<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id91eea095-4155-11e7-b46f-bc935896ce0b" identifier="/us/usc/t49/s5330"><num value="5330">§ 5330.</num><heading> State safety oversight</heading><subsection style="-uslm-lc:I11" class="indent0" id="id91eea096-4155-11e7-b46f-bc935896ce0b" identifier="/us/usc/t49/s5330/a"><num value="a">(a)</num><heading> <inline class="small-caps">Application</inline>.—</heading><chapeau>This section shall only apply to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id91eea097-4155-11e7-b46f-bc935896ce0b" identifier="/us/usc/t49/s5330/a/1"><num value="1">(1)</num><content> States that have rail fixed guideway public transportation systems that are not subject to regulation by the Federal Railroad Administration; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91eea098-4155-11e7-b46f-bc935896ce0b" identifier="/us/usc/t49/s5330/a/2"><num value="2">(2)</num><content> States that are designing rail fixed guideway public transportation systems that will not be subject to regulation by the Federal Railroad Administration.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id91eea099-4155-11e7-b46f-bc935896ce0b" identifier="/us/usc/t49/s5330/b"><num value="b">(b)</num><heading> <inline class="small-caps">General Authority</inline>.—</heading><content>The Secretary of Transportation may withhold not more than 5 percent of the amount required to be appropriated for use in a State or urbanized area in the State under <ref href="/us/usc/t49/s5307">section 5307 of this title</ref> for a fiscal year beginning after <date date="1994-09-30">September 30, 1994</date>, if the State in the prior fiscal year has not met the requirements of subsection (c) of this section and the Secretary decides the State is not making an adequate effort to comply with subsection (c).</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id91eea09a-4155-11e7-b46f-bc935896ce0b" identifier="/us/usc/t49/s5330/c"><num value="c">(c)</num><heading> <inline class="small-caps">State Requirements</inline>.—</heading><chapeau>A State meets the requirements of this section if the State—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id91eea09b-4155-11e7-b46f-bc935896ce0b" identifier="/us/usc/t49/s5330/c/1"><num value="1">(1)</num><content> establishes and is carrying out a safety program plan for each fixed guideway public transportation system in the State that establishes at least safety requirements, lines of authority, levels of responsibility and accountability, and methods of documentation for the system; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91eea09c-4155-11e7-b46f-bc935896ce0b" identifier="/us/usc/t49/s5330/c/2"><num value="2">(2)</num><chapeau> designates a State authority as having responsibility—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id91eea09d-4155-11e7-b46f-bc935896ce0b" identifier="/us/usc/t49/s5330/c/2/A"><num value="A">(A)</num><content> to require, review, approve, and monitor the carrying out of each plan;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id91eea09e-4155-11e7-b46f-bc935896ce0b" identifier="/us/usc/t49/s5330/c/2/B"><num value="B">(B)</num><content> to investigate hazardous conditions and accidents on the systems; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id91eea09f-4155-11e7-b46f-bc935896ce0b" identifier="/us/usc/t49/s5330/c/2/C"><num value="C">(C)</num><content> to require corrective action to correct or eliminate those conditions.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id91eea0a0-4155-11e7-b46f-bc935896ce0b" identifier="/us/usc/t49/s5330/d"><num value="d">(d)</num><heading> <inline class="small-caps">Multistate Involvement</inline>.—</heading><content>When more than one State is subject to this section in connection with a single public transportation authority, the affected States shall ensure uniform safety standards and enforcement or shall designate an entity (except the public transportation authority) to ensure uniform safety standards and enforcement and to meet the requirements of subsection (c) of this section.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id91eea0a1-4155-11e7-b46f-bc935896ce0b" identifier="/us/usc/t49/s5330/e"><num value="e">(e)</num><heading> <inline class="small-caps">Availability of Withheld Amounts</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id91eea0a2-4155-11e7-b46f-bc935896ce0b" identifier="/us/usc/t49/s5330/e/1"><num value="1">(1)</num><content> An amount withheld under subsection (b) of this section remains available for apportionment for use in the State until the end of the 2d fiscal year after the fiscal year for which the amount may be appropriated.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id91eea0a3-4155-11e7-b46f-bc935896ce0b" identifier="/us/usc/t49/s5330/e/2"><num value="2">(2)</num><content> If a State meets the requirements of subsection (c) of this section before the last day of the period for which an amount withheld under subsection (b) of this section remains available under paragraph (1) of this subsection, the Secretary, on the first day on which the State meets the requirements, shall apportion to the State the amount withheld that remains available for apportionment for use in the State. An amount apportioned under this paragraph remains available until the end of the 3d fiscal year after the fiscal year in which the amount is apportioned. An amount not obligated at the end of the 3-year period shall be apportioned for use in other States under <ref href="/us/usc/t49/s5336">section 5336 of this title</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id91eec7b4-4155-11e7-b46f-bc935896ce0b" identifier="/us/usc/t49/s5330/e/3"><num value="3">(3)</num><content> If a State does not meet the requirements of subsection (c) of this section at the end of the period for which an amount withheld under subsection (b) of this section remains available under paragraph (1) of this subsection, the amount shall be apportioned for use in other States under <ref href="/us/usc/t49/s5336">section 5336 of this title</ref>.</content>
