<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id4b5c5447-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136"><num value="47136">§ 47136.</num><heading> Inherently low-emission airport vehicle pilot program</heading><subsection style="-uslm-lc:I11" class="indent0" id="id4b5c5448-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>The Secretary of Transportation shall carry out a pilot program at not more than 10 public-use airports under which the sponsors of such airports may use funds made available under section 48103 for use at such airports to carry out inherently low-emission vehicle activities. Notwithstanding any other provision of this subchapter, inherently low-emission vehicle activities shall for purposes of the pilot program be treated as eligible for assistance under this subchapter.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b5c5449-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/b"><num value="b">(b)</num><heading> Location in Air Quality Nonattainment Areas.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id4b5c544a-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>A public-use airport shall be eligible for participation in the pilot program only if the airport is located in an air quality nonattainment area (as defined in section 171(2) of the Clean Air Act (<ref href="/us/usc/t42/s7501/2">42 U.S.C. 7501(2)</ref>).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b5c544b-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Shortage of candidates</inline>.—</heading><content>If the Secretary receives an insufficient number of applications from public-use airports located in such areas, then the Secretary may consider applications from public-use airports that are not located in such areas.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b5c544c-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/c"><num value="c">(c)</num><heading> <inline class="small-caps">Selection Criteria</inline>.—</heading><content>In selecting from among applicants for participation in the pilot program, the Secretary shall give priority consideration to applicants that will achieve the greatest air quality benefits measured by the amount of emissions reduced per dollar of funds expended under the pilot program.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b5c544d-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/d"><num value="d">(d)</num><heading> <inline class="small-caps">United States Government’s Share</inline>.—</heading><content>Notwithstanding any other provision of this subchapter, the United States Government’s share of the costs of a project carried out under the pilot program shall be 50 percent.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b5c544e-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/e"><num value="e">(e)</num><heading> <inline class="small-caps">Maximum Amount</inline>.—</heading><content>Not more than $2,000,000 may be expended under the pilot program at any single public-use airport.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b5c544f-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/f"><num value="f">(f)</num><heading> Technical Assistance.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id4b5c5450-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/f/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The sponsor of a public-use airport carrying out inherently low-emission vehicle activities under the pilot program may use not more than 10 percent of the amounts made available for expenditure at the airport in a fiscal year under the pilot program to receive technical assistance in carrying out such activities.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b5c5451-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/f/2"><num value="2">(2)</num><heading> <inline class="small-caps">University transportation center</inline>.—</heading><content>To the maximum extent practicable, participants in the pilot program shall use a university transportation center (as defined in section 5506 <ref class="footnoteRef" idref="fn002173">1</ref><note type="footnote" id="fn002173"><num>1</num> See References in text note below.</note> of this title) in the region of the airport to receive technical assistance described in paragraph (1).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b5c5452-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/g"><num value="g">(g)</num><heading> <inline class="small-caps">Materials Identifying Best Practices</inline>.—</heading><content>The Administrator may develop and make available materials identifying best practices for carrying out low-emission vehicle activities based on the projects carried out under the pilot program and other sources.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b5c5453-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/h"><num value="h">(h)</num><heading> <inline class="small-caps">Report to Congress</inline>.—</heading><chapeau>Not later than 18 months after the date of the enactment of this section, the Secretary shall transmit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report containing—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id4b5c7b64-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/h/1"><num value="1">(1)</num><content> an evaluation of the effectiveness of the pilot program;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b5c7b65-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/h/2"><num value="2">(2)</num><content> an identification of other public-use airports that expressed an interest in participating in the pilot program; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b5c7b66-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/h/3"><num value="3">(3)</num><content> a description of the mechanisms used by the Secretary to ensure that the information and know-how gained by participants in the pilot program is transferred among the participants and to other interested parties, including other public-use airports.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4b5c7b67-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/i"><num value="i">(i)</num><heading> <inline class="small-caps">Inherently Low-Emission Vehicle Activity Defined</inline>.—</heading><chapeau>In this section, the term “inherently low-emission vehicle activity” means—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id4b5c7b68-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/i/1"><num value="1">(1)</num><chapeau> the construction of infrastructure or modifications at public-use airports to enable the delivery of fuel and services necessary for the use of vehicles that are certified as inherently low-emission vehicles under title 40 of the Code of Federal Regulations and that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id4b5c7b69-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/i/1/A"><num value="A">(A)</num><content> operate exclusively on compressed natural gas, liquefied natural gas, liquefied petroleum gas, electricity, hydrogen, or a blend at least 85 percent of which is methanol;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4b5c7b6a-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/i/1/B"><num value="B">(B)</num><content> are labeled in accordance with section 88.312–93(c) of such title; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4b5c7b6b-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/i/1/C"><num value="C">(C)</num><content> are located or primarily used at public-use airports;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b5c7b6c-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/i/2"><num value="2">(2)</num><chapeau> the construction of infrastructure or modifications at public-use airports to enable the delivery of fuel and services necessary for the use of nonroad vehicles that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id4b5c7b6d-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/i/2/A"><num value="A">(A)</num><content> operate exclusively on compressed natural gas, liquefied natural gas, liquefied petroleum gas, electricity, hydrogen, or a blend at least 85 percent of which is methanol;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4b5c7b6e-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/i/2/B"><num value="B">(B)</num><content> meet or exceed the standards set forth in section 86.1708–99 of such title or the standards set forth in section 89.112(a) of such title, and are in compliance with the requirements of section 89.112(b) of such title; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4b5c7b6f-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/i/2/C"><num value="C">(C)</num><content> are located or primarily used at public-use airports;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b5c7b70-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/i/3"><num value="3">(3)</num><content> the payment of that portion of the cost of acquiring vehicles described in this subsection that exceeds the cost of acquiring other vehicles or engines that would be used for the same purpose; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4b5c7b71-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s47136/i/4"><num value="4">(4)</num><content> the acquisition of technological capital equipment to enable the delivery of fuel and services necessary for the use of vehicles described in paragraph (1).</content>
</paragraph>
