<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id897abd92-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101"><num value="47101">§ 47101.</num><heading> Policies</heading><subsection style="-uslm-lc:I11" class="indent0" id="id897abd93-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/a"><num value="a">(a)</num><heading> <inline class="small-caps">General</inline>.—</heading><chapeau>It is the policy of the United States—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id897abd94-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/a/1"><num value="1">(1)</num><content> that the safe operation of the airport and airway system is the highest aviation priority;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abd95-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/a/2"><num value="2">(2)</num><content> that aviation facilities be constructed and operated to minimize current and projected noise impact on nearby communities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abd96-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/a/3"><num value="3">(3)</num><content> to give special emphasis to developing reliever airports;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abd97-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/a/4"><num value="4">(4)</num><content> that appropriate provisions should be made to make the development and enhancement of cargo hub airports easier;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abd98-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/a/5"><num value="5">(5)</num><content> to encourage the development of intermodal connections on airport property between aeronautical and other transportation modes and systems to serve air transportation passengers and cargo efficiently and effectively and promote economic development;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abd99-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/a/6"><num value="6">(6)</num><content> that airport development projects under this subchapter provide for the protection and enhancement of natural resources and the quality of the environment of the United States;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abd9a-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/a/7"><num value="7">(7)</num><content> that airport construction and improvement projects that increase the capacity of facilities to accommodate passenger and cargo traffic be undertaken to the maximum feasible extent so that safety and efficiency increase and delays decrease;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abd9b-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/a/8"><num value="8">(8)</num><content> to ensure that nonaviation usage of the navigable airspace be accommodated but not allowed to decrease the safety and capacity of the airspace and airport system;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abd9c-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/a/9"><num value="9">(9)</num><chapeau> that artificial restrictions on airport capacity—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id897abd9d-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/a/9/A"><num value="A">(A)</num><content> are not in the public interest;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id897abd9e-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/a/9/B"><num value="B">(B)</num><content> should be imposed to alleviate air traffic delays only after other reasonably available and less burdensome alternatives have been tried; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id897abd9f-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/a/9/C"><num value="C">(C)</num><content> should not discriminate unjustly between categories and classes of aircraft;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abda0-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/a/10"><num value="10">(10)</num><content> that special emphasis should be placed on converting appropriate former military air bases to civil use and identifying and improving additional joint-use facilities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abda1-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/a/11"><num value="11">(11)</num><content> that the airport improvement program should be administered to encourage projects that employ innovative technology (including integrated in-pavement lighting systems for runways and taxiways and other runway and taxiway incursion prevention devices), concepts, and approaches that will promote safety, capacity, and efficiency improvements in the construction of airports and in the air transportation system (including the development and use of innovative concrete and other materials in the construction of airport facilities to minimize initial laydown costs, minimize time out of service, and maximize lifecycle durability) and to encourage and solicit innovative technology proposals and activities in the expenditure of funding pursuant to this subchapter;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abda2-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/a/12"><num value="12">(12)</num><content> that airport fees, rates, and charges must be reasonable and may only be used for purposes not prohibited by this subchapter; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abda3-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/a/13"><num value="13">(13)</num><content> that airports should be as self-sustaining as possible under the circumstances existing at each particular airport and in establishing new fees, rates, and charges, and generating revenues from all sources, airport owners and operators should not seek to create revenue surpluses that exceed the amounts to be used for airport system purposes and for other purposes for which airport revenues may be spent under <ref href="/us/usc/t49/s47107/b/1">section 47107(b)(1) of this title</ref>, including reasonable reserves and other funds to facilitate financing and cover contingencies.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id897abda4-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/b"><num value="b">(b)</num><heading> <inline class="small-caps">National Transportation Policy</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id897abda5-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/b/1"><num value="1">(1)</num><content> It is a goal of the United States to develop a national intermodal transportation system that transports passengers and property in an efficient manner. The future economic direction of the United States depends on its ability to confront directly the enormous challenges of the global economy, declining productivity growth, energy vulnerability, air pollution, and the need to rebuild the infrastructure of the United States.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id897abda6-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/b/2"><num value="2">(2)</num><content> United States leadership in the world economy, the expanding wealth of the United States, the competitiveness of the industry of the United States, the standard of living, and the quality of life are at stake.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id897abda7-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/b/3"><num value="3">(3)</num><content> A national intermodal transportation system is a coordinated, flexible network of diverse but complementary forms of transportation that transports passengers and property in the most efficient manner. By reducing transportation costs, these intermodal systems will enhance the ability of the industry of the United States to compete in the global marketplace.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id897abda8-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/b/4"><num value="4">(4)</num><content> All forms of transportation, including aviation and other transportation systems of the future, will be full partners in the effort to reduce energy consumption and air pollution while promoting economic development.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id897abda9-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/b/5"><num value="5">(5)</num><content> An intermodal transportation system consists of transportation hubs that connect different forms of appropriate transportation and provides users with the most efficient means of transportation and with access to commercial centers, business locations, population centers, and the vast rural areas of the United States, as well as providing links to other forms of transportation and to intercity connections.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id897abdaa-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/b/6"><num value="6">(6)</num><content> Intermodality and flexibility are paramount issues in the process of developing an integrated system that will obtain the optimum yield of United States resources.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id897abdab-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/b/7"><num value="7">(7)</num><content> The United States transportation infrastructure must be reshaped to provide the economic underpinnings for the United States to compete in the 21st century global economy. The United States can no longer rely on the sheer size of its economy to dominate international economic rivals and must recognize fully that its economy is no longer a separate entity but is part of the global marketplace. The future economic prosperity of the United States depends on its ability to compete in an international marketplace that is teeming with competitors but in which a full one-quarter of the economic activity of the United States takes place.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id897abdac-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/b/8"><num value="8">(8)</num><content> The United States must make a national commitment to rebuild its infrastructure through development of a national intermodal transportation system. The United States must provide the foundation for its industries to improve productivity and their ability to compete in the global economy with a system that will transport passengers and property in an efficient manner.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id897abdad-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/c"><num value="c">(c)</num><heading> <inline class="small-caps">Capacity Expansion and Noise Abatement</inline>.—</heading><content>It is in the public interest to recognize the effects of airport capacity expansion projects on aircraft noise. Efforts to increase capacity through any means can have an impact on surrounding communities. Noncompatible land uses around airports must be reduced and efforts to mitigate noise must be given a high priority.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id897abdae-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/d"><num value="d">(d)</num><heading> <inline class="small-caps">Consistency With Air Commerce and Safety Policies</inline>.—</heading><content>Each airport and airway program should be carried out consistently with section 40101(a), (b), (d), and (f) of this title to foster competition, prevent unfair methods of competition in air transportation, maintain essential air transportation, and prevent unjust and discriminatory practices, including as the practices may be applied between categories and classes of aircraft.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id897abdaf-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/e"><num value="e">(e)</num><heading> <inline class="small-caps">Adequacy of Navigation Aids and Airport Facilities</inline>.—</heading><chapeau>This subchapter should be carried out to provide adequate navigation aids and airport facilities for places at which scheduled commercial air service is provided. The facilities provided may include—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id897abdb0-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/e/1"><num value="1">(1)</num><content> reliever airports; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abdb1-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/e/2"><num value="2">(2)</num><content> heliports designated by the Secretary of Transportation to relieve congestion at commercial service airports by diverting aircraft passengers from fixed-wing aircraft to helicopter carriers.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id897abdb2-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/f"><num value="f">(f)</num><heading> <inline class="small-caps">Maximum Use of Safety Facilities</inline>.—</heading><chapeau>This subchapter should be carried out consistently with a comprehensive airspace system plan, giving highest priority to commercial service airports, to maximize the use of safety facilities, including installing, operating, and maintaining, to the extent possible with available money and considering other safety needs—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id897abdb3-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/f/1"><num value="1">(1)</num><content> electronic or visual vertical guidance on each runway;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abdb4-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/f/2"><num value="2">(2)</num><content> grooving or friction treatment of each primary and secondary runway;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abdb5-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/f/3"><num value="3">(3)</num><content> distance-to-go signs for each primary and secondary runway;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abdb6-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/f/4"><num value="4">(4)</num><content> a precision approach system, a vertical visual guidance system, and a full approach light system for each primary runway;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abdb7-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/f/5"><num value="5">(5)</num><content> a nonprecision instrument approach for each secondary runway;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abdb8-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/f/6"><num value="6">(6)</num><content> runway end identifier lights on each runway that does not have an approach light system;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abdb9-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/f/7"><num value="7">(7)</num><content> a surface movement radar system at each category III airport;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abdba-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/f/8"><num value="8">(8)</num><content> a taxiway lighting and sign system;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abdbb-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/f/9"><num value="9">(9)</num><content> runway edge lighting and marking;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abdbc-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/f/10"><num value="10">(10)</num><content> radar approach coverage for each airport terminal area; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abdbd-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/f/11"><num value="11">(11)</num><content> runway and taxiway incursion prevention devices, including integrated in-pavement lighting systems for runways and taxiways.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id897abdbe-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/g"><num value="g">(g)</num><heading> <inline class="small-caps">Intermodal Planning</inline>.—</heading><chapeau>To carry out the policy of subsection (a)(5) of this section, the Secretary of Transportation shall take each of the following actions:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id897abdbf-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/g/1"><num value="1">(1)</num><heading> <inline class="small-caps">Coordination in development of airport plans and programs</inline>.—</heading><content>Cooperate with State and local officials in developing airport plans and programs that are based on overall transportation needs. The airport plans and programs shall be developed in coordination with other transportation planning and considering comprehensive long-range land-use plans and overall social, economic, environmental, system performance, and energy conservation objectives. The process of developing airport plans and programs shall be continuing, cooperative, and comprehensive to the degree appropriate to the complexity of the transportation problems.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abdc0-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/g/2"><num value="2">(2)</num><heading> <inline class="small-caps">Goals for airport master and system plans</inline>.—</heading><chapeau>Encourage airport sponsors and State and local officials to develop airport master plans and airport system plans that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id897abdc1-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/g/2/A"><num value="A">(A)</num><content> foster effective coordination between aviation planning and metropolitan planning;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id897abdc2-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/g/2/B"><num value="B">(B)</num><content> include an evaluation of aviation needs within the context of multimodal planning;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id897abdc3-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/g/2/C"><num value="C">(C)</num><content> consider passenger convenience, airport ground access, and access to airport facilities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id897abdc4-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/g/2/D"><num value="D">(D)</num><content> are integrated with metropolitan plans to ensure that airport development proposals include adequate consideration of land use and ground transportation access.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abdc5-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/g/3"><num value="3">(3)</num><heading> <inline class="small-caps">Representation of airport operators on mpo’s</inline>.—</heading><content>Encourage metropolitan planning organizations, particularly in areas with populations greater than 200,000, to establish membership positions for airport operators.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id897abdc6-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/h"><num value="h">(h)</num><heading> <inline class="small-caps">Consultation</inline>.—</heading><chapeau>To carry out the policy of subsection (a)(6) of this section, the Secretary of Transportation shall consult with the Secretary of the Interior and the Administrator of the Environmental Protection Agency about any project included in a project grant application involving the location of an airport or runway, or a major runway extension, that may have a significant effect on—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id897abdc7-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/h/1"><num value="1">(1)</num><content> natural resources, including fish and wildlife;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abdc8-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/h/2"><num value="2">(2)</num><content> natural, scenic, and recreation assets;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abdc9-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/h/3"><num value="3">(3)</num><content> water and air quality; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id897abdca-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s47101/h/4"><num value="4">(4)</num><content> another factor affecting the environment.</content>

The airport plans and programs shall be developed in coordination with other transportation planning and considering comprehensive long-range land-use plans and overall social, economic, environmental, system performance, and energy conservation objectives. The process of developing airport plans and programs shall be continuing, cooperative, and comprehensive to the degree appropriate to the complexity of the transportation problems.”</p>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Exceptions</inline>.—</heading><chapeau>Subsection (a) does not apply to—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><chapeau> any regulation ensuring—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> the safe and efficient operation of aircraft or safety of people and property on the ground related to aircraft operations;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> that an airport owner or operator receives not less than fair market value in the context of a commercial transaction for the use, lease, encumbrance, transfer, or disposal of land, any facilities on such land, or any portion of such land or facilities; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> that the airport pays not more than fair market value in the context of a commercial transaction for the acquisition of land or facilities on such land;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> any regulation imposed with respect to land or a facility acquired or modified using Federal funding; or</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><chapeau> any authority contained in—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> a Surplus Property Act [of 1944, <ref href="/us/act/1944-10-03/ch479">act Oct. 3, 1944, ch. 479</ref>, <ref href="/us/stat/58/765">58 Stat. 765</ref>] instrument of transfer, or</content>

</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> near- and long-term actions designed to reduce the severity, number, and rate of runway incursions, losses of standard separation, and operational errors;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iii">“(iii)</num><content> time frames and resources needed for the actions described in clause (ii);</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iv">“(iv)</num><content> a continuous evaluative process to track performance toward the goals referred to in clause (i); and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="v">“(v)</num><content> a review with respect to runway safety of every commercial service airport (as defined in <ref href="/us/usc/t49/s47102">section 47102 of title 49</ref>, United States Code) in the United States and proposed action to improve airport lighting, provide better signs, and improve runway and taxiway markings at those airports; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> shall address the increased runway safety risk associated with the expected increased volume of air traffic.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Process</inline>.—</heading><chapeau>Not later than 6 months after the date of enactment of this Act [<date date="2012-02-14">Feb. 14, 2012</date>], the Administrator shall develop a process for tracking and investigating operational errors, losses of standard separation, and runway incursions that includes procedures for—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> identifying who is responsible for tracking operational errors, losses of standard separation, and runway incursions, including a process for lower level employees to report to higher supervisory levels and for frontline managers to receive the information in a timely manner;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> conducting periodic random audits of the oversight process; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> ensuring proper accountability.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Plan for Installation and Deployment of Systems To Provide Alerts of Potential Runway Incursions</inline>.—</heading><content>Not later than <date date="2012-06-30">June 30, 2012</date>, the Administrator shall submit to Congress a report containing a plan for the installation and deployment of systems to alert air traffic controllers or flight crewmembers, or both, of potential runway incursions. The plan shall be integrated into the annual NextGen Implementation Plan of the Administration or any successor document.”</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> Approaches that would permit entering into agreements with non-Federal entities, such as airport sponsors, for the loan of Federal funds, guarantee of loan repayment, or purchase of insurance or other forms of enhancement for borrower debt, including the use of unobligated Airport Improvement Program contract authority and unobligated balances in the Airport and Airway Trust Fund.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> Means to lower the cost of financing airport development.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Consultation</inline>.—</heading><content>In considering innovative financing pursuant to this section, the Secretary may consult with airport owners and operators and public and private sector experts.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Report to Congress</inline>.—</heading><content>Not later than 12 months after the date of the enactment of this Act [<date date="1994-08-23">Aug. 23, 1994</date>], the Secretary shall transmit to Congress a report on the results of the study conducted under subsection (a).”</content>
