<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id35a9a7d8-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s47112"><num value="47112">§ 47112.</num><heading> Carrying out airport development projects</heading><subsection style="-uslm-lc:I11" class="indent0" id="id35a9a7d9-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s47112/a"><num value="a">(a)</num><heading> <inline class="small-caps">Construction Work</inline>.—</heading><content>The Secretary of Transportation may inspect and approve construction work for an airport development project carried out under a grant agreement under this subchapter. The construction work must be carried out in compliance with regulations the Secretary prescribes. The regulations shall require the sponsor to make necessary cost and progress reports on the project. The regulations may amend or modify a contract related to the project only if the contract was made with actual notice of the regulations.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id35a9a7da-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s47112/b"><num value="b">(b)</num><heading> <inline class="small-caps">Prevailing Wages</inline>.—</heading><content>A contract for more than $2,000 involving labor for an airport development project carried out under a grant agreement under this subchapter must require contractors to pay labor minimum wage rates as determined by the Secretary of Labor under sections 3141–3144, 3146, and 3147 of title 40. The minimum rates must be included in the bids for the work and in the invitation for those bids.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id35a9a7db-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s47112/c"><num value="c">(c)</num><heading> <inline class="small-caps">Veterans’ Preference</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id35a9a7dc-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s47112/c/1"><num value="1">(1)</num><chapeau> In this subsection—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id35a9a7dd-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s47112/c/1/A"><num value="A">(A)</num><content> “disabled veteran” has the same meaning given that term in <ref href="/us/usc/t5/s2108">section 2108 of title 5</ref>.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id35a9a7de-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s47112/c/1/B"><num value="B">(B)</num><content> “Vietnam-era veteran” means an individual who served on active duty (as defined in <ref href="/us/usc/t38/s101">section 101 of title 38</ref>) in the armed forces for more than 180 consecutive days, any part of which occurred after <date date="1964-08-04">August 4, 1964</date>, and before <date date="1975-05-08">May 8, 1975</date>, and who was discharged or released from active duty in the armed forces under honorable conditions.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id35a9a7df-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s47112/c/1/C"><num value="C">(C)</num><content> “Afghanistan-Iraq war veteran” means an individual who served on active duty (as defined in <ref href="/us/usc/t38/s101">section 101 of title 38</ref>) in the armed forces in support of Operation Enduring Freedom, Operation Iraqi Freedom, or Operation New Dawn for more than 180 consecutive days, any part of which occurred after <date date="2001-09-11">September 11, 2001</date>, and before the date prescribed by presidential proclamation or by law as the last day of Operation Enduring Freedom, Operation Iraqi Freedom, or Operation New Dawn (whichever is later), and who was discharged or released from active duty in the armed forces under honorable conditions.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id35a9a7e0-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s47112/c/1/D"><num value="D">(D)</num><content> “Persian Gulf veteran” means an individual who served on active duty in the armed forces in the Southwest Asia theater of operations during the Persian Gulf War for more than 180 consecutive days, any part of which occurred after <date date="1990-08-02">August 2, 1990</date>, and before the date prescribed by presidential proclamation or by law, and who was discharged or released from active duty in the armed forces under honorable conditions.</content>
</subparagraph>

<paragraph style="-uslm-lc:I11" class="indent0" id="id35a9a7e1-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s47112/c/2"><num value="2">(2)</num><content> A contract involving labor for carrying out an airport development project under a grant agreement under this subchapter must require that preference in the employment of labor (except in executive, administrative, and supervisory positions) be given to Vietnam-era veterans, Persian Gulf veterans, Afghanistan-Iraq war veterans, disabled veterans, and small business concerns (as defined in section 3 of the Small Business Act (<ref href="/us/usc/t15/s632">15 U.S.C. 632</ref>)) owned and controlled by disabled veterans when they are available and qualified for the employment.</content>
