<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id34874835-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302"><num value="5302">§ 5302.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">Except as otherwise specifically provided, in this chapter the following definitions apply:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id34874836-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/1"><num value="1">(1)</num><heading> <inline class="small-caps">Associated transit improvement</inline>.—</heading><chapeau>The term “associated transit improvement” means, with respect to any project or an area to be served by a project, projects that are designed to enhance public transportation service or use and that are physically or functionally related to transit facilities. Eligible projects are—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34874837-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/1/A"><num value="A">(A)</num><content> historic preservation, rehabilitation, and operation of historic public transportation buildings, structures, and facilities (including historic bus and railroad facilities) intended for use in public transportation service;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34874838-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/1/B"><num value="B">(B)</num><content> bus shelters;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34874839-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/1/C"><num value="C">(C)</num><content> functional landscaping and streetscaping, including benches, trash receptacles, and street lights;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3487483a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/1/D"><num value="D">(D)</num><content> pedestrian access and walkways;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3487483b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/1/E"><num value="E">(E)</num><content> bicycle access, including bicycle storage shelters and parking facilities and the installation of equipment for transporting bicycles on public transportation vehicles;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3487483c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/1/F"><num value="F">(F)</num><content> signage; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3487483d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/1/G"><num value="G">(G)</num><content> enhanced access for persons with disabilities to public transportation.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3487483e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/2"><num value="2">(2)</num><heading> <inline class="small-caps">Bus rapid transit system</inline>.—</heading><chapeau>The term “bus rapid transit system” means a bus transit system—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3487483f-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/2/A"><num value="A">(A)</num><content> in which the majority of each line operates in a separated right-of-way dedicated for public transportation use during peak periods; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34874840-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/2/B"><num value="B">(B)</num><chapeau> that includes features that emulate the services provided by rail fixed guideway public transportation systems, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id34874841-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/2/B/i"><num value="i">(i)</num><content> defined stations;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34874842-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/2/B/ii"><num value="ii">(ii)</num><content> traffic signal priority for public transportation vehicles;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34874843-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/2/B/iii"><num value="iii">(iii)</num><content> short headway bidirectional services for a substantial part of weekdays and weekend days; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34874844-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/2/B/iv"><num value="iv">(iv)</num><content> any other features the Secretary may determine are necessary to produce high-quality public transportation services that emulate the services provided by rail fixed guideway public transportation systems.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34874845-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3"><num value="3">(3)</num><heading> <inline class="small-caps">Capital project</inline>.—</heading><chapeau>The term “capital project” means a project for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34874846-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/A"><num value="A">(A)</num><content> acquiring, constructing, supervising, or inspecting equipment or a facility for use in public transportation, expenses incidental to the acquisition or construction (including designing, engineering, location surveying, mapping, and acquiring rights-of-way), payments for the capital portions of rail trackage rights agreements, transit-related intelligent transportation systems, relocation assistance, acquiring replacement housing sites, and acquiring, constructing, relocating, and rehabilitating replacement housing;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34874847-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/B"><num value="B">(B)</num><content> rehabilitating a bus;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34874848-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/C"><num value="C">(C)</num><content> remanufacturing a bus;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34874849-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/D"><num value="D">(D)</num><content> overhauling rail rolling stock;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3487484a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/E"><num value="E">(E)</num><content> preventive maintenance;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3487484b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/F"><num value="F">(F)</num><content> leasing equipment or a facility for use in public transportation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3487484c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G"><num value="G">(G)</num><chapeau> a joint development improvement that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3487484d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/i"><num value="i">(i)</num><content> enhances economic development or incorporates private investment, such as commercial and residential development;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3487484e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/ii"><num value="ii">(ii)</num><subclause style="-uslm-lc:I14" class="indent3" id="id3487484f-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/ii/I"><num value="I">(I)</num><content> enhances the effectiveness of public transportation and is related physically or functionally to public transportation; or</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="id34874850-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/ii/II"><num value="II">(II)</num><content> establishes new or enhanced coordination between public transportation and other transportation;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34874851-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/iii"><num value="iii">(iii)</num><content> provides a fair share of revenue that will be used for public transportation;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34874852-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/iv"><num value="iv">(iv)</num><content> provides that a person making an agreement to occupy space in a facility constructed under this paragraph shall pay a fair share of the costs of the facility through rental payments and other means; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34874853-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/v"><num value="v">(v)</num><chapeau> may include—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id34874854-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/v/I"><num value="I">(I)</num><content> property acquisition;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id34874855-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/v/II"><num value="II">(II)</num><content> demolition of existing structures;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id34874856-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/v/III"><num value="III">(III)</num><content> site preparation;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id34874857-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/v/IV"><num value="IV">(IV)</num><content> utilities;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id34874858-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/v/V"><num value="V">(V)</num><content> building foundations;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id34874859-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/v/VI"><num value="VI">(VI)</num><content> walkways;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id3487485a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/v/VII"><num value="VII">(VII)</num><content> pedestrian and bicycle access to a public transportation facility;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id3487485b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/v/VIII"><num value="VIII">(VIII)</num><content> construction, renovation, and improvement of intercity bus and intercity rail stations and terminals;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id3487485c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/v/IX"><num value="IX">(IX)</num><content> renovation and improvement of historic transportation facilities;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id3487485d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/v/X"><num value="X">(X)</num><content> open space;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id3487485e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/v/XI"><num value="XI">(XI)</num><content> safety and security equipment and facilities (including lighting, surveillance, and related intelligent transportation system applications);</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id3487485f-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/v/XII"><num value="XII">(XII)</num><content> facilities that incorporate community services such as daycare or health care;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id34874860-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/v/XIII"><num value="XIII">(XIII)</num><content> a capital project for, and improving, equipment or a facility for an intermodal transfer facility or transportation mall; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id34874861-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/G/v/XIV"><num value="XIV">(XIV)</num><content> construction of space for commercial uses;</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34874862-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/H"><num value="H">(H)</num><content> the introduction of new technology, through innovative and improved products, into public transportation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34874863-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/I"><num value="I">(I)</num><chapeau> the provision of nonfixed route paratransit transportation services in accordance with section 223 of the Americans with Disabilities Act of 1990 (<ref href="/us/usc/t42/s12143">42 U.S.C. 12143</ref>), but only for grant recipients that are in compliance with applicable requirements of that Act, including both fixed route and demand responsive service, and only for amounts—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id34874864-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/I/i"><num value="i">(i)</num><content> not to exceed 10 percent of such recipient’s annual formula apportionment under sections 5307 and 5311; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34874865-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/I/ii"><num value="ii">(ii)</num><chapeau> not to exceed 20 percent of such recipient’s annual formula apportionment under sections 5307 and 5311, if, consistent with guidance issued by the Secretary, the recipient demonstrates that the recipient meets at least 2 of the following requirements:</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id34874866-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/I/ii/I"><num value="I">(I)</num><content> Provides an active fixed route travel training program that is available for riders with disabilities.</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id34874867-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/I/ii/II"><num value="II">(II)</num><content> Provides that all fixed route and paratransit operators participate in a passenger safety, disability awareness, and sensitivity training class on at least a biennial basis.</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id34874868-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/I/ii/III"><num value="III">(III)</num><content> Has memoranda of understanding in place with employers and the American Job Center to increase access to employment opportunities for people with disabilities.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34874869-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/J"><num value="J">(J)</num><content> establishing a debt service reserve, made up of deposits with a bondholder’s trustee, to ensure the timely payment of principal and interest on bonds issued by a grant recipient to finance an eligible project under this chapter;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3487486a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/K"><num value="K">(K)</num><chapeau> mobility management—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3487486b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/K/i"><num value="i">(i)</num><content> consisting of short-range planning and management activities and projects for improving coordination among public transportation and other transportation service providers carried out by a recipient or subrecipient through an agreement entered into with a person, including a governmental entity, under this chapter (other than section 5309); but</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3487486c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/K/ii"><num value="ii">(ii)</num><content> excluding operating public transportation services;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3487486d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/L"><num value="L">(L)</num><chapeau> associated capital maintenance, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3487486e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/L/i"><num value="i">(i)</num><content> equipment, tires, tubes, and material, each costing at least .5 percent of the current fair market value of rolling stock comparable to the rolling stock for which the equipment, tires, tubes, and material are to be used; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3487486f-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/L/ii"><num value="ii">(ii)</num><content> reconstruction of equipment and material, each of which after reconstruction will have a fair market value of at least .5 percent of the current fair market value of rolling stock comparable to the rolling stock for which the equipment and material will be used;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34874870-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/M"><num value="M">(M)</num><content> associated transit improvements; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34874871-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/3/N"><num value="N">(N)</num><content> technological changes or innovations to modify low or no emission vehicles (as defined in section 5339(c)) or facilities.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34874872-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/4"><num value="4">(4)</num><heading> <inline class="small-caps">Designated recipient</inline>.—</heading><chapeau>The term “designated recipient” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34874873-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/4/A"><num value="A">(A)</num><content> an entity designated, in accordance with the planning process under sections 5303 and 5304, by the Governor of a State, responsible local officials, and publicly owned operators of public transportation, to receive and apportion amounts under section 5336 to urbanized areas of 200,000 or more in population; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34874874-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/4/B"><num value="B">(B)</num><content> a State or regional authority, if the authority is responsible under the laws of a State for a capital project and for financing and directly providing public transportation.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34874875-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/5"><num value="5">(5)</num><heading> <inline class="small-caps">Disability</inline>.—</heading><content>The term “disability” has the same meaning as in section 3(1) of the Americans with Disabilities Act of 1990 (<ref href="/us/usc/t42/s12102">42 U.S.C. 12102</ref>).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3489b876-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/6"><num value="6">(6)</num><heading> <inline class="small-caps">Emergency regulation</inline>.—</heading><chapeau>The term “emergency regulation” means a regulation—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3489b877-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/6/A"><num value="A">(A)</num><content> that is effective temporarily before the expiration of the otherwise specified periods of time for public notice and comment under section 5334(c); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3489b878-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/6/B"><num value="B">(B)</num><chapeau> prescribed by the Secretary as the result of a finding that a delay in the effective date of the regulation—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3489b879-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/6/B/i"><num value="i">(i)</num><content> would injure seriously an important public interest;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3489b87a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/6/B/ii"><num value="ii">(ii)</num><content> would frustrate substantially legislative policy and intent; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3489b87b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/6/B/iii"><num value="iii">(iii)</num><content> would damage seriously a person or class without serving an important public interest.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3489b87c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/7"><num value="7">(7)</num><heading> <inline class="small-caps">Fixed guideway</inline>.—</heading><chapeau>The term “fixed guideway” means a public transportation facility—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3489b87d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/7/A"><num value="A">(A)</num><content> using and occupying a separate right-of-way for the exclusive use of public transportation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3489b87e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/7/B"><num value="B">(B)</num><content> using rail;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3489b87f-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/7/C"><num value="C">(C)</num><content> using a fixed catenary system;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3489b880-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5302/7/D"><num value="D">(D)</num><content> for a passenger ferry system; or</content>
</subparagraph>
