<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8971478c-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s45103"><num value="45103">§ 45103.</num><heading> Prohibited service</heading><subsection style="-uslm-lc:I11" class="indent0" id="id8971478d-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s45103/a"><num value="a">(a)</num><heading> <inline class="small-caps">Use of Alcohol or a Controlled Substance</inline>.—</heading><content>An individual may not use alcohol or a controlled substance after <date date="1991-10-28">October 28, 1991</date>, in violation of law or a United States Government regulation and serve as an airman, crewmember, airport security screening employee, air carrier employee responsible for safety-sensitive functions (as decided by the Administrator of the Federal Aviation Administration), or employee of the Administration with responsibility for safety-sensitive functions.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id8971478e-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s45103/b"><num value="b">(b)</num><heading> <inline class="small-caps">Rehabilitation Required To Resume Service</inline>.—</heading><content>Notwithstanding subsection (a) of this section, an individual found to have used alcohol or a controlled substance after <date date="1991-10-28">October 28, 1991</date>, in violation of law or a Government regulation may serve as an airman, crewmember, airport security screening employee, air carrier employee responsible for safety-sensitive functions (as decided by the Administrator), or employee of the Administration with responsibility for safety-sensitive functions only if the individual completes a rehabilitation program described in <ref href="/us/usc/t49/s45105">section 45105 of this title</ref>.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id8971478f-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s45103/c"><num value="c">(c)</num><heading> <inline class="small-caps">Performance of Prior Duties Prohibited</inline>.—</heading><chapeau>An individual who served as an airman, crewmember, airport security screening employee, air carrier employee responsible for safety-sensitive functions (as decided by the Administrator), or employee of the Administration with responsibility for safety-sensitive functions and who was found by the Administrator to have used alcohol or a controlled substance after <date date="1991-10-28">October 28, 1991</date>, in violation of law or a Government regulation may not carry out the duties related to air transportation that the individual carried out before the finding of the Administrator if the individual—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id89714790-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s45103/c/1"><num value="1">(1)</num><content> used the alcohol or controlled substance when on duty;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id89714791-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s45103/c/2"><num value="2">(2)</num><content> began or completed a rehabilitation program described in <ref href="/us/usc/t49/s45105">section 45105 of this title</ref> before using the alcohol or controlled substance; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id89714792-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s45103/c/3"><num value="3">(3)</num><content> refuses to begin or complete a rehabilitation program described in <ref href="/us/usc/t49/s45105">section 45105 of this title</ref> after a finding by the Administrator under this section.</content>
