<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id89787434-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s46320"><num value="46320">§ 46320.</num><heading> Interference with wildfire suppression, law enforcement, or emergency response effort by operation of unmanned aircraft</heading><subsection style="-uslm-lc:I11" class="indent0" id="id89787435-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s46320/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>Except as provided in subsection (b), an individual who operates an unmanned aircraft and in so doing knowingly or recklessly interferes with a wildfire suppression, law enforcement, or emergency response effort is liable to the United States Government for a civil penalty of not more than $20,000.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id897abd26-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s46320/b"><num value="b">(b)</num><heading> <inline class="small-caps">Exceptions</inline>.—</heading><content>This section does not apply to the operation of an unmanned aircraft conducted by a unit or agency of the United States Government or of a State, tribal, or local government (including any individual conducting such operation pursuant to a contract or other agreement entered into with the unit or agency) for the purpose of protecting the public safety and welfare, including firefighting, law enforcement, or emergency response.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id897abd27-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s46320/c"><num value="c">(c)</num><heading> <inline class="small-caps">Compromise and Setoff.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id897abd28-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s46320/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">Compromise</inline>.—</heading><content>The United States Government may compromise the amount of a civil penalty imposed under this section.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id897abd29-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s46320/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">Setoff</inline>.—</heading><content>The United States Government may deduct the amount of a civil penalty imposed or compromised under this section from the amounts the Government owes the person liable for the penalty.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id897abd2a-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s46320/d"><num value="d">(d)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section, the following definitions apply:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id897abd2b-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s46320/d/1"><num value="1">(1)</num><heading> <inline class="small-caps">Wildfire</inline>.—</heading><content>The term “wildfire” has the meaning given that term in section 2 of the Emergency Wildfire Suppression Act (<ref href="/us/usc/t42/s1856m">42 U.S.C. 1856m</ref>).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abd2c-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s46320/d/2"><num value="2">(2)</num><heading> <inline class="small-caps">Wildfire suppression</inline>.—</heading><content>The term “wildfire suppression” means an effort to contain, extinguish, or suppress a wildfire.</content>
