<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id34be0fb7-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s6313"><num value="6313">§ 6313.</num><heading> Mandatory response authority for freight data collection</heading><subsection style="-uslm-lc:I11" class="indent0" id="id34be0fb8-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s6313/a"><num value="a">(a)</num><heading> Freight Data Collection.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id34be0fb9-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s6313/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>An owner, official, agent, person in charge, or assistant to the person in charge of a freight corporation, company, business, institution, establishment, or organization described in paragraph (2) shall be fined in accordance with subsection (b) if that individual neglects or refuses, when requested by the Director or other authorized officer, employee, or contractor of the Bureau to submit data under section 6302(b)(3)(B)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34be0fba-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s6313/a/1/A"><num value="A">(A)</num><content> to answer completely and correctly to the best knowledge of that individual all questions relating to the corporation, company, business, institution, establishment, or other organization; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34be0fbb-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s6313/a/1/B"><num value="B">(B)</num><content> to make available records or statistics in the official custody of the individual.</content>

</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34be0fbc-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s6313/a/2"><num value="2">(2)</num><heading> <inline class="small-caps">Description of entities</inline>.—</heading><chapeau>A freight corporation, company, business, institution, establishment, or organization referred to in paragraph (1) is a corporation, company, business, institution, establishment, or organization that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34be0fbd-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s6313/a/2/A"><num value="A">(A)</num><content> receives Federal funds relating to the freight program; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34be0fbe-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s6313/a/2/B"><num value="B">(B)</num><chapeau> has consented to be subject to a fine under this subsection on—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id34be0fbf-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s6313/a/2/B/i"><num value="i">(i)</num><content> refusal to supply any data requested; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id34be0fc0-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s6313/a/2/B/ii"><num value="ii">(ii)</num><content> failure to respond to a written request.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id34be0fc1-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s6313/b"><num value="b">(b)</num><heading> Fines.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id34be0fc2-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s6313/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Subject to paragraph (2), an individual described in subsection (a) shall be fined not more than $500.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34be0fc3-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s6313/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Willful actions</inline>.—</heading><content>If an individual willfully gives a false answer to a question described in subsection (a)(1), the individual shall be fined not more than $10,000.</content>
