<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id34afb735-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337"><num value="5337">§ 5337.</num><heading> State of good repair grants</heading><subsection style="-uslm-lc:I11" class="indent0" id="id34afb736-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/a"><num value="a">(a)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section, the following definitions shall apply:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id34afb737-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">Fixed guideway</inline>.—</heading><chapeau>The term “fixed guideway” means a public transportation facility—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb738-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/a/1/A"><num value="A">(A)</num><content> using and occupying a separate right-of-way for the exclusive use of public transportation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb739-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/a/1/B"><num value="B">(B)</num><content> using rail;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb73a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/a/1/C"><num value="C">(C)</num><content> using a fixed catenary system;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb73b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/a/1/D"><num value="D">(D)</num><content> for a passenger ferry system; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb73c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/a/1/E"><num value="E">(E)</num><content> for a bus rapid transit system.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34afb73d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/a/2"><num value="2">(2)</num><heading> <inline class="small-caps">State</inline>.—</heading><content>The term “State” means the 50 States, the District of Columbia, and Puerto Rico.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34afb73e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/a/3"><num value="3">(3)</num><heading> <inline class="small-caps">State of good repair</inline>.—</heading><content>The term “state of good repair” has the meaning given that term by the Secretary, by rule, under section 5326(b).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34afb73f-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/a/4"><num value="4">(4)</num><heading> <inline class="small-caps">Transit asset management plan</inline>.—</heading><chapeau>The term “transit asset management plan” means a plan developed by a recipient of funding under this chapter that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb740-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/a/4/A"><num value="A">(A)</num><content> includes, at a minimum, capital asset inventories and condition assessments, decision support tools, and investment prioritization; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb741-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/a/4/B"><num value="B">(B)</num><content> the recipient certifies that the recipient complies with the rule issued under section 5326(d).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id34afb742-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/b"><num value="b">(b)</num><heading> General Authority.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id34afb743-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">Eligible projects</inline>.—</heading><chapeau>The Secretary may make grants under this section to assist State and local governmental authorities in financing capital projects to maintain public transportation systems in a state of good repair, including projects to replace and rehabilitate—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb744-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/b/1/A"><num value="A">(A)</num><content> rolling stock;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb745-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/b/1/B"><num value="B">(B)</num><content> track;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb746-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/b/1/C"><num value="C">(C)</num><content> line equipment and structures;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb747-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/b/1/D"><num value="D">(D)</num><content> signals and communications;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb748-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/b/1/E"><num value="E">(E)</num><content> power equipment and substations;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb749-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/b/1/F"><num value="F">(F)</num><content> passenger stations and terminals;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb74a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/b/1/G"><num value="G">(G)</num><content> security equipment and systems;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb74b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/b/1/H"><num value="H">(H)</num><content> maintenance facilities and equipment;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb74c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/b/1/I"><num value="I">(I)</num><content> operational support equipment, including computer hardware and software;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb74d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/b/1/J"><num value="J">(J)</num><content> development and implementation of a transit asset management plan; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb74e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/b/1/K"><num value="K">(K)</num><content> other replacement and rehabilitation projects the Secretary determines appropriate.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34afb74f-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Inclusion in plan</inline>.—</heading><content>A recipient shall include a project carried out under paragraph (1) in the transit asset management plan of the recipient upon completion of the plan.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id34afb750-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/c"><num value="c">(c)</num><heading> High Intensity Fixed Guideway State of Good Repair Formula.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id34afb751-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Of the amount authorized or made available under section 5338(a)(2)(K), 97.15 percent shall be apportioned to recipients in accordance with this subsection.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34afb752-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/c/2"><num value="2">(2)</num><heading> Area share.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb753-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/c/2/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>50 percent of the amount described in paragraph (1) shall be apportioned for fixed guideway systems in accordance with this paragraph.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb754-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/c/2/B"><num value="B">(B)</num><heading> <inline class="small-caps">Share</inline>.—</heading><content>A recipient shall receive an amount equal to the amount described in subparagraph (A), multiplied by the amount the recipient would have received under this section, as in effect for fiscal year 2011, if the amount had been calculated in accordance with the provisions of section 5336(b)(1) and using the definition of the term “fixed guideway” under subsection (a) of this section, as such sections are in effect on the day after the date of enactment of the Federal Public Transportation Act of 2012, and divided by the total amount apportioned for all areas under this section for fiscal year 2011.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb755-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/c/2/C"><num value="C">(C)</num><heading> <inline class="small-caps">Recipient</inline>.—</heading><content>For purposes of this paragraph, the term “recipient” means an entity that received funding under this section, as in effect for fiscal year 2011.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34afb756-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/c/3"><num value="3">(3)</num><heading> Vehicle revenue miles and directional route miles.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb757-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/c/3/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>50 percent of the amount described in paragraph (1) shall be apportioned to recipients in accordance with this paragraph.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb758-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/c/3/B"><num value="B">(B)</num><heading> <inline class="small-caps">Vehicle revenue miles</inline>.—</heading><content>A recipient in an urbanized area shall receive an amount equal to 60 percent of the amount described in subparagraph (A), multiplied by the number of fixed guideway vehicle revenue miles attributable to the urbanized area, as established by the Secretary, divided by the total number of all fixed guideway vehicle revenue miles attributable to all urbanized areas.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb759-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/c/3/C"><num value="C">(C)</num><heading> <inline class="small-caps">Directional route miles</inline>.—</heading><content>A recipient in an urbanized area shall receive an amount equal to 40 percent of the amount described in subparagraph (A), multiplied by the number of fixed guideway directional route miles attributable to the urbanized area, as established by the Secretary, divided by the total number of all fixed guideway directional route miles attributable to all urbanized areas.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34afb75a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/c/4"><num value="4">(4)</num><heading> Limitation.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb75b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/c/4/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Except as provided in subparagraph (B), the share of the total amount apportioned under this subsection that is apportioned to an area under this subsection shall not decrease by more than 0.25 percentage points compared to the share apportioned to the area under this subsection in the previous fiscal year.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb75c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/c/4/B"><num value="B">(B)</num><heading> <inline class="small-caps">Special rule for fiscal year 2013</inline>.—</heading><content>In fiscal year 2013, the share of the total amount apportioned under this subsection that is apportioned to an area under this subsection shall not decrease by more than 0.25 percentage points compared to the share that would have been apportioned to the area under this section, as in effect for fiscal year 2011, if the share had been calculated using the definition of the term “fixed guideway” under subsection (a) of this section, as in effect on the day after the date of enactment of the Federal Public Transportation Act of 2012.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34afb75d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/c/5"><num value="5">(5)</num><heading> <inline class="small-caps">Use of funds</inline>.—</heading><content>Amounts made available under this subsection shall be available for the exclusive use of fixed guideway projects.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34afb75e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/c/6"><num value="6">(6)</num><heading> Receiving apportionment.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb75f-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/c/6/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Except as provided in subparagraph (B), for an area with a fixed guideway system, the amounts provided under this subsection shall be apportioned to the designated recipient for the urbanized area in which the system operates.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb760-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/c/6/B"><num value="B">(B)</num><heading> <inline class="small-caps">Exception</inline>.—</heading><content>An area described in the amendment made by section 3028(a) of the Transportation Equity Act for the 21st Century (<ref href="/us/pl/105/178">Public Law 105–178</ref>; <ref href="/us/stat/112/366">112 Stat. 366</ref>) shall receive an individual apportionment under this subsection.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34afb761-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/c/7"><num value="7">(7)</num><heading> <inline class="small-caps">Apportionment requirements</inline>.—</heading><content>For purposes of determining the number of fixed guideway vehicle revenue miles or fixed guideway directional route miles attributable to an urbanized area for a fiscal year under this subsection, only segments of fixed guideway systems placed in revenue service not later than 7 years before the first day of the fiscal year shall be deemed to be attributable to an urbanized area.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id34afb762-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/d"><num value="d">(d)</num><heading> High Intensity Motorbus State of Good Repair.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id34afb763-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/d/1"><num value="1">(1)</num><heading> <inline class="small-caps">Definition</inline>.—</heading><content>For purposes of this subsection, the term “high intensity motorbus” means public transportation that is provided on a facility with access for other high-occupancy vehicles.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34afb764-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/d/2"><num value="2">(2)</num><heading> <inline class="small-caps">Apportionment</inline>.—</heading><content>Of the amount authorized or made available under section 5338(a)(2)(K), 2.85 percent shall be apportioned to urbanized areas for high intensity motorbus vehicle state of good repair in accordance with this subsection.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34afb765-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/d/3"><num value="3">(3)</num><heading> Vehicle revenue miles and directional route miles.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb766-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/d/3/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The amount described in paragraph (2) shall be apportioned to each area in accordance with this paragraph.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb767-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/d/3/B"><num value="B">(B)</num><heading> <inline class="small-caps">Vehicle revenue miles</inline>.—</heading><content>Each area shall receive an amount equal to 60 percent of the amount described in subparagraph (A), multiplied by the number of high intensity motorbus vehicle revenue miles attributable to the area, as established by the Secretary, divided by the total number of all high intensity motorbus vehicle revenue miles attributable to all areas.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb768-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/d/3/C"><num value="C">(C)</num><heading> <inline class="small-caps">Directional route miles</inline>.—</heading><content>Each area shall receive an amount equal to 40 percent of the amount described in subparagraph (A), multiplied by the number of high intensity motorbus directional route miles attributable to the area, as established by the Secretary, divided by the total number of all high intensity motorbus directional route miles attributable to all areas.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34afb769-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/d/4"><num value="4">(4)</num><heading> <inline class="small-caps">Apportionment requirements</inline>.—</heading><content>For purposes of determining the number of high intensity motorbus vehicle revenue miles or high intensity motorbus directional route miles attributable to an urbanized area for a fiscal year under this subsection, only segments of high intensity motorbus systems placed in revenue service not later than 7 years before the first day of the fiscal year shall be deemed to be attributable to an urbanized area.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34afb76a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/d/5"><num value="5">(5)</num><heading> <inline class="small-caps">Use of funds</inline>.—</heading><content>Amounts apportioned under this subsection may be used for any project that is an eligible project under subsection (b)(1).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id34afb76b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/e"><num value="e">(e)</num><heading> Government Share of Costs.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id34afb76c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/e/1"><num value="1">(1)</num><heading> <inline class="small-caps">Capital projects</inline>.—</heading><content>A grant for a capital project under this section shall be for 80 percent of the net project cost of the project. The recipient may provide additional local matching amounts.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34afb76d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/e/2"><num value="2">(2)</num><heading> <inline class="small-caps">Remaining costs</inline>.—</heading><chapeau>The remainder of the net project cost shall be provided—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb76e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/e/2/A"><num value="A">(A)</num><content> in cash from non-Government sources;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb76f-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/e/2/B"><num value="B">(B)</num><content> from revenues derived from the sale of advertising and concessions; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34afb770-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5337/e/2/C"><num value="C">(C)</num><content> from an undistributed cash surplus, a replacement or depreciation cash fund or reserve, or new capital.</content>
