<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id48493817-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310"><num value="5310">§ 5310.</num><heading> Formula grants for the enhanced mobility of seniors and individuals with disabilities</heading><subsection style="-uslm-lc:I11" class="indent0" id="id48493818-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/a"><num value="a">(a)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section, the following definitions shall apply:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id48493819-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">Recipient</inline>.—</heading><chapeau>The term “recipient” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id4849381a-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/a/1/A"><num value="A">(A)</num><content> a designated recipient or a State that receives a grant under this section directly; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4849381b-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/a/1/B"><num value="B">(B)</num><content> a State or local governmental entity that operates a public transportation service.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4849381c-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/a/2"><num value="2">(2)</num><heading> <inline class="small-caps">Subrecipient</inline>.—</heading><content>The term “subrecipient” means a State or local governmental authority, a private nonprofit organization, or an operator of public transportation that receives a grant under this section indirectly through a recipient.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4849381d-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b"><num value="b">(b)</num><heading> General Authority.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id4849381e-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">Grants</inline>.—</heading><chapeau>The Secretary may make grants under this section to recipients for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id4849381f-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/1/A"><num value="A">(A)</num><content> public transportation projects planned, designed, and carried out to meet the special needs of seniors and individuals with disabilities when public transportation is insufficient, inappropriate, or unavailable;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id48493820-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/1/B"><num value="B">(B)</num><content> public transportation projects that exceed the requirements of the Americans with Disabilities Act of 1990 (<ref href="/us/usc/t42/s12101">42 U.S.C. 12101</ref> et seq.);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id48493821-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/1/C"><num value="C">(C)</num><content> public transportation projects that improve access to fixed route service and decrease reliance by individuals with disabilities on complementary paratransit; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id48493822-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/1/D"><num value="D">(D)</num><content> alternatives to public transportation that assist seniors and individuals with disabilities with transportation.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id48493823-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/2"><num value="2">(2)</num><heading> Limitations for capital projects.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id48493824-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/2/A"><num value="A">(A)</num><heading> <inline class="small-caps">Amount available</inline>.—</heading><content>The amount available for capital projects under paragraph (1)(A) shall be not less than 55 percent of the funds apportioned to the recipient under this section.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id484b8215-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/2/B"><num value="B">(B)</num><heading> <i>Allocation to subrecipients</i>.—</heading><chapeau>A recipient of a grant under paragraph (1)(A) may allocate the amounts provided under the grant to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id484b8216-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/2/B/i"><num value="i">(i)</num><content> a private nonprofit organization; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id484b8217-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/2/B/ii"><num value="ii">(ii)</num><chapeau> a State or local governmental authority that—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id484b8218-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/2/B/ii/I"><num value="I">(I)</num><content> is approved by a State to coordinate services for seniors and individuals with disabilities; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id484b8219-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/2/B/ii/II"><num value="II">(II)</num><content> certifies that there are no private nonprofit organizations readily available in the area to provide the services described in paragraph (1)(A).</content>
</subclause>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id484b821a-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/3"><num value="3">(3)</num><heading> <inline class="small-caps">Administrative expenses</inline>.—</heading><content>A recipient may use not more than 10 percent of the amounts apportioned to the recipient under this section to administer, plan, and provide technical assistance for a project funded under this section.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id484b821b-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/4"><num value="4">(4)</num><heading> <inline class="small-caps">Eligible capital expenses</inline>.—</heading><content>The acquisition of public transportation services is an eligible capital expense under this section.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id484b821c-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/5"><num value="5">(5)</num><heading> Coordination.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id484b821d-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/5/A"><num value="A">(A)</num><heading> <inline class="small-caps">Department of transportation</inline>.—</heading><content>To the maximum extent feasible, the Secretary shall coordinate activities under this section with related activities under other Federal departments and agencies.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id484b821e-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/5/B"><num value="B">(B)</num><heading> <inline class="small-caps">Other federal agencies and nonprofit organizations</inline>.—</heading><chapeau>A State or local governmental authority or nonprofit organization that receives assistance from Government sources (other than the Department of Transportation) for nonemergency transportation services shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id484b821f-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/5/B/i"><num value="i">(i)</num><content> participate and coordinate with recipients of assistance under this chapter in the design and delivery of transportation services; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id484b8220-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/5/B/ii"><num value="ii">(ii)</num><content> participate in the planning for the transportation services described in clause (i).</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id484b8221-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/6"><num value="6">(6)</num><heading> Program of projects.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id484b8222-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/6/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Amounts made available to carry out this section may be used for transportation projects to assist in providing transportation services for seniors and individuals with disabilities, if such transportation projects are included in a program of projects.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id484b8223-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/6/B"><num value="B">(B)</num><heading> <inline class="small-caps">Submission</inline>.—</heading><content>A recipient shall annually submit a program of projects to the Secretary.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id484b8224-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/6/C"><num value="C">(C)</num><heading> <inline class="small-caps">Assurance</inline>.—</heading><content>The program of projects submitted under subparagraph (B) shall contain an assurance that the program provides for the maximum feasible coordination of transportation services assisted under this section with transportation services assisted by other Government sources.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id484b8225-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/b/7"><num value="7">(7)</num><heading> <inline class="small-caps">Meal delivery for homebound individuals</inline>.—</heading><content>A public transportation service provider that receives assistance under this section or section 5311(c) may coordinate and assist in regularly providing meal delivery service for homebound individuals, if the delivery service does not conflict with providing public transportation service or reduce service to public transportation passengers.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id484b8226-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c"><num value="c">(c)</num><heading> Apportionment and Transfers.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id484b8227-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">Formula</inline>.—</heading><chapeau>The Secretary shall apportion amounts made available to carry out this section as follows:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id484b8228-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/1/A"><num value="A">(A)</num><heading> <inline class="small-caps">Large urbanized areas</inline>.—</heading><chapeau>Sixty percent of the funds shall be apportioned among designated recipients for urbanized areas with a population of 200,000 or more individuals, as determined by the Bureau of the Census, in the ratio that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id484b8229-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/1/A/i"><num value="i">(i)</num><content> the number of seniors and individuals with disabilities in each such urbanized area; bears to</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id484b822a-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/1/A/ii"><num value="ii">(ii)</num><content> the number of seniors and individuals with disabilities in all such urbanized areas.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id484b822b-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/1/B"><num value="B">(B)</num><heading> <inline class="small-caps">Small urbanized areas</inline>.—</heading><chapeau>Twenty percent of the funds shall be apportioned among the States in the ratio that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id484b822c-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/1/B/i"><num value="i">(i)</num><content> the number of seniors and individuals with disabilities in urbanized areas with a population of fewer than 200,000 individuals, as determined by the Bureau of the Census, in each State; bears to</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id484b822d-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/1/B/ii"><num value="ii">(ii)</num><content> the number of seniors and individuals with disabilities in urbanized areas with a population of fewer than 200,000 individuals, as determined by the Bureau of the Census, in all States.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id484b822e-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/1/C"><num value="C">(C)</num><heading> <inline class="small-caps">Rural areas</inline>.—</heading><chapeau>Twenty percent of the funds shall be apportioned among the States in the ratio that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id484b822f-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/1/C/i"><num value="i">(i)</num><content> the number of seniors and individuals with disabilities in rural areas in each State; bears to</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id484b8230-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/1/C/ii"><num value="ii">(ii)</num><content> the number of seniors and individuals with disabilities in rural areas in all States.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id484b8231-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/2"><num value="2">(2)</num><heading> Areas served by projects.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id484b8232-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/2/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Except as provided in subparagraph (B)—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id484b8233-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/2/A/i"><num value="i">(i)</num><content> funds apportioned under paragraph (1)(A) shall be used for projects serving urbanized areas with a population of 200,000 or more individuals, as determined by the Bureau of the Census;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id484b8234-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/2/A/ii"><num value="ii">(ii)</num><content> funds apportioned under paragraph (1)(B) shall be used for projects serving urbanized areas with a population of fewer than 200,000 individuals, as determined by the Bureau of the Census; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id484b8235-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/2/A/iii"><num value="iii">(iii)</num><content> funds apportioned under paragraph (1)(C) shall be used for projects serving rural areas.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id484b8236-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/2/B"><num value="B">(B)</num><heading> <inline class="small-caps">Exceptions</inline>.—</heading><chapeau>A State may use funds apportioned to the State under subparagraph (B) or (C) of paragraph (1)—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id484b8237-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/2/B/i"><num value="i">(i)</num><content> for a project serving an area other than an area specified in subparagraph (A)(ii) or (A)(iii), as the case may be, if the Governor of the State certifies that all of the objectives of this section are being met in the area specified in subparagraph (A)(ii) or (A)(iii); or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id484b8238-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/2/B/ii"><num value="ii">(ii)</num><content> for a project anywhere in the State, if the State has established a statewide program for meeting the objectives of this section.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id484b8239-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/2/C"><num value="C">(C)</num><heading> <inline class="small-caps">Limited to eligible projects</inline>.—</heading><content>Any funds transferred pursuant to subparagraph (B) shall be made available only for eligible projects selected under this section.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id484b823a-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/c/2/D"><num value="D">(D)</num><heading> <inline class="small-caps">Consultation</inline>.—</heading><content>A recipient may transfer an amount under subparagraph (B) only after consulting with responsible local officials, publicly owned operators of public transportation, and nonprofit providers in the area for which the amount was originally apportioned.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id484b823b-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/d"><num value="d">(d)</num><heading> Government Share of Costs.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id484b823c-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/d/1"><num value="1">(1)</num><heading> <inline class="small-caps">Capital projects</inline>.—</heading><content>A grant for a capital project under this section shall be in an amount equal to 80 percent of the net capital costs of the project, as determined by the Secretary.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id484b823d-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/d/2"><num value="2">(2)</num><heading> <inline class="small-caps">Operating assistance</inline>.—</heading><content>A grant made under this section for operating assistance may not exceed an amount equal to 50 percent of the net operating costs of the project, as determined by the Secretary.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id484b823e-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/d/3"><num value="3">(3)</num><heading> <inline class="small-caps">Remainder of net costs</inline>.—</heading><chapeau>The remainder of the net costs of a project carried out under this section—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id484b823f-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/d/3/A"><num value="A">(A)</num><content> may be provided from an undistributed cash surplus, a replacement or depreciation cash fund or reserve, a service agreement with a State or local social service agency or a private social service organization, or new capital; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id484b8240-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/d/3/B"><num value="B">(B)</num><chapeau> may be derived from amounts appropriated or otherwise made available—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id484b8241-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/d/3/B/i"><num value="i">(i)</num><content> to a department or agency of the Government (other than the Department of Transportation) that are eligible to be expended for transportation; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id484b8242-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/d/3/B/ii"><num value="ii">(ii)</num><content> to carry out the Federal lands highways program under section 204 <ref class="footnoteRef" idref="fn002026">1</ref><note type="footnote" id="fn002026"><num>1</num> See References in Text note below.</note> of title 23.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id484b8243-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/d/4"><num value="4">(4)</num><heading> <inline class="small-caps">Use of certain funds</inline>.—</heading><content>For purposes of paragraph (3)(B)(i), the prohibition under section 403(a)(5)(C)(vii) of the Social Security Act (<ref href="/us/usc/t42/s603/a/5/C/vii">42 U.S.C. 603(a)(5)(C)(vii)</ref>) on the use of grant funds for matching requirements shall not apply to Federal or State funds to be used for transportation purposes.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id484b8244-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/e"><num value="e">(e)</num><heading> Grant Requirements.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id484b8245-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/e/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>A grant under this section shall be subject to the same requirements as a grant under section 5307, to the extent the Secretary determines appropriate.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id484b8246-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/e/2"><num value="2">(2)</num><heading> Certification requirements.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id484b8247-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/e/2/A"><num value="A">(A)</num><heading> <inline class="small-caps">Project selection and plan development</inline>.—</heading><chapeau>Before receiving a grant under this section, each recipient shall certify that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id484b8248-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/e/2/A/i"><num value="i">(i)</num><content> the projects selected by the recipient are included in a locally developed, coordinated public transit-human services transportation plan;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id484b8249-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/e/2/A/ii"><num value="ii">(ii)</num><content> the plan described in clause (i) was developed and approved through a process that included participation by seniors, individuals with disabilities, representatives of public, private, and nonprofit transportation and human services providers, and other members of the public; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id484b824a-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/e/2/A/iii"><num value="iii">(iii)</num><content> to the maximum extent feasible, the services funded under this section will be coordinated with transportation services assisted by other Federal departments and agencies, including any transportation activities carried out by a recipient of a grant from the Department of Health and Human Services.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id484b824b-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/e/2/B"><num value="B">(B)</num><heading> <inline class="small-caps">Allocations to subrecipients</inline>.—</heading><content>If a recipient allocates funds received under this section to subrecipients, the recipient shall certify that the funds are allocated on a fair and equitable basis.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id484b824c-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/f"><num value="f">(f)</num><heading> Competitive Process for Grants to Subrecipients.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id484b824d-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/f/1"><num value="1">(1)</num><heading> <inline class="small-caps">Areawide solicitations</inline>.—</heading><content>A recipient of funds apportioned under subsection (c)(1)(A) may conduct, in cooperation with the appropriate metropolitan planning organization, an areawide solicitation for applications for grants under this section.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id484b824e-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/f/2"><num value="2">(2)</num><heading> <inline class="small-caps">Statewide solicitations</inline>.—</heading><content>A recipient of funds apportioned under subparagraph (B) or (C) of subsection (c)(1) may conduct a statewide solicitation for applications for grants under this section.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id484b824f-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/f/3"><num value="3">(3)</num><heading> <inline class="small-caps">Application</inline>.—</heading><content>If the recipient elects to engage in a competitive process, a recipient or subrecipient seeking to receive a grant from funds apportioned under subsection (c) shall submit to the recipient making the election an application in such form and in accordance with such requirements as the recipient making the election shall establish.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id484b8250-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/g"><num value="g">(g)</num><heading> <inline class="small-caps">Transfers of Facilities and Equipment</inline>.—</heading><chapeau>A recipient may transfer a facility or equipment acquired using a grant under this section to any other recipient eligible to receive assistance under this chapter, if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id484b8251-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/g/1"><num value="1">(1)</num><content> the recipient in possession of the facility or equipment consents to the transfer; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id484b8252-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/g/2"><num value="2">(2)</num><content> the facility or equipment will continue to be used as required under this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id484b8253-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/h"><num value="h">(h)</num><heading> Performance Measures.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id484b8254-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/h/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Not later than 1 year after the date of enactment of the Federal Public Transportation Act of 2012, the Secretary shall submit a report to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives making recommendations on the establishment of performance measures for grants under this section. Such report shall be developed in consultation with national nonprofit organizations that provide technical assistance and advocacy on issues related to transportation services for seniors and individuals with disabilities.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id484b8255-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/h/2"><num value="2">(2)</num><heading> <inline class="small-caps">Measures</inline>.—</heading><chapeau>The performance measures to be considered in the report under paragraph (1) shall require the collection of quantitative and qualitative information, as available, concerning—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id484b8256-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/h/2/A"><num value="A">(A)</num><content> modifications to the geographic coverage of transportation service, the quality of transportation service, or service times that increase the availability of transportation services for seniors and individuals with disabilities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id484b8257-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/h/2/B"><num value="B">(B)</num><content> ridership;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id484b8258-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/h/2/C"><num value="C">(C)</num><content> accessibility improvements; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id484b8259-9222-11e6-b436-b6f01964ba54" identifier="/us/usc/t49/s5310/h/2/D"><num value="D">(D)</num><content> other measures, as the Secretary determines is appropriate.</content>

<paragraph style="-uslm-lc:I21" class="indent0"><num value="2">“(2)</num><heading> <inline class="small-caps">General authority</inline>.—</heading><chapeau>The Secretary [of Transportation] may make grants under this subsection to eligible recipients to assist in financing innovative projects for the transportation disadvantaged that improve the coordination of transportation services and nonemergency medical transportation services, including—</chapeau><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><content> the deployment of coordination technology;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><content> projects that create or increase access to community One-Call/One-Click Centers; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="C">“(C)</num><content> such other projects as determined appropriate by the Secretary.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="3">“(3)</num><heading> <inline class="small-caps">Application</inline>.—</heading><chapeau>An eligible recipient shall submit to the Secretary an application that, at a minimum, contains—</chapeau><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><content> a detailed description of the eligible project;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><chapeau> an identification of all eligible project partners and their specific role in the eligible project, including—</chapeau><clause style="-uslm-lc:I23" class="indent2"><num value="i">“(i)</num><content> private entities engaged in the coordination of nonemergency medical transportation services for the transportation disadvantaged; or</content>
</clause>
<clause style="-uslm-lc:I23" class="indent2"><num value="ii">“(ii)</num><content> nonprofit entities engaged in the coordination of nonemergency medical transportation services for the transportation disadvantaged;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="C">“(C)</num><chapeau> a description of how the eligible project would—</chapeau><clause style="-uslm-lc:I23" class="indent2"><num value="i">“(i)</num><content> improve local coordination or access to coordinated transportation services;</content>
</clause>
<clause style="-uslm-lc:I23" class="indent2"><num value="ii">“(ii)</num><content> reduce duplication of service, if applicable; and</content>
</clause>
<clause style="-uslm-lc:I23" class="indent2"><num value="iii">“(iii)</num><content> provide innovative solutions in the State or community; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="D">“(D)</num><content> specific performance measures the eligible project will use to quantify actual outcomes against expected outcomes.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="4">“(4)</num><heading> <inline class="small-caps">Report</inline>.—</heading><content>The Secretary shall make publicly available an annual report on the pilot program carried out under this subsection for each fiscal year, not later than December 31 of the calendar year in which that fiscal year ends. The report shall include a detailed description of the activities carried out under the pilot program, and an evaluation of the program, including an evaluation of the performance measures described in paragraph (3)(D).</content>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="5">“(5)</num><heading> Government share of costs.—</heading><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Government share of the cost of an eligible project carried out under this subsection shall not exceed 80 percent.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><heading> <inline class="small-caps">Non-government share</inline>.—</heading><content>The non-Government share of the cost of an eligible project carried out under this subsection may be derived from in-kind contributions.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="6">“(6)</num><heading> <inline class="small-caps">Rule of construction</inline>.—</heading><content>For purposes of this subsection, nonemergency medical transportation services shall be limited to services eligible under Federal programs other than programs authorized under chapter 53 of title 49, United States Code.”</content>
