<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id34b472b3-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339"><num value="5339">§ 5339.</num><heading> Grants for buses and bus facilities</heading><subsection style="-uslm-lc:I11" class="indent0" id="id34b472b4-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a"><num value="a">(a)</num><heading> Formula Grants.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id34b472b5-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this subsection—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472b6-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/1/A"><num value="A">(A)</num><content> the term “low or no emission vehicle” has the meaning given that term in subsection (c)(1);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472b7-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/1/B"><num value="B">(B)</num><content> the term “State” means a State of the United States; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472b8-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/1/C"><num value="C">(C)</num><content> the term “territory” means the District of Columbia, Puerto Rico, the Northern Mariana Islands, Guam, American Samoa, and the United States Virgin Islands.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b472b9-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/2"><num value="2">(2)</num><heading> <inline class="small-caps">General authority</inline>.—</heading><chapeau>The Secretary may make grants under this subsection to assist eligible recipients described in paragraph (4)(A) in financing capital projects—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472ba-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/2/A"><num value="A">(A)</num><content> to replace, rehabilitate, and purchase buses and related equipment, including technological changes or innovations to modify low or no emission vehicles or facilities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472bb-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/2/B"><num value="B">(B)</num><content> to construct bus-related facilities.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b472bc-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/3"><num value="3">(3)</num><heading> <inline class="small-caps">Grant requirements</inline>.—</heading><chapeau>The requirements of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472bd-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/3/A"><num value="A">(A)</num><content> section 5307 shall apply to recipients of grants made in urbanized areas under this subsection; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472be-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/3/B"><num value="B">(B)</num><content> section 5311 shall apply to recipients of grants made in rural areas under this subsection.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b472bf-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/4"><num value="4">(4)</num><heading> Eligible recipients.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472c0-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/4/A"><num value="A">(A)</num><heading> <inline class="small-caps">Recipients</inline>.—</heading><chapeau>Eligible recipients under this subsection are—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id34b472c1-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/4/A/i"><num value="i">(i)</num><content> designated recipients that allocate funds to fixed route bus operators; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34b472c2-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/4/A/ii"><num value="ii">(ii)</num><content> State or local governmental entities that operate fixed route bus service.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472c3-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/4/B"><num value="B">(B)</num><heading> <inline class="small-caps">Subrecipients</inline>.—</heading><content>A recipient that receives a grant under this subsection may allocate amounts of the grant to subrecipients that are public agencies or private nonprofit organizations engaged in public transportation.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b472c4-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/5"><num value="5">(5)</num><heading> <inline class="small-caps">Distribution of grant funds</inline>.—</heading><chapeau>Funds allocated under section 5338(a)(2)(L) shall be distributed as follows:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472c5-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/5/A"><num value="A">(A)</num><heading> <inline class="small-caps">National distribution</inline>.—</heading><content>$90,500,000 for each of fiscal years 2016 through 2020 shall be allocated to all States and territories, with each State receiving $1,750,000 for each such fiscal year and each territory receiving $500,000 for each such fiscal year.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472c6-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/5/B"><num value="B">(B)</num><heading> <inline class="small-caps">Distribution using population and service factors</inline>.—</heading><content>The remainder of the funds not otherwise distributed under subparagraph (A) shall be allocated pursuant to the formula set forth in section 5336 other than subsection (b).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b472c7-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/6"><num value="6">(6)</num><heading> Transfers of apportionments.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472c8-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/6/A"><num value="A">(A)</num><heading> <inline class="small-caps">Transfer flexibility for national distribution funds</inline>.—</heading><content>The Governor of a State may transfer any part of the State’s apportionment under paragraph (5)(A) to supplement amounts apportioned to the State under section 5311(c) or amounts apportioned to urbanized areas under subsections (a) and (c) of section 5336.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472c9-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/6/B"><num value="B">(B)</num><heading> <inline class="small-caps">Transfer flexibility for population and service factors funds</inline>.—</heading><content>The Governor of a State may expend in an urbanized area with a population of less than 200,000 any amounts apportioned under paragraph (5)(B) that are not allocated to designated recipients in urbanized areas with a population of 200,000 or more.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b472ca-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/7"><num value="7">(7)</num><heading> Government share of costs.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472cb-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/7/A"><num value="A">(A)</num><heading> <inline class="small-caps">Capital projects</inline>.—</heading><content>A grant for a capital project under this subsection shall be for 80 percent of the net capital costs of the project. A recipient of a grant under this subsection may provide additional local matching amounts.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472cc-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/7/B"><num value="B">(B)</num><heading> <inline class="small-caps">Remaining costs</inline>.—</heading><chapeau>The remainder of the net project cost shall be provided—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id34b472cd-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/7/B/i"><num value="i">(i)</num><content> in cash from non-Government sources other than revenues from providing public transportation services;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34b472ce-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/7/B/ii"><num value="ii">(ii)</num><content> from revenues derived from the sale of advertising and concessions;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34b472cf-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/7/B/iii"><num value="iii">(iii)</num><content> from an undistributed cash surplus, a replacement or depreciation cash fund or reserve, or new capital;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34b472d0-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/7/B/iv"><num value="iv">(iv)</num><content> from amounts received under a service agreement with a State or local social service agency or private social service organization; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34b472d1-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/7/B/v"><num value="v">(v)</num><content> from revenues generated from value capture financing mechanisms.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b472d2-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/8"><num value="8">(8)</num><heading> <inline class="small-caps">Period of availability to recipients</inline>.—</heading><content>Amounts made available under this subsection may be obligated by a recipient for 3 fiscal years after the fiscal year in which the amount is apportioned. Not later than 30 days after the end of the 3-fiscal-year period described in the preceding sentence, any amount that is not obligated on the last day of such period shall be added to the amount that may be apportioned under this subsection in the next fiscal year.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b472d3-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/9"><num value="9">(9)</num><heading> Pilot program for cost-effective capital investment.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472d4-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/9/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>For each of fiscal years 2016 through 2020, the Secretary shall carry out a pilot program under which an eligible recipient (as described in paragraph (4)) in an urbanized area with population of not less than 200,000 and not more than 999,999 may elect to participate in a State pool in accordance with this paragraph.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472d5-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/9/B"><num value="B">(B)</num><heading> <inline class="small-caps">Purpose of state pools</inline>.—</heading><content>The purpose of a State pool shall be to allow for transfers of formula grant funds made available under this subsection among the designated recipients participating in the State pool in a manner that supports the transit asset management plans of the designated recipients under section 5326.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472d6-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/9/C"><num value="C">(C)</num><heading> <inline class="small-caps">Requests for participation</inline>.—</heading><content>A State, and eligible recipients in the State described in subparagraph (A), may submit to the Secretary a request for participation in the program under procedures to be established by the Secretary. An eligible recipient for a multistate area may participate in only 1 State pool.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472d7-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/9/D"><num value="D">(D)</num><heading> <inline class="small-caps">Allocations to participating states</inline>.—</heading><content>For each fiscal year, the Secretary shall allocate to each State participating in the program the total amount of funds that otherwise would be allocated to the urbanized areas of the eligible recipients participating in the State’s pool for that fiscal year pursuant to the formulas referred to in paragraph (5).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472d8-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/9/E"><num value="E">(E)</num><heading> <inline class="small-caps">Allocations to eligible recipients in state pools</inline>.—</heading><content>A State shall distribute the amount that is allocated to the State for a fiscal year under subparagraph (D) among the eligible recipients participating in the State’s pool in a manner that supports the transit asset management plans of the recipients under section 5326.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472d9-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/9/F"><num value="F">(F)</num><heading> <inline class="small-caps">Allocation plans</inline>.—</heading><content>A State participating in the program shall develop an allocation plan for the period of fiscal years 2016 through 2020 to ensure that an eligible recipient participating in the State’s pool receives under the program an amount of funds that equals the amount of funds that would have otherwise been available to the eligible recipient for that period pursuant to the formulas referred to in paragraph (5).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472da-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/a/9/G"><num value="G">(G)</num><heading> <inline class="small-caps">Grants</inline>.—</heading><content>The Secretary shall make grants under this subsection for a fiscal year to an eligible recipient participating in a State pool following notification by the State of the allocation amount determined under subparagraph (E).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id34b472db-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b"><num value="b">(b)</num><heading> Buses and Bus Facilities Competitive Grants.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id34b472dc-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>The Secretary may make grants under this subsection to eligible recipients (as described in subsection (a)(4)) to assist in the financing of buses and bus facilities capital projects, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472dd-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b/1/A"><num value="A">(A)</num><content> replacing, rehabilitating, purchasing, or leasing buses or related equipment; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472de-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b/1/B"><num value="B">(B)</num><content> rehabilitating, purchasing, constructing, or leasing bus-related facilities.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b472df-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Grant considerations</inline>.—</heading><content>In making grants under this subsection, the Secretary shall consider the age and condition of buses, bus fleets, related equipment, and bus-related facilities.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b472e0-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b/3"><num value="3">(3)</num><heading> <inline class="small-caps">Statewide applications</inline>.—</heading><content>A State may submit a statewide application on behalf of a public agency or private nonprofit organization engaged in public transportation in rural areas or other areas for which the State allocates funds. The submission of a statewide application shall not preclude the submission and consideration of any application under this subsection from other eligible recipients (as described in subsection (a)(4)) in an urbanized area in a State.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b472e1-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b/4"><num value="4">(4)</num><heading> <inline class="small-caps">Requirements for the secretary</inline>.—</heading><chapeau>The Secretary shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472e2-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b/4/A"><num value="A">(A)</num><content> disclose all metrics and evaluation procedures to be used in considering grant applications under this subsection upon issuance of the notice of funding availability in the Federal Register; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472e3-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b/4/B"><num value="B">(B)</num><content> publish a summary of final scores for selected projects, metrics, and other evaluations used in awarding grants under this subsection in the Federal Register.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b472e4-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b/5"><num value="5">(5)</num><heading> <inline class="small-caps">Rural projects</inline>.—</heading><content>Not less than 10 percent of the amounts made available under this subsection in a fiscal year shall be distributed to projects in rural areas.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b472e5-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b/6"><num value="6">(6)</num><heading> Grant requirements.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472e6-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b/6/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>A grant under this subsection shall be subject to the requirements of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id34b472e7-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b/6/A/i"><num value="i">(i)</num><content> section 5307 for eligible recipients of grants made in urbanized areas; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34b472e8-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b/6/A/ii"><num value="ii">(ii)</num><content> section 5311 for eligible recipients of grants made in rural areas.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472e9-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b/6/B"><num value="B">(B)</num><heading> <inline class="small-caps">Government share of costs</inline>.—</heading><content>The Government share of the cost of an eligible project carried out under this subsection shall not exceed 80 percent.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b472ea-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b/7"><num value="7">(7)</num><heading> <inline class="small-caps">Availability of funds</inline>.—</heading><chapeau>Any amounts made available to carry out this subsection—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472eb-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b/7/A"><num value="A">(A)</num><content> shall remain available for 3 fiscal years after the fiscal year for which the amount is made available; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472ec-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b/7/B"><num value="B">(B)</num><content> that remain unobligated at the end of the period described in subparagraph (A) shall be added to the amount made available to an eligible project in the following fiscal year.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b472ed-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/b/8"><num value="8">(8)</num><heading> <inline class="small-caps">Limitation</inline>.—</heading><content>Of the amounts made available under this subsection, not more than 10 percent may be awarded to a single grantee.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id34b472ee-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c"><num value="c">(c)</num><heading> Low or No Emission Grants.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id34b472ef-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this subsection—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472f0-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/1/A"><num value="A">(A)</num><content> the term “direct carbon emissions” means the quantity of direct greenhouse gas emissions from a vehicle, as determined by the Administrator of the Environmental Protection Agency;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472f1-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/1/B"><num value="B">(B)</num><chapeau> the term “eligible project” means a project or program of projects in an eligible area for—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id34b472f2-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/1/B/i"><num value="i">(i)</num><content> acquiring low or no emission vehicles;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34b472f3-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/1/B/ii"><num value="ii">(ii)</num><content> leasing low or no emission vehicles;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34b472f4-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/1/B/iii"><num value="iii">(iii)</num><content> acquiring low or no emission vehicles with a leased power source;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34b472f5-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/1/B/iv"><num value="iv">(iv)</num><content> constructing facilities and related equipment for low or no emission vehicles;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34b472f6-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/1/B/v"><num value="v">(v)</num><content> leasing facilities and related equipment for low or no emission vehicles;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34b472f7-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/1/B/vi"><num value="vi">(vi)</num><content> constructing new public transportation facilities to accommodate low or no emission vehicles; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34b472f8-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/1/B/vii"><num value="vii">(vii)</num><content> rehabilitating or improving existing public transportation facilities to accommodate low or no emission vehicles;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472f9-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/1/C"><num value="C">(C)</num><content> the term “leased power source” means a removable power source, as defined in subsection (c)(3) of section 3019 of the Federal Public Transportation Act of 2015 that is made available through a capital lease under such section;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472fa-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/1/D"><num value="D">(D)</num><content> the term “low or no emission bus” means a bus that is a low or no emission vehicle;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472fb-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/1/E"><num value="E">(E)</num><chapeau> the term “low or no emission vehicle” means—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id34b472fc-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/1/E/i"><num value="i">(i)</num><content> a passenger vehicle used to provide public transportation that the Secretary determines sufficiently reduces energy consumption or harmful emissions, including direct carbon emissions, when compared to a comparable standard vehicle; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34b472fd-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/1/E/ii"><num value="ii">(ii)</num><content> a zero emission vehicle used to provide public transportation;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472fe-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/1/F"><num value="F">(F)</num><content> the term “recipient” means a designated recipient, a local governmental authority, or a State that receives a grant under this subsection for an eligible project; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b472ff-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/1/G"><num value="G">(G)</num><content> the term “zero emission vehicle” means a low or no emission vehicle that produces no carbon or particulate matter.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b47300-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">General authority</inline>.—</heading><content>The Secretary may make grants to recipients to finance eligible projects under this subsection.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b47301-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/3"><num value="3">(3)</num><heading> Grant requirements.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id34b47302-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/3/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>A grant under this subsection shall be subject to the requirements of section 5307.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b47303-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/3/B"><num value="B">(B)</num><heading> <inline class="small-caps">Government share of costs for certain projects</inline>.—</heading><content>Section 5323(i) applies to eligible projects carried out under this subsection, unless the recipient requests a lower grant percentage.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b47304-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/3/C"><num value="C">(C)</num><heading> Combination of funding sources.—</heading><clause style="-uslm-lc:I14" class="indent3" id="id34b47305-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/3/C/i"><num value="i">(i)</num><heading> <inline class="small-caps">Combination permitted</inline>.—</heading><content>An eligible project carried out under this subsection may receive funding under section 5307 or any other provision of law.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34b47306-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/3/C/ii"><num value="ii">(ii)</num><heading> <inline class="small-caps">Government share</inline>.—</heading><content>Nothing in this subparagraph shall be construed to alter the Government share required under paragraph (7), section 5307, or any other provision of law.</content>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b47307-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/4"><num value="4">(4)</num><heading> <inline class="small-caps">Competitive process</inline>.—</heading><chapeau>The Secretary shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34b47308-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/4/A"><num value="A">(A)</num><content> not later than 30 days after the date on which amounts are made available for obligation under this subsection for a full fiscal year, solicit grant applications for eligible projects on a competitive basis; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b47309-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/4/B"><num value="B">(B)</num><chapeau> award a grant under this subsection based on the solicitation under subparagraph (A) not later than the earlier of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id34b4730a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/4/B/i"><num value="i">(i)</num><content> 75 days after the date on which the solicitation expires; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34b4730b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/4/B/ii"><num value="ii">(ii)</num><content> the end of the fiscal year in which the Secretary solicited the grant applications.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b4730c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/5"><num value="5">(5)</num><heading> <inline class="small-caps">Consideration</inline>.—</heading><chapeau>In awarding grants under this subsection, the Secretary shall only consider eligible projects relating to the acquisition or leasing of low or no emission buses or bus facilities that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34b4730d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/5/A"><num value="A">(A)</num><content> make greater reductions in energy consumption and harmful emissions, including direct carbon emissions, than comparable standard buses or other low or no emission buses; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b4730e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/5/B"><num value="B">(B)</num><content> are part of a long-term integrated fleet management plan for the recipient.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b4730f-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/6"><num value="6">(6)</num><heading> <inline class="small-caps">Availability of funds</inline>.—</heading><chapeau>Any amounts made available to carry out this subsection—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34b47310-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/6/A"><num value="A">(A)</num><content> shall remain available to an eligible project for 3 fiscal years after the fiscal year for which the amount is made available; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b47311-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/6/B"><num value="B">(B)</num><content> that remain unobligated at the end of the period described in subparagraph (A) shall be added to the amount made available to an eligible project in the following fiscal year.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id34b47312-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/7"><num value="7">(7)</num><heading> Government share of costs.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id34b47313-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/7/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Federal share of the cost of an eligible project carried out under this subsection shall not exceed 80 percent.</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="id34b47314-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5339/c/7/B"><num value="B">(B)</num><heading> <inline class="small-caps">Non-federal share</inline>.—</heading><content>The non-Federal share of the cost of an eligible project carried out under this subsection may be derived from in-kind contributions.</content>
