—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> determine the amount and type of work that is being performed by aircraft repair facilities located within, and outside of, the United States; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> provide advice and counsel to the Secretary [of Transportation] with respect to the aircraft and aviation component repair work performed by aircraft repair facilities and air carriers, staffing needs, and any balance of trade or safety issues associated with that work.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">DOT To Request Information From Air Carriers and Repair Facilities.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Collection of information</inline>.—</heading><content>The Secretary, by regulation, shall require air carriers, foreign air carriers, domestic repair facilities, and foreign repair facilities to submit such information as the Secretary may require in order to assess balance of trade and safety issues with respect to work performed on aircraft used by air carriers, foreign air carriers, United States corporate operators, and foreign corporate operators.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Drug and alcohol testing information</inline>.—</heading><content>Included in the information the Secretary requires under paragraph (1) shall be information on the existence and administration of employee drug and alcohol testing programs in place at the foreign repair facilities, if applicable. The Secretary, if necessary, shall work with the International Civil Aviation Organization to increase the number and improve the administration of employee drug and alcohol testing programs at the foreign repair facilities.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Description of work done</inline>.—</heading><content>Included in the information the Secretary requires under paragraph (1) shall be information on the amount and type of work performed on aircraft registered in and outside of the United States.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"e\">“(e)</num><heading> <inline class=\"small-caps\">DOT To Facilitate Collection of Information About Aircraft Maintenance</inline>.—</heading><content>The Secretary shall facilitate the collection of information from the National Transportation Safety Board, the Federal Aviation Administration, and other appropriate agencies regarding maintenance performed by aircraft repair facilities.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"f\">“(f)</num><heading> <inline class=\"small-caps\">DOT To Make Information Available to Public</inline>.—</heading><content>The Secretary shall make any relevant information received under subsection (d) available to the public, consistent with the authority to withhold trade secrets or commercial, financial, and other proprietary information under <ref href=\"/us/usc/t5/s552\">section 552 of title 5</ref>, United States Code.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"g\">“(g)</num><heading> <inline class=\"small-caps\">Termination</inline>.—</heading><chapeau>The panel established under subsection (a) shall terminate on the earlier of—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> the date that is 2 years after the date of the enactment of this Act [<date date=\"2000-04-05\">Apr. 5, 2000</date>]; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> <date date=\"2001-12-31\">December 31, 2001</date>.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"h\">“(h)</num><heading> <inline class=\"small-caps\">Definitions</inline>.—</heading><content>The definitions contained in <ref href=\"/us/usc/t49/s40102\">section 40102 of title 49</ref>, United States Code, shall apply to this section.”</content>\n</subsection>\n</quotedContent>\n</p>\n</note>\n</notes>\n</section>","provision":null,"duplicates":[],"release":{"label":"116-34","currency_date":"2019-07-29","congress":116,"law_num":34,"excluded_laws":[],"update_num":null,"seq":179,"is_partial":false,"caveat":null,"titles_affected":["10","36","49"],"ingested_titles":[]},"served_from":{"label":"116-34","currency_date":"2019-07-29","congress":116,"law_num":34,"excluded_laws":[],"update_num":null,"seq":179,"is_partial":false,"caveat":null,"titles_affected":["10","36","49"],"ingested_titles":[]},"content_first_seen":{"label":"116-29","currency_date":"2019-07-05","congress":116,"law_num":29,"excluded_laws":[],"update_num":null,"seq":177,"is_partial":false,"caveat":null,"titles_affected":["02","06","07","15","16","19","21","26","34","38","42","43","48","49","50"],"ingested_titles":[]},"is_exact":true,"note":null}
