<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id4fe540ac-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s2104"><num value="2104">§ 2104.</num><heading> Officer</heading><subsection style="-uslm-lc:I11" class="indent0" id="id4fe540ad-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s2104/a"><num value="a">(a)</num><chapeau> For the purpose of this title, “officer”, except as otherwise provided by this section or when specifically modified, means a justice or judge of the United States and an individual who is—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id4fe540ae-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s2104/a/1"><num value="1">(1)</num><chapeau> required by law to be appointed in the civil service by one of the following acting in an official capacity—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id4fe540af-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s2104/a/1/A"><num value="A">(A)</num><content> the President;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4fe540b0-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s2104/a/1/B"><num value="B">(B)</num><content> a court of the United States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4fe540b1-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s2104/a/1/C"><num value="C">(C)</num><content> the head of an Executive agency; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4fe540b2-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s2104/a/1/D"><num value="D">(D)</num><content> the Secretary of a military department;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4fe540b3-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s2104/a/2"><num value="2">(2)</num><content> engaged in the performance of a Federal function under authority of law or an Executive act; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4fe540b4-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s2104/a/3"><num value="3">(3)</num><content> subject to the supervision of an authority named by paragraph (1) of this section, or the Judicial Conference of the United States, while engaged in the performance of the duties of his office.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id4fe540b5-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s2104/b"><num value="b">(b)</num><content> Except as otherwise provided by law, an officer of the United States Postal Service or of the Postal Regulatory Commission is deemed not an officer for purposes of this title.</content>
