<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id90fa57a5-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5565"><num value="5565">§ 5565.</num><heading> Encouraging the development of plans for converting certain rail passenger terminals</heading><subsection style="-uslm-lc:I11" class="indent0" id="id90fa57a6-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5565/a"><num value="a">(a)</num><heading> General Grant Authority.—</heading><chapeau>The Secretary of Transportation may make a grant of financial assistance to a qualified person (including a governmental authority) to encourage the development of plans for converting a rail passenger terminal under <ref href="/us/usc/t49/s5562/a/4">section 5562(a)(4) of this title</ref>. To receive assistance under this section, the person must—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id90fa57a7-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5565/a/1"><num value="1">(1)</num><content> be prepared to develop practicable plans that meet zoning, land use, and other requirements of the applicable State and local jurisdictions in which the terminal is located;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id90fa57a8-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5565/a/2"><num value="2">(2)</num><content> incorporate into the designs and plans proposed for converting the terminal, features that reasonably appear likely to attract private investors willing to carry out the planned conversion and its subsequent maintenance and operation; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id90fa57a9-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5565/a/3"><num value="3">(3)</num><content> complete the designs and plans for the conversion within the period of time prescribed by the Secretary.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id90fa57aa-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5565/b"><num value="b">(b)</num><heading> Preference.—</heading><content>In making a grant under this section, the Secretary of Transportation shall give preferential consideration to an applicant whose completed designs and plans will be carried out within 3 years after their completion.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id90fa57ab-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5565/c"><num value="c">(c)</num><heading> Maximizing Conversion and Continued Public Use.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id90fa57ac-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5565/c/1"><num value="1">(1)</num><chapeau> Amounts appropriated to carry out this section and <ref href="/us/usc/t49/s5562/a/4">section 5562(a)(4) of this title</ref> shall be expended in the way most likely to maximize the conversion and continued public use of rail passenger terminals that are—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id90fa57ad-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5565/c/1/A"><num value="A">(A)</num><content> listed in the National Register of Historic Places maintained by the Secretary of the Interior; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id90fa57ae-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5565/c/1/B"><num value="B">(B)</num><content> recommended (on the basis of architectural integrity and quality) by the Advisory Council on Historic Preservation or the Chairman of the National Endowment for the Arts.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id90fa57af-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s5565/c/2"><num value="2">(2)</num><content> The Secretary of Transportation may not make a grant under this section for more than 80 percent of the total cost of the project for which the financial assistance is provided.</content>
