<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id886b7074-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s5332"><num value="5332">§ 5332.</num><heading> Nondiscrimination</heading><subsection style="-uslm-lc:I11" class="indent0" id="id886b7075-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s5332/a"><num value="a">(a)</num><heading> <inline class="small-caps">Definition</inline>.—</heading><content>In this section, “person” includes a governmental authority, political subdivision, authority, legal representative, trust, unincorporated organization, trustee, trustee in bankruptcy, and receiver.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id886b7076-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s5332/b"><num value="b">(b)</num><heading> <inline class="small-caps">Prohibitions</inline>.—</heading><content>A person may not be excluded from participating in, denied a benefit of, or discriminated against under, a project, program, or activity receiving financial assistance under this chapter because of race, color, religion, national origin, sex, disability, or age.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id886b7077-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s5332/c"><num value="c">(c)</num><heading> <inline class="small-caps">Compliance</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id886b7078-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s5332/c/1"><num value="1">(1)</num><content> The Secretary shall take affirmative action to ensure compliance with subsection (b) of this section.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id886b7079-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s5332/c/2"><num value="2">(2)</num><content> When the Secretary decides that a person receiving financial assistance under this chapter is not complying with subsection (b) of this section, a civil rights law of the United States, or a regulation or order under that law, the Secretary shall notify the person of the decision and require action be taken to ensure compliance with subsection (b).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id886b707a-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s5332/d"><num value="d">(d)</num><heading> <inline class="small-caps">Authority of Secretary for Noncompliance</inline>.—</heading><chapeau>If a person does not comply with subsection (b) of this section within a reasonable time after receiving notice, the Secretary shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id886b707b-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s5332/d/1"><num value="1">(1)</num><content> direct that no further financial assistance of the United States Government under this chapter be provided to the person;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id886b707c-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s5332/d/2"><num value="2">(2)</num><content> refer the matter to the Attorney General with a recommendation that a civil action be brought;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id886b707d-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s5332/d/3"><num value="3">(3)</num><content> proceed under title VI of the Civil Rights Act of 1964 (<ref href="/us/usc/t42/s2000d">42 U.S.C. 2000d</ref> et seq.); or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id886b707e-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s5332/d/4"><num value="4">(4)</num><content> take any other action provided by law.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id886b707f-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s5332/e"><num value="e">(e)</num><heading> <inline class="small-caps">Civil Actions by Attorney General</inline>.—</heading><chapeau>The Attorney General may bring a civil action for appropriate relief when—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id886b7080-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s5332/e/1"><num value="1">(1)</num><content> a matter is referred to the Attorney General under subsection (d)(2) of this section; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id886b7081-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s5332/e/2"><num value="2">(2)</num><content> the Attorney General believes a person is engaged in a pattern or practice in violation of this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id886b7082-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s5332/f"><num value="f">(f)</num><heading> <inline class="small-caps">Application and Relationship to Other Laws</inline>.—</heading><content>This section applies to an employment or business opportunity and is in addition to title VI of the Civil Rights Act of 1964 (<ref href="/us/usc/t42/s2000d">42 U.S.C. 2000d</ref> et seq.).</content>
