<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id358864d8-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44735"><num value="44735">§ 44735.</num><heading> Limitation on disclosure of safety information</heading><subsection style="-uslm-lc:I11" class="indent0" id="id358864d9-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44735/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>Except as provided by subsection (c), a report, data, or other information described in subsection (b) shall not be disclosed to the public by the Administrator of the Federal Aviation Administration pursuant to <ref href="/us/usc/t5/s552/b/3/B">section 552(b)(3)(B) of title 5</ref> if the report, data, or other information is submitted to the Federal Aviation Administration voluntarily and is not required to be submitted to the Administrator under any other provision of law.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id358864da-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44735/b"><num value="b">(b)</num><heading> <inline class="small-caps">Applicability</inline>.—</heading><chapeau>The limitation established by subsection (a) shall apply to the following:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id358864db-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44735/b/1"><num value="1">(1)</num><content> Reports, data, or other information developed under the Aviation Safety Action Program.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id358864dc-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44735/b/2"><num value="2">(2)</num><content> Reports, data, or other information produced or collected under the Flight Operational Quality Assurance Program.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id358864dd-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44735/b/3"><num value="3">(3)</num><content> Reports, data, or other information developed under the Line Operations Safety Audit Program.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id358864de-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44735/b/4"><num value="4">(4)</num><content> Reports, data, or other information produced or collected for purposes of developing and implementing a safety management system acceptable to the Administrator.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id358864df-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44735/b/5"><num value="5">(5)</num><content> Reports, analyses, and directed studies, based in whole or in part on reports, data, or other information described in paragraphs (1) through (4), including those prepared under the Aviation Safety Information Analysis and Sharing Program (or any successor program).</content>
</paragraph>

<subsection style="-uslm-lc:I11" class="indent0" id="id358864e0-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44735/c"><num value="c">(c)</num><heading> Exception for De-identified Information.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id358864e1-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44735/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The limitation established by subsection (a) shall not apply to a report, data, or other information if the information contained in the report, data, or other information has been de-identified.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id358864e2-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s44735/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">De-identified defined</inline>.—</heading><content>In this subsection, the term “de-identified” means the process by which all information that is likely to establish the identity of the specific persons or entities submitting reports, data, or other information is removed from the reports, data, or other information.</content>
