<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id90f352b8-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339"><num value="5339">§ 5339.</num><heading> Bus and bus facilities formula grants</heading><subsection style="-uslm-lc:I11" class="indent0" id="id90f352b9-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/a"><num value="a">(a)</num><heading> General Authority.—</heading><chapeau>The Secretary may make grants under this section to assist eligible recipients described in subsection (c)(1) in financing capital projects—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id90f352ba-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/a/1"><num value="1">(1)</num><content> to replace, rehabilitate, and purchase buses and related equipment; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id90f352bb-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/a/2"><num value="2">(2)</num><content> to construct bus-related facilities.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id90f352bc-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/b"><num value="b">(b)</num><heading> Grant Requirements.—</heading><content>The requirements of section 5307 apply to recipients of grants made under this section.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id90f352bd-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/c"><num value="c">(c)</num><heading> Eligible Recipients and Subrecipients.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id90f352be-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/c/1"><num value="1">(1)</num><heading> Recipients.—</heading><content>Eligible recipients under this section are designated recipients that operate fixed route bus service or that allocate funding to fixed route bus operators.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id90f352bf-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/c/2"><num value="2">(2)</num><heading> Subrecipients.—</heading><content>A designated recipient that receives a grant under this section may allocate amounts of the grant to subrecipients that are public agencies or private nonprofit organizations engaged in public transportation.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id90f352c0-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/d"><num value="d">(d)</num><heading> Distribution of Grant Funds.—</heading><chapeau>Funds allocated under section 5338(a)(2)(J) shall be distributed as follows:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id90f352c1-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/d/1"><num value="1">(1)</num><heading> National distribution.—</heading><content>$65,500,000 shall be allocated to all States and territories, with each State receiving $1,250,000 and each territory receiving $500,000.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id90f352c2-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/d/2"><num value="2">(2)</num><heading> Distribution using population and service factors.—</heading><content>The remainder of the funds not otherwise distributed under paragraph (1) shall be allocated pursuant to the formula set forth in section 5336 other than subsection (b).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id90f352c3-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/e"><num value="e">(e)</num><heading> Transfers of Apportionments.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id90f352c4-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/e/1"><num value="1">(1)</num><heading> Transfer flexibility for national distribution funds.—</heading><content>The Governor of a State may transfer any part of the State’s apportionment under subsection (d)(1) to supplement amounts apportioned to the State under <ref href="/us/usc/t49/s5311/c">section 5311(c) of this title</ref> or amounts apportioned to urbanized areas under subsections (a) and (c) of <ref href="/us/usc/t49/s5336">section 5336 of this title</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id90f59cb5-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/e/2"><num value="2">(2)</num><heading> Transfer flexibility for population and service factors funds.—</heading><content>The Governor of a State may expend in an urbanized area with a population of less than 200,000 any amounts apportioned under subsection (d)(2) that are not allocated to designated recipients in urbanized areas with a population of 200,000 or more.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id90f59cb6-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/f"><num value="f">(f)</num><heading> Government’s Share of Costs.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id90f59cb7-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/f/1"><num value="1">(1)</num><heading> Capital projects.—</heading><content>A grant for a capital project under this section shall be for 80 percent of the net capital costs of the project. A recipient of a grant under this section may provide additional local matching amounts.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id90f59cb8-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/f/2"><num value="2">(2)</num><heading> Remaining costs.—</heading><chapeau>The remainder of the net project cost shall be provided—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id90f59cb9-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/f/2/A"><num value="A">(A)</num><content> in cash from non-Government sources other than revenues from providing public transportation services;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id90f59cba-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/f/2/B"><num value="B">(B)</num><content> from revenues derived from the sale of advertising and concessions;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id90f59cbb-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/f/2/C"><num value="C">(C)</num><content> from an undistributed cash surplus, a replacement or depreciation cash fund or reserve, or new capital; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id90f59cbc-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/f/2/D"><num value="D">(D)</num><content> from amounts received under a service agreement with a State or local social service agency or private social service organization.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id90f59cbd-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/g"><num value="g">(g)</num><heading> Period of Availability to Recipients.—</heading><content>Amounts made available under this section may be obligated by a recipient for 3 years after the fiscal year in which the amount is apportioned. Not later than 30 days after the end of the 3-year period described in the preceding sentence, any amount that is not obligated on the last day of that period shall be added to the amount that may be apportioned under this section in the next fiscal year.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id90f59cbe-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/h"><num value="h">(h)</num><heading> Definitions.—</heading><chapeau>For purposes of this section:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id90f59cbf-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/h/1"><num value="1">(1)</num><content> The term “State” means a State of the United States.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id90f59cc0-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5339/h/2"><num value="2">(2)</num><content> The term “territory” means the District of Columbia, Puerto Rico, the Northern Mariana Islands, Guam, American Samoa, and the United States Virgin Islands.</content>
