<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id1135b809-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s1502"><num value="1502">§ 1502.</num><heading> Influencing elections; taking part in political campaigns; prohibitions; exceptions</heading><subsection style="-uslm-lc:I11" class="indent0" id="id1135b80a-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s1502/a"><num value="a">(a)</num><chapeau> A State or local officer or employee may not—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id1135b80b-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s1502/a/1"><num value="1">(1)</num><content> use his official authority or influence for the purpose of interfering with or affecting the result of an election or a nomination for office;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1135b80c-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s1502/a/2"><num value="2">(2)</num><content> directly or indirectly coerce, attempt to coerce, command, or advise a State or local officer or employee to pay, lend, or contribute anything of value to a party, committee, organization, agency, or person for political purposes; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1135b80d-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s1502/a/3"><num value="3">(3)</num><content> if the salary of the employee is paid completely, directly or indirectly, by loans or grants made by the United States or a Federal agency, be a candidate for elective office.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id1135b80e-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s1502/b"><num value="b">(b)</num><content> A State or local officer or employee retains the right to vote as he chooses and to express his opinions on political subjects and candidates.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id1135df1f-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s1502/c"><num value="c">(c)</num><chapeau> Subsection (a)(3) of this section does not apply to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id1135df20-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s1502/c/1"><num value="1">(1)</num><content> the Governor or Lieutenant Governor of a State or an individual authorized by law to act as Governor;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1135df21-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s1502/c/2"><num value="2">(2)</num><content> the mayor of a city;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1135df22-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s1502/c/3"><num value="3">(3)</num><content> a duly elected head of an executive department of a State, municipality, or the District of Columbia who is not classified under a State, municipal, or the District of Columbia merit or civil-service system; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1135df23-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s1502/c/4"><num value="4">(4)</num><content> an individual holding elective office.</content>
