<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id9101834e-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s6103"><num value="6103">§ 6103.</num><heading> Minimum standards for State one-call notification programs</heading><subsection style="-uslm-lc:I11" class="indent0" id="id9101834f-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s6103/a"><num value="a">(a)</num><heading> Minimum Standards.—</heading><chapeau>In order to qualify for a grant under section 6106, a State one-call notification program shall, at a minimum, provide for—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id91018350-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s6103/a/1"><num value="1">(1)</num><content> appropriate participation by all underground facility operators, including all government operators;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91018351-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s6103/a/2"><num value="2">(2)</num><content> appropriate participation by all excavators, including all government and contract excavators; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91018352-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s6103/a/3"><num value="3">(3)</num><content> flexible and effective enforcement under State law with respect to participation in, and use of, one-call notification systems.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id91018353-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s6103/b"><num value="b">(b)</num><heading> Appropriate Participation.—</heading><chapeau>In determining the appropriate extent of participation required for types of underground facilities or excavators under subsection (a), a State shall assess, rank, and take into consideration the risks to the public safety, the environment, excavators, and vital public services associated with—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id91018354-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s6103/b/1"><num value="1">(1)</num><content> damage to types of underground facilities; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91018355-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s6103/b/2"><num value="2">(2)</num><content> activities of types of excavators.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id91018356-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s6103/c"><num value="c">(c)</num><heading> Implementation.—</heading><chapeau>A State one-call notification program also shall, at a minimum, provide for and document—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id91018357-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s6103/c/1"><num value="1">(1)</num><content> consideration of the ranking of risks under subsection (b) in the enforcement of its provisions;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91018358-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s6103/c/2"><num value="2">(2)</num><content> a reasonable relationship between the benefits of one-call notification and the cost of implementing and complying with the requirements of the State one-call notification program; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91018359-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s6103/c/3"><num value="3">(3)</num><content> voluntary participation where the State determines that a type of underground facility or an activity of a type of excavator poses a de minimis risk to public safety or the environment.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id9101835a-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s6103/d"><num value="d">(d)</num><heading> Penalties.—</heading><chapeau>To the extent the State determines appropriate and necessary to achieve the purposes of this chapter, a State one-call notification program shall, at a minimum, provide for—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id9101835b-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s6103/d/1"><num value="1">(1)</num><content> administrative or civil penalties commensurate with the seriousness of a violation by an excavator or facility owner of a State one-call notification program;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9101835c-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s6103/d/2"><num value="2">(2)</num><content> increased penalties for parties that repeatedly damage underground facilities because they fail to use one-call notification systems or for parties that repeatedly fail to provide timely and accurate marking after the required call has been made to a one-call notification system;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9101835d-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s6103/d/3"><num value="3">(3)</num><content> reduced or waived penalties for a violation of a requirement of a State one-call notification program that results in, or could result in, damage that is promptly reported by the violator;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9101835e-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s6103/d/4"><num value="4">(4)</num><content> equitable relief; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9101835f-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s6103/d/5"><num value="5">(5)</num><content> citation of violations.</content>

<p style="-uslm-lc:I12" class="indent1 fontsize8"><i>(2) </i><inline class="small-caps"/><i>Exemptions prohibited</i>.—<i>In order to qualify for a grant under section 6106, a State one-call notification program may not exempt municipalities, State agencies, or their contractors from the one-call notification system requirements of the program.</i></p>
