<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f500e-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/a/2/B"><num value="B">(B)</num><content> a metropolitan planning organization;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f500f-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/a/2/C"><num value="C">(C)</num><content> a unit of local government;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5010-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/a/2/D"><num value="D">(D)</num><content> a political subdivision of a State;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5011-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/a/2/E"><num value="E">(E)</num><content> a special purpose district or public authority with a transportation function, including a port authority;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5012-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/a/2/F"><num value="F">(F)</num><content> a Tribal government or a consortium of Tribal governments;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5013-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/a/2/G"><num value="G">(G)</num><content> a partnership between Amtrak and 1 or more entities described in subparagraphs (A) through (F); and</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5014-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/a/2/H"><num value="H">(H)</num><content> a group of entities described in any of subparagraphs (A) through (G).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5015-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/a/3"><num value="3">(3)</num><heading> <inline class="small-caps">Program</inline>.—</heading><content>The term “program” means the program established by subsection (b).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5016-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/a/4"><num value="4">(4)</num><heading> <inline class="small-caps">Secretary</inline>.—</heading><content>The term “Secretary”’ means the Secretary of Transportation.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5017-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/a/5"><num value="5">(5)</num><heading> <inline class="small-caps">State</inline>.—</heading><chapeau>The term “State” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5018-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/a/5/A"><num value="A">(A)</num><content> any of the several States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5019-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/a/5/B"><num value="B">(B)</num><content> the District of Columbia;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f501a-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/a/5/C"><num value="C">(C)</num><content> the Commonwealth of Puerto Rico;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f501b-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/a/5/D"><num value="D">(D)</num><content> the Commonwealth of the Northern Mariana Islands;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f501c-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/a/5/E"><num value="E">(E)</num><content> the United States Virgin Islands;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f501d-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/a/5/F"><num value="F">(F)</num><content> Guam;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f501e-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/a/5/G"><num value="G">(G)</num><content> American Samoa; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f501f-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/a/5/H"><num value="H">(H)</num><content> any other territory or possession of the United States.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3d6f5020-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/b"><num value="b">(b)</num><heading> <inline class="small-caps">Establishment</inline>.—</heading><content>There is established a program under which the Secretary shall provide to eligible entities grants, on a competitive basis pursuant to single-year or multiyear grant agreements, for projects described in subsection (d).</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3d6f5021-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/c"><num value="c">(c)</num><heading> <inline class="small-caps">Applications.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5022-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>To be eligible for a grant under the program, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary determines to be appropriate.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5023-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">Plan for data collection</inline>.—</heading><content>An application under paragraph (1) shall include a plan for data collection and analysis described in subsection (g).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3d6f5024-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/d"><num value="d">(d)</num><heading> <inline class="small-caps">Eligible Projects</inline>.—</heading><chapeau>The Secretary may provide a grant under the program only for a project—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5025-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/d/1"><num value="1">(1)</num><chapeau> that is—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5026-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/d/1/A"><num value="A">(A)</num><chapeau> a highway or bridge project carried out on—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3d6f5027-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/d/1/A/i"><num value="i">(i)</num><content> the National Multimodal Freight Network established under section 70103;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f5028-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/d/1/A/ii"><num value="ii">(ii)</num><content> the National Highway Freight Network established under <ref href="/us/usc/t23/s167">section 167 of title 23</ref>; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f5029-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/d/1/A/iii"><num value="iii">(iii)</num><content> the National Highway System (as defined in <ref href="/us/usc/t23/s101/a">section 101(a) of title 23</ref>);</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f502a-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/d/1/B"><num value="B">(B)</num><content> a freight intermodal (including public ports) or freight rail project that provides a public benefit;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f502b-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/d/1/C"><num value="C">(C)</num><content> a railway-highway grade separation or elimination project;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f502c-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/d/1/D"><num value="D">(D)</num><content> an intercity passenger rail project;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f502d-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/d/1/E"><num value="E">(E)</num><chapeau> a public transportation project that is—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3d6f502e-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/d/1/E/i"><num value="i">(i)</num><content> eligible for assistance under chapter 53; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f502f-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/d/1/E/ii"><num value="ii">(ii)</num><content> part of a project described in any of subparagraphs (A) through (D); or</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5030-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/d/1/F"><num value="F">(F)</num><content> a grouping, combination, or program of interrelated, connected, or dependent projects of any of the projects described in subparagraphs (A) through (E); and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5031-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/d/2"><num value="2">(2)</num><chapeau> the eligible project costs of which are—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5032-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/d/2/A"><num value="A">(A)</num><content> reasonably anticipated to equal or exceed $500,000,000; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5033-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/d/2/B"><num value="B">(B)</num><chapeau> for any project funded by the set-aside under subsection (m)(2)—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3d6f5034-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/d/2/B/i"><num value="i">(i)</num><content> more than $100,000,000; but</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f5035-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/d/2/B/ii"><num value="ii">(ii)</num><content> less than $500,000,000.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3d6f5036-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/e"><num value="e">(e)</num><heading> <inline class="small-caps">Geographical Distribution</inline>.—</heading><chapeau>In providing grants under this section, the Secretary shall ensure among grant recipients—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5037-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/e/1"><num value="1">(1)</num><content> geographical diversity; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5038-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/e/2"><num value="2">(2)</num><content> a balance between rural and urban communities.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3d6f5039-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f"><num value="f">(f)</num><heading> <inline class="small-caps">Project Evaluation and Selection.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f503a-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/1"><num value="1">(1)</num><heading> <inline class="small-caps">Requirements</inline>.—</heading><chapeau>The Secretary may select a project described in subsection (d) to receive a grant under the program only if the Secretary determines that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f503b-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/1/A"><num value="A">(A)</num><content> the project is likely to generate national or regional economic, mobility, or safety benefits;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f503c-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/1/B"><num value="B">(B)</num><content> the project is in need of significant Federal funding;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f503d-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/1/C"><num value="C">(C)</num><content> the project will be cost-effective;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f503e-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/1/D"><num value="D">(D)</num><chapeau> with respect to related non-Federal financial commitments, 1 or more stable and dependable sources of funding and financing are available—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3d6f503f-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/1/D/i"><num value="i">(i)</num><content> to construct, operate, and maintain the project; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f5040-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/1/D/ii"><num value="ii">(ii)</num><content> to cover cost increases; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5041-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/1/E"><num value="E">(E)</num><content> the applicant has, or will have, sufficient legal, financial, and technical capacity to carry out the project.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5042-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/2"><num value="2">(2)</num><heading> <inline class="small-caps">Evaluation criteria</inline>.—</heading><chapeau>In awarding a grant under the program, the Secretary shall evaluate—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5043-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/2/A"><num value="A">(A)</num><content> the extent to which a project supports achieving a state of good repair for each existing asset to be improved by the project;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5044-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/2/B"><num value="B">(B)</num><chapeau> the level of benefits a project is expected to generate, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3d6f5045-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/2/B/i"><num value="i">(i)</num><content> the costs avoided by the prevention of closure or reduced use of the asset to be improved by the project;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f5046-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/2/B/ii"><num value="ii">(ii)</num><content> reductions in maintenance costs over the life of the applicable asset;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f5047-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/2/B/iii"><num value="iii">(iii)</num><content> safety benefits, including the reduction of serious injuries and fatalities and related costs;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f5048-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/2/B/iv"><num value="iv">(iv)</num><content> improved person or freight throughput, including improved mobility and reliability; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f5049-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/2/B/v"><num value="v">(v)</num><chapeau> environmental benefits and health impacts, such as—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id3d6f504a-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/2/B/v/I"><num value="I">(I)</num><content> reductions in greenhouse gas emissions;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id3d6f504b-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/2/B/v/II"><num value="II">(II)</num><content> air quality benefits;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id3d6f504c-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/2/B/v/III"><num value="III">(III)</num><content> preventing stormwater runoff that would be a detriment to aquatic species; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id3d6f504d-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/2/B/v/IV"><num value="IV">(IV)</num><content> improved infrastructure resilience;</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f504e-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/2/C"><num value="C">(C)</num><content> the benefits of the project, as compared to the costs of the project;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f504f-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/2/D"><num value="D">(D)</num><content> the number of persons or volume of freight, as applicable, supported by the project; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5050-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/2/E"><num value="E">(E)</num><content> national and regional economic benefits of the project, including with respect to short- and long-term job access, growth, or creation.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5051-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/3"><num value="3">(3)</num><heading> <inline class="small-caps">Additional considerations</inline>.—</heading><chapeau>In selecting projects to receive grants under the program, the Secretary shall take into consideration—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5052-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/3/A"><num value="A">(A)</num><content> contributions to geographical diversity among grant recipients, including a balance between the needs of rural and urban communities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5053-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/3/B"><num value="B">(B)</num><content> whether multiple States would benefit from a project;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5054-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/3/C"><num value="C">(C)</num><chapeau> whether, and the degree to which, a project uses—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3d6f5055-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/3/C/i"><num value="i">(i)</num><chapeau> construction materials or approaches that have—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id3d6f5056-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/3/C/i/I"><num value="I">(I)</num><content> demonstrated reductions in greenhouse gas emissions; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id3d6f5057-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/3/C/i/II"><num value="II">(II)</num><content> reduced the need for maintenance of other projects; or</content>
</subclause>

</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f505b-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/3/D/ii"><num value="ii">(ii)</num><content> an area of persistent poverty;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f505c-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/3/E"><num value="E">(E)</num><chapeau> whether a project benefits users of multiple modes of transportation, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3d6f505d-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/3/E/i"><num value="i">(i)</num><content> pedestrians;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f505e-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/3/E/ii"><num value="ii">(ii)</num><content> bicyclists; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f505f-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/3/E/iii"><num value="iii">(iii)</num><content> users of nonvehicular rail and public transportation, including intercity and commuter rail; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5060-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/3/F"><num value="F">(F)</num><content> whether a project improves connectivity between modes of transportation moving persons or goods nationally or regionally.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5061-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/4"><num value="4">(4)</num><heading> <inline class="small-caps">Ratings.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5062-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/4/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>In evaluating applications for a grant under the program, the Secretary shall assign the project proposed in the application a rating described in subparagraph (B), based on the information contained in the applicable notice published under paragraph (5).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5063-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/4/B"><num value="B">(B)</num><heading> <inline class="small-caps">Ratings.—</inline></heading><clause style="-uslm-lc:I14" class="indent3" id="id3d6f5064-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/4/B/i"><num value="i">(i)</num><heading> <inline class="small-caps">Highly recommended</inline>.—</heading><chapeau>The Secretary shall assign a rating of “highly recommended” to projects that, in the determination of the Secretary—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id3d6f5065-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/4/B/i/I"><num value="I">(I)</num><content> are exemplary projects of national or regional significance; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id3d6f5066-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/4/B/i/II"><num value="II">(II)</num><content> would provide significant public benefit, as determined based on the applicable criteria described in this subsection, if funded under the program.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f5067-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/4/B/ii"><num value="ii">(ii)</num><heading> <inline class="small-caps">Recommended</inline>.—</heading><chapeau>The Secretary shall assign a rating of “recommended” to projects that, in the determination of the Secretary—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id3d6f5068-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/4/B/ii/I"><num value="I">(I)</num><content> are of national or regional significance; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id3d6f5069-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/4/B/ii/II"><num value="II">(II)</num><content> would provide public benefit, as determined based on the applicable criteria described in this subsection, if funded under the program.</content>

<clause style="-uslm-lc:I14" class="indent3" id="id3d6f506a-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/4/B/iii"><num value="iii">(iii)</num><heading> <inline class="small-caps">Not recommended</inline>.—</heading><content>The Secretary shall assign a rating of “not recommended” to projects that, in the determination of the Secretary, should not receive a grant under the program, based on the applicable criteria described in this subsection.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f506b-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/4/C"><num value="C">(C)</num><heading> <inline class="small-caps">Technical assistance.—</inline></heading><clause style="-uslm-lc:I14" class="indent3" id="id3d6f506c-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/4/C/i"><num value="i">(i)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>On request of an eligible entity that submitted an application under subsection (c) for a project that is not selected to receive a grant under the program, the Secretary shall provide to the eligible entity technical assistance and briefings relating to the project.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f506d-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/4/C/ii"><num value="ii">(ii)</num><heading> <inline class="small-caps">Treatment</inline>.—</heading><content>Technical assistance provided under this subparagraph shall not be considered a guarantee of future selection of the applicable project under the program.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f506e-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/5"><num value="5">(5)</num><heading> <inline class="small-caps">Publication of project evaluation and selection criteria</inline>.—</heading><chapeau>Not later than 90 days after the date of enactment of this chapter, the Secretary shall publish and make publicly available on the website of the Department a notice that contains a detailed explanation of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f506f-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/5/A"><num value="A">(A)</num><content> the method by which the Secretary will determine whether a project satisfies the applicable requirements described in paragraph (1);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5070-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/5/B"><num value="B">(B)</num><content> any additional ratings the Secretary may assign to determine the means by which a project addresses the selection criteria and additional considerations described in paragraphs (2) and (3); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5071-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/5/C"><num value="C">(C)</num><content> the means by which the project requirements and ratings referred to in subparagraphs (A) and (B) will be used to assign an overall rating for the project under paragraph (4).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5072-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/f/6"><num value="6">(6)</num><heading> <inline class="small-caps">Project selection priority</inline>.—</heading><content>In awarding grants under the program, the Secretary shall give priority to projects to which the Secretary has assigned a rating of “highly recommended” under paragraph (4)(B)(i).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3d6f5073-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g"><num value="g">(g)</num><heading> <inline class="small-caps">Data Collection and Analysis.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5074-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/1"><num value="1">(1)</num><heading> <inline class="small-caps">Plan.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5075-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/1/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>An eligible entity seeking a grant under the program shall submit to the Secretary, together with the grant application, a plan for the collection and analysis of data to identify in accordance with the framework established under paragraph (2)—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3d6f5076-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/1/A/i"><num value="i">(i)</num><content> the impacts of the project; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f5077-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/1/A/ii"><num value="ii">(ii)</num><content> the accuracy of any forecast prepared during the development phase of the project and included in the grant application.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5078-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/1/B"><num value="B">(B)</num><heading> <inline class="small-caps">Contents</inline>.—</heading><chapeau>A plan under subparagraph (A) shall include—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3d6f5079-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/1/B/i"><num value="i">(i)</num><chapeau> an approach to measuring—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id3d6f507a-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/1/B/i/I"><num value="I">(I)</num><content> the criteria described in subsection (f)(2); and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id3d6f507b-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/1/B/i/II"><num value="II">(II)</num><content> if applicable, the additional requirements described in subsection (f)(3);</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f507c-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/1/B/ii"><num value="ii">(ii)</num><content> an approach for analyzing the consistency of predicted project characteristics with actual outcomes; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f507d-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/1/B/iii"><num value="iii">(iii)</num><content> any other elements that the Secretary determines to be necessary.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f507e-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/2"><num value="2">(2)</num><heading> <inline class="small-caps">Framework</inline>.—</heading><chapeau>The Secretary may publish a standardized framework for the contents of the plans under paragraph (1), which may include, as appropriate—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f507f-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/2/A"><num value="A">(A)</num><content> standardized forecasting and measurement approaches;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5080-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/2/B"><num value="B">(B)</num><content> data storage system requirements; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5081-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/2/C"><num value="C">(C)</num><content> any other requirements the Secretary determines to be necessary to carry out this section.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5082-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/3"><num value="3">(3)</num><heading> <inline class="small-caps">Multiyear grant agreements</inline>.—</heading><content>The Secretary shall require an eligible entity, as a condition of receiving funding pursuant to a multiyear grant agreement under the program, to collect additional data to measure the impacts of the project and to accurately track improvements made by the project, in accordance with a plan described in paragraph (1).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5083-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/4"><num value="4">(4)</num><heading> <inline class="small-caps">Reports.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5084-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/4/A"><num value="A">(A)</num><heading> <inline class="small-caps">Project baseline</inline>.—</heading><content>Before the date of completion of a project for which a grant is provided under the program, the eligible entity carrying out the project shall submit to the Secretary a report providing baseline data for the purpose of analyzing the long-term impact of the project in accordance with the framework established under paragraph (2).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5085-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/4/B"><num value="B">(B)</num><heading> <inline class="small-caps">Updated report</inline>.—</heading><chapeau>Not later than 6 years after the date of completion of a project for which a grant is provided under the program, the eligible entity carrying out the project shall submit to the Secretary a report that compares the baseline data included in the report under subparagraph (A) to project data collected during the period—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3d6f5086-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/4/B/i"><num value="i">(i)</num><content> beginning on the date that is 5 years after the date of completion of the project; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f5087-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/g/4/B/ii"><num value="ii">(ii)</num><content> ending on the date on which the updated report is submitted.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3d6f5088-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/h"><num value="h">(h)</num><heading> <inline class="small-caps">Eligible Project Costs.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5089-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/h/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>An eligible entity may use a grant provided under the program for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f508a-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/h/1/A"><num value="A">(A)</num><content> development-phase activities and costs, including planning, feasibility analysis, revenue forecasting, alternatives analysis, data collection and analysis, environmental review and activities to support environmental review, preliminary engineering and design work, and other preconstruction activities, including the preparation of a data collection and post-construction analysis plan under subsection (g); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f508b-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/h/1/B"><num value="B">(B)</num><content> construction, reconstruction, rehabilitation, acquisition of real property (including land relating to the project and improvements to that land), environmental mitigation (including projects to replace or rehabilitate culverts or reduce stormwater runoff for the purpose of improving habitat for aquatic species), construction contingencies, acquisition of equipment, protection, and operational improvements directly relating to the project.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f508c-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/h/2"><num value="2">(2)</num><heading> <inline class="small-caps">Interest and other financing costs</inline>.—</heading><content>The interest and other financing costs of carrying out any part of a project under a multiyear grant agreement within a reasonable period of time shall be considered to be an eligible project cost only if the applicable eligible entity certifies to the Secretary that the eligible entity has demonstrated reasonable diligence in seeking the most favorable financing terms.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3d6f508d-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/i"><num value="i">(i)</num><heading> <inline class="small-caps">Cost Sharing.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f508e-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/i/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The total amount awarded for a project under the program may not exceed 60 percent of the total eligible project costs described in subsection (h).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f508f-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/i/2"><num value="2">(2)</num><heading> <inline class="small-caps">Maximum federal involvement.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5090-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/i/2/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Subject to subparagraph (B), Federal assistance other than a grant awarded under the program may be provided for a project for which a grant is awarded under the program.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5091-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/i/2/B"><num value="B">(B)</num><heading> <inline class="small-caps">Limitation</inline>.—</heading><content>The total amount of Federal assistance provided for a project for which a grant is awarded under the program shall not exceed 80 percent of the total cost of the project.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5092-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/i/2/C"><num value="C">(C)</num><heading> <inline class="small-caps">Non-federal share</inline>.—</heading><content>Secured loans or financing provided under <ref href="/us/usc/t23/s603">section 603 of title 23</ref> or <ref href="/us/usc/t49/s22402">section 22402 of this title</ref> and repaid with local funds or revenues shall be considered to be part of the local share of the cost of a project.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5093-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/i/3"><num value="3">(3)</num><heading> <inline class="small-caps">Application to multiyear agreements</inline>.—</heading><content>Notwithstanding any other provision of this title, in any case in which amounts are provided under the program pursuant to a multiyear agreement, the disbursed Federal share of the cost of the project may exceed the limitations described in paragraphs (1) and (2)(B) for 1 or more years if the total amount of the Federal share of the cost of the project, once completed, does not exceed those limitations.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3d6f5094-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/j"><num value="j">(j)</num><heading> <inline class="small-caps">Grant Agreements.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5095-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/j/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>A project for which an eligible entity receives a multiyear grant under the program shall be carried out in accordance with this subsection.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f5096-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/j/2"><num value="2">(2)</num><heading> <inline class="small-caps">Terms</inline>.—</heading><chapeau>A multiyear grant agreement under this subsection shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5097-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/j/2/A"><num value="A">(A)</num><content> establish the terms of Federal participation in the applicable project;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5098-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/j/2/B"><num value="B">(B)</num><content> establish the maximum amount of Federal financial assistance for the project;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f5099-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/j/2/C"><num value="C">(C)</num><content> establish a schedule of anticipated Federal obligations for the project that provides for obligation of the full grant amount;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f509a-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/j/2/D"><num value="D">(D)</num><content> describe the period of time for completing the project, regardless of whether that period extends beyond the period of an authorization; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f509b-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/j/2/E"><num value="E">(E)</num><content> facilitate timely and efficient management of the applicable project by the eligible entity carrying out the project, in accordance with applicable law.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f509c-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/j/3"><num value="3">(3)</num><heading> <inline class="small-caps">Special rules.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f509d-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/j/3/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>A multiyear grant agreement under this subsection—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3d6f509e-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/j/3/A/i"><num value="i">(i)</num><content> shall provide for the obligation of an amount of available budget authority specified in law;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f509f-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/j/3/A/ii"><num value="ii">(ii)</num><content> may include a commitment, contingent on amounts to be specified in law in advance for commitments under this paragraph, to obligate an additional amount from future available budget authority specified in law; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f50a0-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/j/3/A/iii"><num value="iii">(iii)</num><content> shall provide that any funds disbursed under the program for the project before the completion of any review required under the National Environmental Policy Act of 1969 (<ref href="/us/usc/t42/s4321">42 U.S.C. 4321</ref> et seq.) may only cover costs associated with development-phase activities described in subsection (h)(1)(A).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50a1-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/j/3/B"><num value="B">(B)</num><heading> <inline class="small-caps">Contingent commitment</inline>.—</heading><content>A contingent commitment under this paragraph is not an obligation of the Federal Government, including for purposes of <ref href="/us/usc/t31/s1501">section 1501 of title 31</ref>.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f50a2-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/j/4"><num value="4">(4)</num><heading> <inline class="small-caps">Single-year grants</inline>.—</heading><content>The Secretary may only provide to an eligible entity a full grant under the program in a single year if all reviews required under the National Environmental Policy Act of 1969 (<ref href="/us/usc/t42/s4321">42 U.S.C. 4321</ref> et seq.) with respect to the applicable project have been completed before the receipt of any program funds.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3d6f50a3-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/k"><num value="k">(k)</num><heading> <inline class="small-caps">Congressional Notification.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f50a4-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/k/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Not later than 30 days before the date on which the Secretary publishes the selection of projects to receive grants under the program, the Secretary shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a written notice that includes—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50a5-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/k/1/A"><num value="A">(A)</num><content> a list of all project applications reviewed by the Secretary as part of the selection process;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50a6-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/k/1/B"><num value="B">(B)</num><content> the rating assigned to each project under subsection (f)(4);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50a7-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/k/1/C"><num value="C">(C)</num><chapeau> an evaluation and justification with respect to each project for which the Secretary will—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3d6f50a8-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/k/1/C/i"><num value="i">(i)</num><content> provide a grant under the program; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f50a9-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/k/1/C/ii"><num value="ii">(ii)</num><content> enter into a multiyear grant agreement under the program;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50aa-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/k/1/D"><num value="D">(D)</num><content> a description of the means by which the Secretary anticipates allocating among selected projects the amounts made available to the Secretary to carry out the program; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50ab-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/k/1/E"><num value="E">(E)</num><content> anticipated funding levels required for the 3 fiscal years beginning after the date of submission of the notice for projects selected for grants under the program, based on information available to the Secretary as of that date.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f50ac-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/k/2"><num value="2">(2)</num><heading> <inline class="small-caps">Congressional disapproval</inline>.—</heading><content>The Secretary may not provide a grant or any other obligation or commitment to fund a project under the program if a joint resolution is enacted disapproving funding for the project before the last day of the 30-day period described in paragraph (1).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3d6f50ad-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/l"><num value="l">(l)</num><heading> <inline class="small-caps">Reports.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f50ae-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/l/1"><num value="1">(1)</num><heading> <inline class="small-caps">Transparency</inline>.—</heading><chapeau>Not later than 60 days after the date on which the grants are announced under the program, the Secretary shall publish on the website of the Department a report that includes—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50af-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/l/1/A"><num value="A">(A)</num><content> a list of all project applications reviewed by the Secretary as part of the selection process under the program;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50b0-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/l/1/B"><num value="B">(B)</num><content> the rating assigned to each project under subsection (f)(4); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50b1-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/l/1/C"><num value="C">(C)</num><content> a description of each project for which a grant has been provided under the program.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f50b2-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/l/2"><num value="2">(2)</num><heading> <inline class="small-caps">Comptroller general.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50b3-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/l/2/A"><num value="A">(A)</num><heading> <inline class="small-caps">Assessment</inline>.—</heading><content>The Comptroller General of the United States shall conduct an assessment of the administrative establishment, solicitation, selection, and justification process with respect to the funding of grants under the program.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50b4-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/l/2/B"><num value="B">(B)</num><heading> <inline class="small-caps">Report</inline>.—</heading><chapeau>Not later than 18 months after the date on which the initial grants are awarded for projects under the program, the Comptroller General shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that describes, as applicable—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3d6f50b5-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/l/2/B/i"><num value="i">(i)</num><content> the adequacy and fairness of the process by which the projects were selected; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f50b6-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/l/2/B/ii"><num value="ii">(ii)</num><content> the justification and criteria used for the selection of the projects.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3d6f50b7-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/m"><num value="m">(m)</num><heading> <inline class="small-caps">Authorization of Appropriations.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f50b8-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/m/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>There is authorized to be appropriated to the Secretary to carry out the program $2,000,000,000 for each of fiscal years 2022 through 2026.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f50b9-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/m/2"><num value="2">(2)</num><heading> <inline class="small-caps">Other projects</inline>.—</heading><chapeau>Of the amounts made available under paragraph (1), 50 percent shall be set aside for projects that have a project cost of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50ba-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/m/2/A"><num value="A">(A)</num><content> more than $100,000,000; but</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50bb-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/m/2/B"><num value="B">(B)</num><content> less than $500,000,000.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f50bc-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/m/3"><num value="3">(3)</num><heading> <inline class="small-caps">Administrative expenses</inline>.—</heading><chapeau>Of the amounts made available to carry out the program for each fiscal year, the Secretary may reserve not more than 2 percent for the costs of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50bd-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/m/3/A"><num value="A">(A)</num><content> administering and overseeing the program; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50be-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/m/3/B"><num value="B">(B)</num><content> hiring personnel for the program, including personnel dedicated to processing permitting and environmental review issues.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f50bf-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/m/4"><num value="4">(4)</num><heading> <inline class="small-caps">Transfer of authority</inline>.—</heading><content>The Secretary may transfer any portion of the amounts reserved under paragraph (3) for a fiscal year to the Administrator of any of the Federal Highway Administration, the Federal Transit Administration, the Federal Railroad Administration, or the Maritime Administration to award and oversee grants in accordance with this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3d6f50c0-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/n"><num value="n">(n)</num><heading> <inline class="small-caps">Additional Requirements.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f50c1-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/n/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Each project that receives a grant under this chapter shall achieve compliance with the applicable requirements of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50c2-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/n/1/A"><num value="A">(A)</num><content> subchapter IV of chapter 31 of title 40;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50c3-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/n/1/B"><num value="B">(B)</num><content> title VI of the Civil Rights Act of 1964 (<ref href="/us/usc/t42/s2000d">42 U.S.C. 2000d</ref> et seq.); and</content>
</subparagraph>

</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f50c5-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/n/2"><num value="2">(2)</num><heading> <inline class="small-caps">Modal requirements</inline>.—</heading><chapeau>The Secretary shall, with respect to a project funded by a grant under this section, apply—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50c6-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/n/2/A"><num value="A">(A)</num><content> the requirements of title 23 to a highway, road, or bridge project;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50c7-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/n/2/B"><num value="B">(B)</num><content> the requirements of chapter 53 to a transit project; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50c8-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/n/2/C"><num value="C">(C)</num><content> the requirements of section 22905 to a rail project.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3d6f50c9-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/n/3"><num value="3">(3)</num><heading> <inline class="small-caps">Multimodal projects.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50ca-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/n/3/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Except as otherwise provided in this paragraph, if an eligible project is a multimodal project, the Secretary shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3d6f50cb-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/n/3/A/i"><num value="i">(i)</num><content> determine the predominant modal component of the project; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3d6f50cc-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/n/3/A/ii"><num value="ii">(ii)</num><content> apply the applicable requirements described in paragraph (2) of the predominant modal component to the project.</content>

</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3d6f50cd-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/n/3/B"><num value="B">(B)</num><heading> <inline class="small-caps">Exceptions.—</inline></heading><clause style="-uslm-lc:I14" class="indent3" id="id3d6f50ce-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/n/3/B/i"><num value="i">(i)</num><heading> <inline class="small-caps">Passenger or freight rail component</inline>.—</heading><content>The requirements of section 22905 shall apply to any passenger or freight rail component of a project.</content>

<clause style="-uslm-lc:I14" class="indent3" id="id3d6f50cf-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s6701/n/3/B/ii"><num value="ii">(ii)</num><heading> <inline class="small-caps">Public transportation component</inline>.—</heading><content>The requirements of section 5333 shall apply to any public transportation component of a project.</content>
