<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id1098dc37-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306"><num value="306">§ 306.</num><heading> Agency strategic plans</heading><subsection style="-uslm-lc:I11" class="indent0" id="id1098dc38-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/a"><num value="a">(a)</num><chapeau> Not later than the first Monday in February of any year following the year in which the term of the President commences under <ref href="/us/usc/t3/s101">section 101 of title 3</ref>, the head of each agency shall make available on the public website of the agency a strategic plan and notify the President and Congress of its availability. Such plan shall contain—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id1098dc39-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/a/1"><num value="1">(1)</num><content> a comprehensive mission statement covering the major functions and operations of the agency;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1099034a-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/a/2"><num value="2">(2)</num><content> general goals and objectives, including outcome-oriented goals, for the major functions and operations of the agency;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1099034b-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/a/3"><num value="3">(3)</num><content> a description of how any goals and objectives contribute to the Federal Government priority goals required by <ref href="/us/usc/t31/s1120/a">section 1120(a) of title 31</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1099034c-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/a/4"><num value="4">(4)</num><chapeau> a description of how the goals and objectives are to be achieved, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id1099034d-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/a/4/A"><num value="A">(A)</num><content> a description of the operational processes, skills and technology, and the human, capital, information, and other resources required to achieve those goals and objectives; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1099034e-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/a/4/B"><num value="B">(B)</num><content> a description of how the agency is working with other agencies to achieve its goals and objectives as well as relevant Federal Government priority goals;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1099034f-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/a/5"><num value="5">(5)</num><content> a description of how the goals and objectives incorporate views and suggestions obtained through congressional consultations required under subsection (d);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10992a60-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/a/6"><num value="6">(6)</num><content> a description of how the performance goals provided in the plan required by <ref href="/us/usc/t31/s1115/a">section 1115(a) of title 31</ref>, including the agency priority goals required by <ref href="/us/usc/t31/s1120/b">section 1120(b) of title 31</ref>, if applicable, contribute to the general goals and objectives in the strategic plan;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10992a61-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/a/7"><num value="7">(7)</num><content> an identification of those key factors external to the agency and beyond its control that could significantly affect the achievement of the general goals and objectives;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10992a62-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/a/8"><num value="8">(8)</num><content> a description of the program evaluations used in establishing or revising general goals and objectives, with a schedule for future program evaluations to be conducted, and citations to relevant provisions of the plans required under section 312; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10992a63-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/a/9"><num value="9">(9)</num><chapeau> an assessment of the coverage, quality, methods, effectiveness, and independence of the statistics, evaluation, research, and analysis efforts of the agency, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id10992a64-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/a/9/A"><num value="A">(A)</num><content> a list of the activities and operations of the agency that are currently being evaluated and analyzed;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10995175-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/a/9/B"><num value="B">(B)</num><content> the extent to which the evaluations, research, and analysis efforts and related activities of the agency support the needs of various divisions within the agency;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10995176-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/a/9/C"><num value="C">(C)</num><content> the extent to which the evaluation research and analysis efforts and related activities of the agency address an appropriate balance between needs related to organizational learning, ongoing program management, performance management, strategic management, interagency and private sector coordination, internal and external oversight, and accountability;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10995177-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/a/9/D"><num value="D">(D)</num><content> the extent to which the agency uses methods and combinations of methods that are appropriate to agency divisions and the corresponding research questions being addressed, including an appropriate combination of formative and summative evaluation research and analysis approaches;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10995178-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/a/9/E"><num value="E">(E)</num><content> the extent to which evaluation and research capacity is present within the agency to include personnel and agency processes for planning and implementing evaluation activities, disseminating best practices and findings, and incorporating employee views and feedback; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10997889-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/a/9/F"><num value="F">(F)</num><content> the extent to which the agency has the capacity to assist agency staff and program offices to develop the capacity to use evaluation research and analysis approaches and data in the day-to-day operations.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id1099788a-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/b"><num value="b">(b)</num><content> The strategic plan shall cover a period of not less than 4 years following the fiscal year in which the plan is submitted. As needed, the head of the agency may make adjustments to the strategic plan to reflect significant changes in the environment in which the agency is operating, with appropriate notification of Congress.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id1099788b-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/c"><num value="c">(c)</num><content> The performance plan required by <ref href="/us/usc/t31/s1115/b">section 1115(b) of title 31</ref> shall be consistent with the agency’s strategic plan. A performance plan may not be submitted for a fiscal year not covered by a current strategic plan under this section.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10999f9c-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/d"><num value="d">(d)</num><content> When developing or making adjustments to a strategic plan, the agency shall consult periodically with the Congress, including majority and minority views from the appropriate authorizing, appropriations, and oversight committees, and shall solicit and consider the views and suggestions of those entities potentially affected by or interested in such a plan. The agency shall consult with the appropriate committees of Congress at least once every 2 years.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10999f9d-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/e"><num value="e">(e)</num><content> The functions and activities of this section shall be considered to be inherently governmental functions. The drafting of strategic plans under this section shall be performed only by Federal employees.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id10999f9e-81bc-11eb-8b8f-cf900944cd12" identifier="/us/usc/t5/s306/f"><num value="f">(f)</num><content> For purposes of this section the term “agency” means an Executive agency defined under section 105, but does not include the Central Intelligence Agency, the Government Accountability Office, the United States Postal Service, and the Postal Regulatory Commission.</content>
