<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id60bf3586-9c7c-11e6-ad05-d8125160c21f" identifier="/us/usc/t5/s3371"><num value="3371">§ 3371.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">For the purpose of this subchapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id60bf3587-9c7c-11e6-ad05-d8125160c21f" identifier="/us/usc/t5/s3371/1"><num value="1">(1)</num><chapeau> “State” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id60bf3588-9c7c-11e6-ad05-d8125160c21f" identifier="/us/usc/t5/s3371/1/A"><num value="A">(A)</num><content> a State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the Trust Territory of the Pacific Islands, and a territory or possession of the United States; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id60bf3589-9c7c-11e6-ad05-d8125160c21f" identifier="/us/usc/t5/s3371/1/B"><num value="B">(B)</num><content> an instrumentality or authority of a State or States as defined in subparagraph (A) of this paragraph (1) and a Federal-State authority or instrumentality;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id60bf358a-9c7c-11e6-ad05-d8125160c21f" identifier="/us/usc/t5/s3371/2"><num value="2">(2)</num><chapeau> “local government” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id60bf358b-9c7c-11e6-ad05-d8125160c21f" identifier="/us/usc/t5/s3371/2/A"><num value="A">(A)</num><content> any political subdivision, instrumentality, or authority of a State or States as defined in subparagraph (A) of paragraph (1);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id60bf358c-9c7c-11e6-ad05-d8125160c21f" identifier="/us/usc/t5/s3371/2/B"><num value="B">(B)</num><content> any general or special purpose agency of such a political subdivision, instrumentality, or authority; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id60bf358d-9c7c-11e6-ad05-d8125160c21f" identifier="/us/usc/t5/s3371/2/C"><num value="C">(C)</num><content> any Indian tribe, band, nation, or other organized group or community, including any Alaska Native village as defined in the Alaska Native Claims Settlement Act (<ref href="/us/stat/85/688">85 Stat. 688</ref>), which is recognized as eligible for the special programs and services provided by the United States to Indians because of their status as Indians and includes any tribal organization as defined in section 4 of the Indian Self-Determination and Education Assistance Act;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id60bf358e-9c7c-11e6-ad05-d8125160c21f" identifier="/us/usc/t5/s3371/3"><num value="3">(3)</num><content> “Federal agency” means an Executive agency, military department, a court of the United States, the Administrative Office of the United States Courts, the Library of Congress, the Botanic Garden, the Government Publishing Office, the Congressional Budget Office, the United States Postal Service, the Postal Regulatory Commission, the Office of the Architect of the Capitol, the Office of Technology Assessment, and such other similar agencies of the legislative and judicial branches as determined appropriate by the Office of Personnel Management; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id60bf358f-9c7c-11e6-ad05-d8125160c21f" identifier="/us/usc/t5/s3371/4"><num value="4">(4)</num><chapeau> “other organization” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id60bf3590-9c7c-11e6-ad05-d8125160c21f" identifier="/us/usc/t5/s3371/4/A"><num value="A">(A)</num><content> a national, regional, State-wide, area-wide, or metropolitan organization representing member State or local governments;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id60bf3591-9c7c-11e6-ad05-d8125160c21f" identifier="/us/usc/t5/s3371/4/B"><num value="B">(B)</num><content> an association of State or local public officials;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id60bf3592-9c7c-11e6-ad05-d8125160c21f" identifier="/us/usc/t5/s3371/4/C"><num value="C">(C)</num><content> a nonprofit organization which has as one of its principal functions the offering of professional advisory, research, educational, or development services, or related services, to governments or universities concerned with public management; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id60bf3593-9c7c-11e6-ad05-d8125160c21f" identifier="/us/usc/t5/s3371/4/D"><num value="D">(D)</num><content> a federally funded research and development center.</content>

</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Establishment</inline>.—</heading><content>The President shall establish an employee exchange program between Federal agencies that perform law enforcement functions and agencies of State and local governments that perform law enforcement functions.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Conduct of Program</inline>.—</heading><content>The Program shall be conducted in accordance with subchapter VI of chapter 33 of title 5, United States Code.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Qualifications</inline>.—</heading><chapeau>An employee of an employing agency who performs law enforcement functions may be selected to participate in the Program if the employee—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> has been employed by that employing agency for a period of more than 3 years;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> has had appropriate training or experience to perform the work required by the assignment;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> has had an overall rating of satisfactory or higher on performance appraisals from the employing agency during the 3-year period before being assigned to another agency under this section; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> agrees to return to the employing agency after completing the assignment for a period not less than the length of the assignment.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Written Agreement</inline>.—</heading><content>An employee shall enter into a written agreement regarding the terms and conditions of the assignment before beginning the assignment with another agency.”</content>
