<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id34b6e3e0-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5564"><num value="5564">§ 5564.</num><heading> Interim preservation of certain rail passenger terminals</heading><subsection style="-uslm-lc:I11" class="indent0" id="id34b6e3e1-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5564/a"><num value="a">(a)</num><heading> <inline class="small-caps">General Grant Authority</inline>.—</heading><content>Subject to subsection (b) of this section, the Secretary of Transportation may make a grant of financial assistance to a responsible person (including a governmental authority) to preserve a rail passenger terminal under <ref href="/us/usc/t49/s5562/a/2">section 5562(a)(2) of this title</ref>. To receive assistance under this section, the person must be qualified, prepared, committed, and authorized by law to maintain (and prevent the demolition, dismantling, or further deterioration of) the terminal until plans for its reuse are prepared.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id34b6e3e2-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5564/b"><num value="b">(b)</num><heading> <inline class="small-caps">Grant Requirements</inline>.—</heading><chapeau>The Secretary of Transportation may make a grant of financial assistance under this section only if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id34b6e3e3-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5564/b/1"><num value="1">(1)</num><content> the Secretary decides the rail passenger terminal has a reasonable likelihood of being converted to, or conditioned for reuse as, an intermodal transportation terminal, a civic or cultural activities center, or both; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34b6e3e4-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5564/b/2"><num value="2">(2)</num><content> planning activity directed toward conversion or reuse has begun and is proceeding in a competent way.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id34b6e3e5-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5564/c"><num value="c">(c)</num><heading> <inline class="small-caps">Maximizing Preservation of Terminals</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id34b6e3e6-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5564/c/1"><num value="1">(1)</num><chapeau> Amounts appropriated to carry out this section and <ref href="/us/usc/t49/s5562/a/2">section 5562(a)(2) of this title</ref> shall be expended in the way most likely to maximize the preservation of rail passenger terminals that are—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id34b6e3e7-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5564/c/1/A"><num value="A">(A)</num><content> reasonably capable of conversion to intermodal transportation terminals;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id34b6e3e8-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5564/c/1/B"><num value="B">(B)</num><content> listed in the National Register of Historic Places maintained by the Secretary of the Interior; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id34b6e3e9-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5564/c/1/C"><num value="C">(C)</num><content> recommended (on the basis of architectural integrity and quality) by the Advisory Council on Historic Preservation or the Chairman of the National Endowment for the Arts.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id34b6e3ea-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s5564/c/2"><num value="2">(2)</num><content> The Secretary of Transportation may not make a grant under this section for more than 80 percent of the total cost of maintaining the terminal for an interim period of not more than 5 years.</content>
