<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id3cf014db-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101"><num value="60101">§ 60101.</num><heading> Definitions</heading><subsection style="-uslm-lc:I11" class="indent0" id="id3cf014dc-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a"><num value="a">(a)</num><heading> <inline class="small-caps">General</inline>.—</heading><chapeau>In this chapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3cf014dd-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/1"><num value="1">(1)</num><chapeau> “existing liquefied natural gas facility”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cf014de-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/1/A"><num value="A">(A)</num><chapeau> means a liquefied natural gas facility for which an application to approve the site, construction, or operation of the facility was filed before <date date="1978-03-01">March 1, 1978</date>, with—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3cf014df-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/1/A/i"><num value="i">(i)</num><content> the Federal Energy Regulatory Commission (or any predecessor); or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3cf014e0-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/1/A/ii"><num value="ii">(ii)</num><content> the appropriate State or local authority, if the facility is not subject to the jurisdiction of the Commission under the Natural Gas Act (<ref href="/us/usc/t15/s717">15 U.S.C. 717</ref> et seq.); but</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cf014e1-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/1/B"><num value="B">(B)</num><content> does not include a facility on which construction is begun after <date date="1979-11-29">November 29, 1979</date>, without the approval;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf014e2-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/2"><num value="2">(2)</num><content> “gas” means natural gas, flammable gas, or toxic or corrosive gas;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf014e3-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/3"><num value="3">(3)</num><content> “gas pipeline facility” includes a pipeline, a right of way, a facility, a building, or equipment used in transporting gas or treating gas during its transportation;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf014e4-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/4"><num value="4">(4)</num><chapeau> “hazardous liquid” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cf014e5-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/4/A"><num value="A">(A)</num><content> petroleum or a petroleum product;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cf014e6-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/4/B"><num value="B">(B)</num><content> nonpetroleum fuel, including biofuel, that is flammable, toxic, or corrosive or would be harmful to the environment if released in significant quantities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cf014e7-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/4/C"><num value="C">(C)</num><content> a substance the Secretary of Transportation decides may pose an unreasonable risk to life or property when transported by a hazardous liquid pipeline facility in a liquid state (except for liquefied natural gas);</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf014e8-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/5"><num value="5">(5)</num><content> “hazardous liquid pipeline facility” includes a pipeline, a right of way, a facility, a building, or equipment used or intended to be used in transporting hazardous liquid;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf014e9-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/6"><num value="6">(6)</num><chapeau> “interstate gas pipeline facility” means a gas pipeline facility—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cf014ea-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/6/A"><num value="A">(A)</num><content> used to transport gas; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cf014eb-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/6/B"><num value="B">(B)</num><content> subject to the jurisdiction of the Commission under the Natural Gas Act (<ref href="/us/usc/t15/s717">15 U.S.C. 717</ref> et seq.);</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf014ec-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/7"><num value="7">(7)</num><content> “interstate hazardous liquid pipeline facility” means a hazardous liquid pipeline facility used to transport hazardous liquid in interstate or foreign commerce;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf014ed-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/8"><num value="8">(8)</num><chapeau> “interstate or foreign commerce”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cf014ee-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/8/A"><num value="A">(A)</num><chapeau> related to gas, means commerce—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3cf014ef-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/8/A/i"><num value="i">(i)</num><content> between a place in a State and a place outside that State; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3cf014f0-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/8/A/ii"><num value="ii">(ii)</num><content> that affects any commerce described in subclause (A)(i) of this clause; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cf014f1-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/8/B"><num value="B">(B)</num><chapeau> related to hazardous liquid, means commerce between—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3cf014f2-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/8/B/i"><num value="i">(i)</num><content> a place in a State and a place outside that State; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3cf014f3-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/8/B/ii"><num value="ii">(ii)</num><content> places in the same State through a place outside the State;</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf014f4-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/9"><num value="9">(9)</num><content> “intrastate gas pipeline facility” means a gas pipeline facility and transportation of gas within a State not subject to the jurisdiction of the Commission under the Natural Gas Act (<ref href="/us/usc/t15/s717">15 U.S.C. 717</ref> et seq.);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf014f5-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/10"><num value="10">(10)</num><content> “intrastate hazardous liquid pipeline facility” means a hazardous liquid pipeline facility that is not an interstate hazardous liquid pipeline facility;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf014f6-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/11"><num value="11">(11)</num><content> “liquefied natural gas” means natural gas in a liquid or semisolid state;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf014f7-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/12"><num value="12">(12)</num><content> “liquefied natural gas accident” means a release, burning, or explosion of liquefied natural gas from any cause, except a release, burning, or explosion that, under regulations prescribed by the Secretary, does not pose a threat to public health or safety, property, or the environment;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf014f8-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/13"><num value="13">(13)</num><content> “liquefied natural gas conversion” means conversion of natural gas into liquefied natural gas or conversion of liquefied natural gas into natural gas;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf014f9-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/14"><num value="14">(14)</num><chapeau> “liquefied natural gas pipeline facility”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cf014fa-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/14/A"><num value="A">(A)</num><content> means a gas pipeline facility used for transporting or storing liquefied natural gas, or for liquefied natural gas conversion, in interstate or foreign commerce; but</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cf014fb-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/14/B"><num value="B">(B)</num><content> does not include any part of a structure or equipment located in navigable waters (as defined in section 3 of the Federal Power Act (<ref href="/us/usc/t16/s796">16 U.S.C. 796</ref>));</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf014fc-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/15"><num value="15">(15)</num><content> “municipality” means a political subdivision of a State;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf014fd-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/16"><num value="16">(16)</num><content> “new liquefied natural gas pipeline facility” means a liquefied natural gas pipeline facility except an existing liquefied natural gas pipeline facility;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf014fe-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/17"><num value="17">(17)</num><content> “person”, in addition to its meaning under <ref href="/us/usc/t1/s1">section 1 of title 1</ref> (except as to societies), includes a State, a municipality, and a trustee, receiver, assignee, or personal representative of a person;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf014ff-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/18"><num value="18">(18)</num><content> “pipeline facility” means a gas pipeline facility and a hazardous liquid pipeline facility;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf01500-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/19"><num value="19">(19)</num><content> “pipeline transportation” means transporting gas and transporting hazardous liquid;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf01501-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/20"><num value="20">(20)</num><content> “State” means a State of the United States, the District of Columbia, and Puerto Rico;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf01502-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/21"><num value="21">(21)</num><chapeau> “transporting gas”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cf01503-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/21/A"><num value="A">(A)</num><chapeau> means—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3cf01504-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/21/A/i"><num value="i">(i)</num><content> the gathering, transmission, or distribution of gas by pipeline, or the storage of gas, in interstate or foreign commerce; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3cf01505-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/21/A/ii"><num value="ii">(ii)</num><content> the movement of gas through regulated gathering lines; but</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cf01506-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/21/B"><num value="B">(B)</num><content> does not include gathering gas (except through regulated gathering lines) in a rural area outside a populated area designated by the Secretary as a nonrural area.<ref class="footnoteRef" idref="fn002169">1</ref><note type="footnote" id="fn002169"><num>1</num> So in original. </subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf01507-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/22"><num value="22">(22)</num><chapeau> “transporting hazardous liquid”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cf01508-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/22/A"><num value="A">(A)</num><chapeau> means—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3cf01509-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/22/A/i"><num value="i">(i)</num><content> the movement of hazardous liquid by pipeline, or the storage of hazardous liquid incidental to the movement of hazardous liquid by pipeline, in or affecting interstate or foreign commerce; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3cf0150a-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/22/A/ii"><num value="ii">(ii)</num><content> the movement of hazardous liquid through regulated gathering lines; but</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cf0150b-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/22/B"><num value="B">(B)</num><chapeau> does not include moving hazardous liquid through—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3cf0150c-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/22/B/i"><num value="i">(i)</num><content> gathering lines (except regulated gathering lines) in a rural area;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3cf0150d-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/22/B/ii"><num value="ii">(ii)</num><content> onshore production, refining, or manufacturing facilities; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3cf0150e-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/22/B/iii"><num value="iii">(iii)</num><content> storage or in-plant piping systems associated with onshore production, refining, or manufacturing facilities.<sup>1</sup></content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf0150f-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/23"><num value="23">(23)</num><content> “risk management” means the systematic application, by the owner or operator of a pipeline facility, of management policies, procedures, finite resources, and practices to the tasks of identifying, analyzing, assessing, reducing, and controlling risk in order to protect employees, the general public, the environment, and pipeline facilities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf01510-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/24"><num value="24">(24)</num><content> “risk management plan” means a management plan utilized by a gas or hazardous liquid pipeline facility owner or operator that encompasses risk management; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cf01511-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/a/25"><num value="25">(25)</num><content> “Secretary” means the Secretary of Transportation.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3cf01512-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/b"><num value="b">(b)</num><heading> <inline class="small-caps">Gathering Lines</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id3cf01513-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/b/1"><num value="1">(1)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id3cf01514-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/b/1/A"><num value="A">(A)</num><content> Not later than <date date="1994-10-24">October 24, 1994</date>, the Secretary shall prescribe standards defining the term “gathering line”.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id3cf01515-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/b/1/B"><num value="B">(B)</num><chapeau> In defining “gathering line” for gas, the Secretary—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="id3cf01516-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/b/1/B/i"><num value="i">(i)</num><content> shall consider functional and operational characteristics of the lines to be included in the definition; and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id3cf01517-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/b/1/B/ii"><num value="ii">(ii)</num><content> is not bound by a classification the Commission establishes under the Natural Gas Act (<ref href="/us/usc/t15/s717">15 U.S.C. 717</ref> et seq.).</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id3cf01518-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/b/2"><num value="2">(2)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id3cf01519-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/b/2/A"><num value="A">(A)</num><content> Not later than <date date="1995-10-24">October 24, 1995</date>, the Secretary, if appropriate, shall prescribe standards defining the term “regulated gathering line”. In defining the term, the Secretary shall consider factors such as location, length of line from the well site, operating pressure, throughput, and the composition of the transported gas or hazardous liquid, as appropriate, in deciding on the types of lines that functionally are gathering but should be regulated under this chapter because of specific physical characteristics.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id3cf0151a-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/b/2/B"><num value="B">(B)</num><clause style="-uslm-lc:I11" class="indent0" id="id3cf0151b-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/b/2/B/i"><num value="i">(i)</num><content> The Secretary also shall consider diameter when defining “regulated gathering line” for hazardous liquid.</content>

<clause style="-uslm-lc:I11" class="indent0" id="id3cf0151c-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s60101/b/2/B/ii"><num value="ii">(ii)</num><content> The definition of “regulated gathering line” for hazardous liquid may not include a crude oil gathering line that has a nominal diameter of not more than 6 inches, is operated at low pressure, and is located in a rural area that is not unusually sensitive to environmental damage.</content>

<p style="-uslm-lc:I21" class="indent0">In this chapter, the words “liquefied natural gas” are substituted for “LNG” for clarity. The word “authority” is substituted for “agency” for consistency in the revised title and with other titles of the United States Code. The words “gas” and “hazardous liquid” are added where applicable because of the restatement.</p>
<p style="-uslm-lc:I21" class="indent0">In subsection (a), before clause (1), the text of 49 App.:1671(10) and 2001(11) is omitted because the complete name of the Secretary of Transportation is used the first time the term appears in a section. The words “As used” are omitted as surplus. In clause (1)(A), the words “Federal Energy Regulatory Commission” and “Commission” are substituted for “Department of Energy” because under 42:7171(a) and 7172(a)(1) the Commission is statutorily independent of the Department and has the responsibility for siting, construction, and operating applications. </paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> distribution of technical resources and training to support current and future Federal mandates; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> evaluation of program outcomes.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Training and Educational Materials</inline>.—</heading><chapeau>The collaborative program established under subsection (a) may include courses in recent developments, techniques, and procedures related to—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> safety and security of pipeline systems;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> incident and risk management for such systems;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> integrity management for such systems;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> consequence modeling for such systems;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> detection of encroachments and monitoring of rights-of-way for such systems; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><content> vulnerability assessment of such systems at both project and national levels.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> Reports.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">University</inline>.—</heading><content>Not later than <date date="2009-03-31">March 31, 2009</date>, the universities awarded grants under subsection (a) shall submit to the Secretary a report on the results of the collaborative program.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Secretary</inline>.—</heading><content>Not later than <date date="2009-10-01">October 1, 2009</date>, the Secretary shall transmit the reports submitted to the Secretary under paragraph (1), along with any findings, recommendations, or legislative options for Congress to consider, to the Committees on Transportation and Infrastructure and Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> Memorandum of Understanding.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Not later than 120 days after the date of enactment of this Act [<date date="2002-12-17">Dec. 17, 2002</date>], the heads of the participating agencies shall enter into a memorandum of understanding detailing their respective responsibilities in the program authorized by subsection (a).</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Areas of expertise</inline>.—</heading><content>Under the memorandum of understanding, each of the participating agencies shall have the primary responsibility for ensuring that the elements of the program within its expertise are implemented in accordance with this section. The Department of Transportation’s responsibilities shall reflect its lead role in pipeline safety and expertise in pipeline inspection, integrity management, and damage prevention. The Department of Energy’s responsibilities shall reflect its expertise in system reliability, low-volume gas leak detection, and surveillance technologies. The National Institute of Standards and Technology’s responsibilities shall reflect its expertise in materials research and assisting in the development of consensus technical standards, as that term is used in section 12(d)(4) [probably should be “12(d)(5)”] of <ref href="/us/pl/104/13">Public Law 104–13</ref> [<ref href="/us/pl/104/113">Pub. L. 104–113</ref>] (<ref href="/us/usc/t15/s272">15 U.S.C. 272</ref> note).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Program Elements</inline>.—</heading><chapeau>The program authorized by subsection (a) shall include research, development, demonstration, and standardization activities related to—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> materials inspection;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> stress and fracture analysis, detection of cracks, abrasion, and other abnormalities inside pipelines that lead to pipeline failure, and development of new equipment or technologies that are inserted into pipelines to detect anomalies;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> internal inspection and leak detection technologies, including detection of leaks at very low volumes;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> methods of analyzing content of pipeline throughput;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> pipeline security, including improving the real-time surveillance of pipeline rights-of-way, developing tools for evaluating and enhancing pipeline security and infrastructure, reducing natural, technological, and terrorist threats, and protecting first response units and persons near an incident;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><content> risk assessment methodology, including vulnerability assessment and reduction of third-party damage;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="7">“(7)</num><content> communication, control, and information systems surety;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="8">“(8)</num><content> fire safety of pipelines;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="9">“(9)</num><content> improved excavation, construction, and repair technologies;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="10">“(10)</num><content> corrosion detection and improving methods, best practices, and technologies for identifying, detecting, preventing, and managing internal and external corrosion and other safety risks; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="11">“(11)</num><content> other appropriate elements.</content>
</paragraph>

<continuation style="-uslm-lc:I33" class="indent0 firstIndent0">The results of activities carried out under paragraph (10) shall be used by the participating agencies to support development and improvement of national consensus standards.</continuation>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> Program Plan.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Not later than 1 year after the date of enactment of this section [<date date="2002-12-17">Dec. 17, 2002</date>], the Secretary of Transportation, in coordination with the Secretary of Energy and the Director of the National Institute of Standards and Technology, shall prepare and transmit to Congress a 5-year program plan to guide activities under this section. Such program plan shall be submitted to the Technical Pipeline Safety Standards Committee and the Technical Hazardous Liquid Pipeline Safety Standards Committee for review, and the report to Congress shall include the comments of the committees. The 5-year program plan shall be based on the memorandum of understanding under subsection (b) and take into account related activities of other Federal agencies.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Consultation</inline>.—</heading><content>In preparing the program plan and selecting and prioritizing appropriate project proposals, the Secretary of Transportation shall consult with or seek the advice of appropriate representatives of the natural gas, crude oil, and petroleum product pipeline industries, utilities, manufacturers, institutions of higher learning, Federal agencies, pipeline research institutions, national laboratories, State pipeline safety officials, labor organizations, environmental organizations, pipeline safety advocates, and professional and technical societies.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> Ongoing pipeline transportation research and development.—</heading><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>After the initial 5-year program plan has been carried out by the participating agencies, the Secretary of Transportation, in coordination with the Director of the National Institute of Standards and Technology, as appropriate, shall prepare a research and development program plan every 5 years thereafter and shall transmit a report to Congress on the status and results-to-date of implementation of the program every 2 years. The biennial report shall include a summary of updated research needs and priorities identified through the consultation requirements of paragraph (2).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><heading> <inline class="small-caps">Consultation</inline>.—</heading><content>The Secretary shall comply with the consultation requirements of paragraph (2) when preparing the program plan and in the selection and prioritization of research and development projects.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><heading> <inline class="small-caps">Funding from non-federal sources</inline>.—</heading><content>The Secretary shall ensure at least 30 percent of the costs of program-wide research and development activities are carried out using non-Federal sources.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Reports to Congress</inline>.—</heading><content>Not later than 1 year after the date of enactment of this Act [<date date="2002-12-17">Dec. 17, 2002</date>], and annually thereafter, the heads of the participating agencies shall transmit jointly to Congress a report on the status and results to date of the implementation of the program plan prepared under subsection (d).</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Pipeline Integrity Program</inline>.—</heading><content>Of the amounts available in the Oil Spill Liability Trust Fund established by section 9509 of the Internal Revenue Code of 1986 (<ref href="/us/usc/t26/s9509">26 U.S.C. 9509</ref>), $3,000,000 shall be transferred to the Secretary of Transportation, as provided in appropriation Acts, to carry out programs for detection, prevention, and mitigation of oil spills for each of the fiscal years 2012 through 2015.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="g">“(g)</num><heading> <inline class="small-caps">Participating Agencies Defined</inline>.—</heading><content>In this section, the term ‘participating agencies’ means the Department of Transportation, the Department of Energy, and the National Institute of Standards and Technology.”</content>
