<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id65633476-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102"><num value="5102">§ 5102.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">In this chapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id65633477-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/1"><num value="1">(1)</num><chapeau> “commerce” means trade or transportation in the jurisdiction of the United States—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id65633478-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/1/A"><num value="A">(A)</num><content> between a place in a State and a place outside of the State;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id65633479-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/1/B"><num value="B">(B)</num><content> that affects trade or transportation between a place in a State and a place outside of the State; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6563347a-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/1/C"><num value="C">(C)</num><content> on a United States-registered aircraft.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6563347b-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/2"><num value="2">(2)</num><content> “hazardous material” means a substance or material the Secretary designates under <ref href="/us/usc/t49/s5103/a">section 5103(a) of this title</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6563347c-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/3"><num value="3">(3)</num><chapeau> “hazmat employee”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6563347d-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/3/A"><num value="A">(A)</num><chapeau> means an individual—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id6563347e-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/3/A/i"><num value="i">(i)</num><chapeau> who—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id6563347f-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/3/A/i/I"><num value="I">(I)</num><content> is employed on a full time, part time, or temporary basis by a hazmat employer; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id65633480-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/3/A/i/II"><num value="II">(II)</num><content> is self-employed (including an owner-operator of a motor vehicle, vessel, or aircraft) transporting hazardous material in commerce; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id65633481-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/3/A/ii"><num value="ii">(ii)</num><content> who during the course of such full time, part time, or temporary employment, or such self employment, directly affects hazardous material transportation safety as the Secretary decides by regulation; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id65633482-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/3/B"><num value="B">(B)</num><chapeau> includes an individual, employed on a full time, part time, or temporary basis by a hazmat employer, or self employed, who during the course of employment—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id65633483-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/3/B/i"><num value="i">(i)</num><content> loads, unloads, or handles hazardous material;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id65633484-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/3/B/ii"><num value="ii">(ii)</num><content> designs, manufactures, fabricates, inspects, marks, maintains, reconditions, repairs, or tests a package, container, or packaging component that is represented, marked, certified, or sold as qualified for use in transporting hazardous material in commerce;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id65633485-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/3/B/iii"><num value="iii">(iii)</num><content> prepares hazardous material for transportation;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id65633486-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/3/B/iv"><num value="iv">(iv)</num><content> is responsible for the safety of transporting hazardous material; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id65633487-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/3/B/v"><num value="v">(v)</num><content> operates a vehicle used to transport hazardous material.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id65633488-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/4"><num value="4">(4)</num><chapeau> “hazmat employer”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id65633489-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/4/A"><num value="A">(A)</num><chapeau> means a person—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id6563348a-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/4/A/i"><num value="i">(i)</num><chapeau> who—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id6563348b-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/4/A/i/I"><num value="I">(I)</num><content> employs or uses at least 1 hazmat employee on a full time, part time, or temporary basis; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id6563348c-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/4/A/i/II"><num value="II">(II)</num><content> is self-employed (including an owner-operator of a motor vehicle, vessel, or aircraft) transporting hazardous material in commerce; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6563348d-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/4/A/ii"><num value="ii">(ii)</num><chapeau> who—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id6563348e-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/4/A/ii/I"><num value="I">(I)</num><content> transports hazardous material in commerce;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id6563348f-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/4/A/ii/II"><num value="II">(II)</num><content> causes hazardous material to be transported in commerce; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id65633490-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/4/A/ii/III"><num value="III">(III)</num><content> designs, manufactures, fabricates, inspects, marks, maintains, reconditions, repairs, or tests a package, container, or packaging component that is represented, marked, certified, or sold as qualified for use in transporting hazardous material in commerce; and</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id65633491-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/4/B"><num value="B">(B)</num><content> includes a department, agency, or instrumentality of the United States Government, or an authority of a State, political subdivision of a State, or Indian tribe, carrying out an activity described in clause (ii).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id65633492-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/5"><num value="5">(5)</num><content> “imminent hazard” means the existence of a condition relating to hazardous material that presents a substantial likelihood that death, serious illness, severe personal injury, or a substantial endangerment to health, property, or the environment may occur before the reasonably foreseeable completion date of a formal proceeding begun to lessen the risk of that death, illness, injury, or endangerment.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id65633493-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/6"><num value="6">(6)</num><content> “Indian tribe” has the same meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<ref href="/us/usc/t25/s450b">25 U.S.C. 450b</ref>).<ref class="footnoteRef" idref="fn002018">1</ref><note type="footnote" id="fn002018"><num>1</num> See References in Text note below.</note></content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id65633494-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/7"><num value="7">(7)</num><chapeau> “motor carrier”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id65633495-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/7/A"><num value="A">(A)</num><content> means a motor carrier, motor private carrier, and freight forwarder as those terms are defined in section 13102; but</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id65633496-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/7/B"><num value="B">(B)</num><content> does not include a freight forwarder, as so defined, if the freight forwarder is not performing a function relating to highway transportation.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id65633497-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/8"><num value="8">(8)</num><content> “National Response Team” means the National Response Team established under the National Contingency Plan established under section 105 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<ref href="/us/usc/t42/s9605">42 U.S.C. 9605</ref>).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id65633498-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/9"><num value="9">(9)</num><chapeau> “person”, in addition to its meaning under <ref href="/us/usc/t1/s1">section 1 of title 1</ref>—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id65633499-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/9/A"><num value="A">(A)</num><chapeau> includes a government, Indian tribe, or authority of a government or tribe that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id6563349a-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/9/A/i"><num value="i">(i)</num><content> offers hazardous material for transportation in commerce;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6563349b-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/9/A/ii"><num value="ii">(ii)</num><content> transports hazardous material to further a commercial enterprise; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6563349c-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/9/A/iii"><num value="iii">(iii)</num><content> designs, manufactures, fabricates, inspects, marks, maintains, reconditions, repairs, or tests a package, container, or packaging component that is represented, marked, certified, or sold as qualified for use in transporting hazardous material in commerce; but</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6563349d-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/9/B"><num value="B">(B)</num><chapeau> does not include—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id6563349e-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/9/B/i"><num value="i">(i)</num><content> the United States Postal Service; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6563349f-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/9/B/ii"><num value="ii">(ii)</num><content> in sections 5123 and 5124 of this title, a department, agency, or instrumentality of the Government.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id656334a0-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/10"><num value="10">(10)</num><chapeau> “public sector employee”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id656334a1-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/10/A"><num value="A">(A)</num><content> means an individual employed by a State, political subdivision of a State, or Indian tribe and who during the course of employment has responsibilities related to responding to an accident or incident involving the transportation of hazardous material;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id656334a2-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/10/B"><num value="B">(B)</num><content> includes an individual employed by a State, political subdivision of a State, or Indian tribe as a firefighter or law enforcement officer; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id656334a3-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/10/C"><num value="C">(C)</num><content> includes an individual who volunteers to serve as a firefighter for a State, political subdivision of a State, or Indian tribe.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id656334a4-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/11"><num value="11">(11)</num><content> “Secretary” means the Secretary of Transportation except as otherwise provided.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id656334a5-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/12"><num value="12">(12)</num><chapeau> “State” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id656334a6-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/12/A"><num value="A">(A)</num><content> except in <ref href="/us/usc/t49/s5119">section 5119 of this title</ref>, a State of the United States, the District of Columbia, Puerto Rico, the Northern Mariana Islands, the Virgin Islands, American Samoa, Guam, and any other territory or possession of the United States designated by the Secretary; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id656334a7-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/12/B"><num value="B">(B)</num><content> in <ref href="/us/usc/t49/s5119">section 5119 of this title</ref>, a State of the United States and the District of Columbia.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id656334a8-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/13"><num value="13">(13)</num><content> “transports” or “transportation” means the movement of property and loading, unloading, or storage incidental to the movement.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id656334a9-d385-11e6-bc46-9b7fdee7024f" identifier="/us/usc/t49/s5102/14"><num value="14">(14)</num><content> “United States” means all of the States.</content>
