limitation on liability</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3d1262a8-7fa1-11ec-9118-e82f24c6522f\" identifier=\"/us/usc/t49/s508/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">Limitation on Liability</inline>.—</heading><chapeau>No action or proceeding for defamation, invasion of privacy, or interference with a contract that is based on the furnishing or use of safety performance records in accordance with regulations issued by the Secretary may be brought against—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3d1262a9-7fa1-11ec-9118-e82f24c6522f\" identifier=\"/us/usc/t49/s508/a/1\"><num value=\"1\">(1)</num><content> a motor carrier requesting the safety performance records of an individual under consideration for employment as a commercial motor vehicle driver as required by and in accordance with regulations issued by the Secretary;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3d1262aa-7fa1-11ec-9118-e82f24c6522f\" identifier=\"/us/usc/t49/s508/a/2\"><num value=\"2\">(2)</num><content> a person who has complied with such a request; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3d1262ab-7fa1-11ec-9118-e82f24c6522f\" identifier=\"/us/usc/t49/s508/a/3\"><num value=\"3\">(3)</num><content> the agents or insurers of a person described in paragraph (1) or (2).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3d1262ac-7fa1-11ec-9118-e82f24c6522f\" identifier=\"/us/usc/t49/s508/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Restrictions on Applicability.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3d1262ad-7fa1-11ec-9118-e82f24c6522f\" identifier=\"/us/usc/t49/s508/b/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Motor carrier requesting</inline>.—</heading><chapeau>Subsection (a) does not apply to a motor carrier requesting safety performance records unless—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id3d1262ae-7fa1-11ec-9118-e82f24c6522f\" identifier=\"/us/usc/t49/s508/b/1/A\"><num value=\"A\">(A)</num><content> the motor carrier and any agents of the motor carrier have complied with the regulations issued by the Secretary in using the records, including the requirement that the individual who is the subject of the records be afforded a reasonable opportunity to review and comment on the records;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id3d1262af-7fa1-11ec-9118-e82f24c6522f\" identifier=\"/us/usc/t49/s508/b/1/B\"><num value=\"B\">(B)</num><content> the motor carrier and any agents and insurers of the motor carrier have taken all precautions reasonably necessary to protect the records from disclosure to any person, except for such an insurer, not directly involved in deciding whether to hire that individual; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id3d1262b0-7fa1-11ec-9118-e82f24c6522f\" identifier=\"/us/usc/t49/s508/b/1/C\"><num value=\"C\">(C)</num><content> the motor carrier has used those records only to assess the safety performance of the individual who is the subject of those records in deciding whether to hire that individual.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3d1262b1-7fa1-11ec-9118-e82f24c6522f\" identifier=\"/us/usc/t49/s508/b/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Person complying with requests</inline>.—</heading><chapeau>Subsection (a) does not apply to a person complying with a request for safety performance records unless—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id3d1262b2-7fa1-11ec-9118-e82f24c6522f\" identifier=\"/us/usc/t49/s508/b/2/A\"><num value=\"A\">(A)</num><content> the complying person and any agents of the complying person have taken all precautions reasonably necessary to ensure the accuracy of the records and have complied with the regulations issued by the Secretary in furnishing the records, including the requirement that the individual who is the subject of the records be afforded a reasonable opportunity to review and comment on the records; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id3d1262b3-7fa1-11ec-9118-e82f24c6522f\" identifier=\"/us/usc/t49/s508/b/2/B\"><num value=\"B\">(B)</num><content> the complying person and any agents and insurers of the complying person have taken all precautions reasonably necessary to protect the records from disclosure to any person, except for such an insurer, not directly involved in forwarding the records.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3d1262b4-7fa1-11ec-9118-e82f24c6522f\" identifier=\"/us/usc/t49/s508/b/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Persons knowingly furnishing false information</inline>.—</heading><content>Subsection (a) does not apply to persons who knowingly furnish false information.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3d1262b5-7fa1-11ec-9118-e82f24c6522f\" identifier=\"/us/usc/t49/s508/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Preemption of State and Local Law</inline>.—</heading><content>No State or political subdivision thereof may enact, prescribe, issue, continue in effect, or enforce any law (including any regulation, standard, or other provision having the force and effect of law) that prohibits, penalizes, or imposes liability for furnishing or using safety performance records in accordance with regulations issued by the Secretary to carry out this section. Notwithstanding any provision of law, written authorization shall not be required to obtain information on the motor vehicle driving record of an individual under consideration for employment with a motor carrier.</content>\n</subsection>\n<sourceCredit id=\"id3d1262b6-7fa1-11ec-9118-e82f24c6522f\">(Added <ref href=\"/us/pl/105/178/tIV/s4014/a/1\">Pub.
