<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id899c27dc-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s50101"><num value="50101">§ 50101.</num><heading> Buying goods produced in the United States</heading><subsection style="-uslm-lc:I11" class="indent0" id="id899c27dd-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s50101/a"><num value="a">(a)</num><heading> <inline class="small-caps">Preference</inline>.—</heading><content>The Secretary of Transportation may obligate an amount that may be appropriated to carry out section 106(k), 44502(a)(2), or 44509, subchapter I of chapter 471 (except section 47127), or chapter 481 (except sections 48102(e), 48106, 48107, and 48110) of this title for a project only if steel and manufactured goods used in the project are produced in the United States.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id899c27de-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s50101/b"><num value="b">(b)</num><heading> <inline class="small-caps">Waiver</inline>.—</heading><chapeau>The Secretary may waive subsection (a) of this section if the Secretary finds that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id899c27df-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s50101/b/1"><num value="1">(1)</num><content> applying subsection (a) would be inconsistent with the public interest;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id899c27e0-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s50101/b/2"><num value="2">(2)</num><content> the steel and goods produced in the United States are not produced in a sufficient and reasonably available amount or are not of a satisfactory quality;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id899c27e1-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s50101/b/3"><num value="3">(3)</num><chapeau> when procuring a facility or equipment under section 44502(a)(2) or 44509, subchapter I of chapter 471 (except section 47127), or chapter 481 (except sections 48102(e), 48106, 48107, and 48110) of this title—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id899c27e2-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s50101/b/3/A"><num value="A">(A)</num><content> the cost of components and subcomponents produced in the United States is more than 60 percent of the cost of all components of the facility or equipment; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id899c27e3-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s50101/b/3/B"><num value="B">(B)</num><content> final assembly of the facility or equipment has occurred in the United States; or</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id899c27e4-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s50101/b/4"><num value="4">(4)</num><content> including domestic material will increase the cost of the overall project by more than 25 percent.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id899c27e5-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s50101/c"><num value="c">(c)</num><heading> <inline class="small-caps">Labor Costs</inline>.—</heading><content>In this section, labor costs involved in final assembly are not included in calculating the cost of components.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Compliance With Buy American Act</inline>.—</heading><paragraph style="-uslm-lc:I21" class="indent0"><num value="1">(1)</num><content> Except as provided in paragraph (2), the head of each office within the Federal Aviation Administration that conducts procurements shall ensure that such procurements are conducted in compliance with sections 2 through 4 of the Act of <date date="1933-03-03">March 3, 1933</date> ([former] <ref href="/us/usc/t41/s10a">41 U.S.C. 10a</ref> through 10c, popularly known as the ‘Buy American Act’ [see <ref href="/us/usc/t41/s8301">41 U.S.C. 8301</ref> et seq.]).</content>
