<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id4b3cbe0d-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935"><num value="44935">§ 44935.</num><heading> Employment standards and training</heading><subsection style="-uslm-lc:I11" class="indent0" id="id4b3cbe0e-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/a"><num value="a">(a)</num><heading> <inline class="small-caps">Employment Standards</inline>.—</heading><chapeau>The Under Secretary of Transportation for Security shall prescribe standards for the employment and continued employment of, and contracting for, air carrier personnel and, as appropriate, airport security personnel. The standards shall include—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id4b3cbe0f-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/a/1"><num value="1">(1)</num><content> minimum training requirements for new employees;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b3cbe10-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/a/2"><num value="2">(2)</num><content> retraining requirements;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b3cbe11-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/a/3"><num value="3">(3)</num><content> minimum staffing levels;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b3cbe12-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/a/4"><num value="4">(4)</num><content> minimum language skills; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b3cbe13-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/a/5"><num value="5">(5)</num><content> minimum education levels for employees, when appropriate.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b3cbe14-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/b"><num value="b">(b)</num><heading> <inline class="small-caps">Review and Recommendations</inline>.—</heading><content>In coordination with air carriers, airport operators, and other interested persons, the Under Secretary shall review issues related to human performance in the aviation security system to maximize that performance. When the review is completed, the Under Secretary shall recommend guidelines and prescribe appropriate changes in existing procedures to improve that performance.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b3ce525-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/c"><num value="c">(c)</num><heading> <inline class="small-caps">Security Program Training, Standards, and Qualifications</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id4b3ce526-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/c/1"><num value="1">(1)</num><chapeau> The Under Secretary—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id4b3ce527-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/c/1/A"><num value="A">(A)</num><content> may train individuals employed to carry out a security program under <ref href="/us/usc/t49/s44903/c">section 44903(c) of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id4b3ce528-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/c/1/B"><num value="B">(B)</num><content> shall prescribe uniform training standards and uniform minimum qualifications for individuals eligible for that training.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id4b3ce529-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/c/2"><num value="2">(2)</num><content> The Under Secretary may authorize reimbursement for travel, transportation, and subsistence expenses for security training of non-United States Government domestic and foreign individuals whose services will contribute significantly to carrying out civil aviation security programs. To the extent practicable, air travel reimbursed under this paragraph shall be on air carriers.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b3ce52a-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/d"><num value="d">(d)</num><heading> <inline class="small-caps">Education and Training Standards for Security Coordinators, Supervisory Personnel, and Pilots</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id4b3ce52b-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/d/1"><num value="1">(1)</num><chapeau> The Under Secretary shall prescribe standards for educating and training—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id4b3ce52c-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/d/1/A"><num value="A">(A)</num><content> ground security coordinators;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id4b3ce52d-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/d/1/B"><num value="B">(B)</num><content> security supervisory personnel; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id4b3ce52e-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/d/1/C"><num value="C">(C)</num><content> airline pilots as in-flight security coordinators.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id4b3ce52f-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/d/2"><num value="2">(2)</num><content> The standards shall include initial training, retraining, and continuing education requirements and methods. Those requirements and methods shall be used annually to measure the performance of ground security coordinators and security supervisory personnel.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b3ce530-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/e"><num value="e">(e)</num><heading> Security Screeners.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id4b3ce531-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/e/1"><num value="1">(1)</num><heading> <inline class="small-caps">Training program</inline>.—</heading><content>The Under Secretary of Transportation for Security shall establish a program for the hiring and training of security screening personnel.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b3ce532-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/e/2"><num value="2">(2)</num><heading> Hiring.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id4b3ce533-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/e/2/A"><num value="A">(A)</num><heading> <inline class="small-caps">Qualifications</inline>.—</heading><chapeau>Within 30 days after the date of enactment of the Aviation and Transportation Security Act, the Under Secretary shall establish qualification standards for individuals to be hired by the United States as security screening personnel. Notwithstanding any provision of law, those standards shall require, at a minimum, an individual—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id4b3ce534-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/e/2/A/i"><num value="i">(i)</num><content> to have a satisfactory or better score on a Federal security screening personnel selection examination;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id4b3ce535-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/e/2/A/ii"><num value="ii">(ii)</num><content> to be a citizen of the United States or a national of the United States, as defined in section 1101(a)(22) <ref class="footnoteRef" idref="fn002152">1</ref><note type="footnote" id="fn002152"><num>1</num> So in original. Probably should be section “101(a)(22)”.</note> of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1101/a/22">8 U.S.C. 1101(a)(22)</ref>);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id4b3ce536-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/e/2/A/iii"><num value="iii">(iii)</num><content> to meet, at a minimum, the requirements set forth in subsection (f);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id4b3ce537-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/e/2/A/iv"><num value="iv">(iv)</num><content> to meet such other qualifications as the Under Secretary may establish; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id4b3ce538-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/e/2/A/v"><num value="v">(v)</num><content> to have the ability to demonstrate daily a fitness for duty without any impairment due to illegal drugs, sleep deprivation, medication, or alcohol.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4b3ce539-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/e/2/B"><num value="B">(B)</num><heading> <inline class="small-caps">Background checks</inline>.—</heading><content>The Under Secretary shall require that an individual to be hired as a security screener undergo an employment investigation (including a criminal history record check) under section 44936(a)(1).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4b3ce53a-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/e/2/C"><num value="C">(C)</num><heading> <inline class="small-caps">Disqualification of individuals who present national security risks</inline>.—</heading><content>The Under Secretary, in consultation with the heads of other appropriate Federal agencies, shall establish procedures, in addition to any background check conducted under section 44936, to ensure that no individual who presents a threat to national security is employed as a security screener.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b3d0c4b-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/e/3"><num value="3">(3)</num><heading> <inline class="small-caps">Examination; review of existing rules</inline>.—</heading><content>The Under Secretary shall develop a security screening personnel examination for use in determining the qualification of individuals seeking employment as security screening personnel. The Under Secretary shall also review, and revise as necessary, any standard, rule, or regulation governing the employment of individuals as security screening personnel.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b3d0c4c-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f"><num value="f">(f)</num><heading> Employment Standards for Screening Personnel.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id4b3d0c4d-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/1"><num value="1">(1)</num><heading> <inline class="small-caps">Screener requirements</inline>.—</heading><chapeau>Notwithstanding any provision of law, an individual may not be deployed as a security screener unless that individual meets the following requirements:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id4b3d0c4e-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/1/A"><num value="A">(A)</num><content> The individual shall possess a high school diploma, a general equivalency diploma, or experience that the Under Secretary has determined to be sufficient for the individual to perform the duties of the position.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4b3d0c4f-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/1/B"><num value="B">(B)</num><chapeau> The individual shall possess basic aptitudes and physical abilities, including color perception, visual and aural acuity, physical coordination, and motor skills, to the following standards:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id4b3d0c50-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/1/B/i"><num value="i">(i)</num><content> Screeners operating screening equipment shall be able to distinguish on the screening equipment monitor the appropriate imaging standard specified by the Under Secretary.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id4b3d0c51-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/1/B/ii"><num value="ii">(ii)</num><content> Screeners operating any screening equipment shall be able to distinguish each color displayed on every type of screening equipment and explain what each color signifies.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id4b3d0c52-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/1/B/iii"><num value="iii">(iii)</num><content> Screeners shall be able to hear and respond to the spoken voice and to audible alarms generated by screening equipment in an active checkpoint environment.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id4b3d0c53-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/1/B/iv"><num value="iv">(iv)</num><content> Screeners performing physical searches or other related operations shall be able to efficiently and thoroughly manipulate and handle such baggage, containers, and other objects subject to security processing.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id4b3d0c54-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/1/B/v"><num value="v">(v)</num><content> Screeners who perform pat-downs or hand-held metal detector searches of individuals shall have sufficient dexterity and capability to thoroughly conduct those procedures over an individual’s entire body.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4b3d0c55-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/1/C"><num value="C">(C)</num><chapeau> The individual shall be able to read, speak, and write English well enough to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id4b3d0c56-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/1/C/i"><num value="i">(i)</num><content> carry out written and oral instructions regarding the proper performance of screening duties;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id4b3d0c57-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/1/C/ii"><num value="ii">(ii)</num><content> read English language identification media, credentials, airline tickets, and labels on items normally encountered in the screening process;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id4b3d0c58-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/1/C/iii"><num value="iii">(iii)</num><content> provide direction to and understand and answer questions from English-speaking individuals undergoing screening; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id4b3d0c59-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/1/C/iv"><num value="iv">(iv)</num><content> write incident reports and statements and log entries into security records in the English language.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4b3d0c5a-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/1/D"><num value="D">(D)</num><content> The individual shall have satisfactorily completed all initial, recurrent, and appropriate specialized training required by the security program, except as provided in paragraph (3).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b3d0c5b-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/2"><num value="2">(2)</num><heading> <inline class="small-caps">Veterans preference</inline>.—</heading><content>The Under Secretary shall provide a preference for the hiring of an individual as a security screener if the individual is a member or former member of the armed forces and if the individual is entitled, under statute, to retired, retirement, or retainer pay on account of service as a member of the armed forces.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b3d0c5c-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/3"><num value="3">(3)</num><heading> <inline class="small-caps">Exceptions</inline>.—</heading><chapeau>An individual who has not completed the training required by this section may be deployed during the on-the-job portion of training to perform functions if that individual—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id4b3d336d-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/3/A"><num value="A">(A)</num><content> is closely supervised; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4b3d336e-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/3/B"><num value="B">(B)</num><content> does not make independent judgments as to whether individuals or property may enter a sterile area or aircraft without further inspection.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b3d336f-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/4"><num value="4">(4)</num><heading> <inline class="small-caps">Remedial training</inline>.—</heading><content>No individual employed as a security screener may perform a screening function after that individual has failed an operational test related to that function until that individual has successfully completed the remedial training specified in the security program.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b3d3370-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/5"><num value="5">(5)</num><heading> <inline class="small-caps">Annual proficiency review</inline>.—</heading><chapeau>The Under Secretary shall provide that an annual evaluation of each individual assigned screening duties is conducted and documented. An individual employed as a security screener may not continue to be employed in that capacity unless the evaluation demonstrates that the individual—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id4b3d3371-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/5/A"><num value="A">(A)</num><content> continues to meet all qualifications and standards required to perform a screening function;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4b3d3372-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/5/B"><num value="B">(B)</num><content> has a satisfactory record of performance and attention to duty based on the standards and requirements in the security program; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4b3d3373-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/5/C"><num value="C">(C)</num><content> demonstrates the current knowledge and skills necessary to courteously, vigilantly, and effectively perform screening functions.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b3d3374-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/f/6"><num value="6">(6)</num><heading> <inline class="small-caps">Operational testing</inline>.—</heading><content>In addition to the annual proficiency review conducted under paragraph (5), the Under Secretary shall provide for the operational testing of such personnel.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b3d3375-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/g"><num value="g">(g)</num><heading> Training.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id4b3d3376-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/g/1"><num value="1">(1)</num><heading> <inline class="small-caps">Use of other agencies</inline>.—</heading><content>The Under Secretary may enter into a memorandum of understanding or other arrangement with any other Federal agency or department with appropriate law enforcement responsibilities, to provide personnel, resources, or other forms of assistance in the training of security screening personnel.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b3d3377-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/g/2"><num value="2">(2)</num><heading> <inline class="small-caps">Training plan</inline>.—</heading><chapeau>Within 60 days after the date of enactment of the Aviation and Transportation Security Act, the Under Secretary shall develop a plan for the training of security screening personnel. The plan shall require, at a minimum, that a security screener—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id4b3d3378-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/g/2/A"><num value="A">(A)</num><content> has completed 40 hours of classroom instruction or successfully completed a program that the Under Secretary determines will train individuals to a level of proficiency equivalent to the level that would be achieved by such classroom instruction;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4b3d3379-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/g/2/B"><num value="B">(B)</num><content> has completed 60 hours of on-the-job instructions; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4b3d337a-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/g/2/C"><num value="C">(C)</num><content> has successfully completed an on-the-job training examination prescribed by the Under Secretary.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b3d337b-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/g/3"><num value="3">(3)</num><heading> <inline class="small-caps">Equipment-specific training</inline>.—</heading><content>An individual employed as a security screener may not use any security screening device or equipment in the scope of that individual’s employment unless the individual has been trained on that device or equipment and has successfully completed a test on the use of the device or equipment.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b3d337c-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/h"><num value="h">(h)</num><heading> Technological Training.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id4b3d337d-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s44935/h/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Under Secretary shall require training to ensure that screeners are proficient in using the most up-to-date new technology and to ensure their proficiency in recognizing new threats and weapons.</content>
</paragraph>

L. 104–264, title V</ref>, § 504, <date date="1996-10-09">Oct. 9, 1996</date>, <ref href="/us/stat/110/3263">110 Stat. 3263</ref>, provided that:<quotedContent origin="/us/pl/104/264/tV">
<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">Study</inline>.—</heading><content>The Administrator of the Federal Aviation Administration shall conduct a study to determine whether current minimum flight time requirements applicable to individuals seeking employment as a pilot with an air carrier are sufficient to ensure public safety.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Report</inline>.—</heading><content>Not later than 1 year after the date of the enactment of this Act [<date date="1996-10-09">Oct. 9, 1996</date>], the Administrator shall transmit to Congress a report on the results of the study.”</content>
