L. 102–83, § 5(c)(2), Aug. 6, 1991, 105 Stat. 406.)","seq_in_title":278,"parent_identifier":"/us/usc/t5/ptIII/sptB/ch35/schI","ancestors":[{"identifier":"/us/usc/t5","level":"title","num":"Title 5—","heading":"GOVERNMENT ORGANIZATION AND EMPLOYEES","status":null,"is_section":false},{"identifier":"/us/usc/t5/ptIII","level":"part","num":"PART III—","heading":"EMPLOYEES","status":null,"is_section":false},{"identifier":"/us/usc/t5/ptIII/sptB","level":"subpart","num":"Subpart B—","heading":"Employment and Retention","status":null,"is_section":false},{"identifier":"/us/usc/t5/ptIII/sptB/ch35","level":"chapter","num":"CHAPTER 35—","heading":"RETENTION PREFERENCE, VOLUNTARY SEPARATION INCENTIVE PAYMENTS, RESTORATION, AND REEMPLOYMENT","status":null,"is_section":false},{"identifier":"/us/usc/t5/ptIII/sptB/ch35/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"RETENTION PREFERENCE","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id500dafec-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s3501\"><num value=\"3501\">§ 3501.</num><heading> Definitions; application</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id500dafed-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s3501/a\"><num value=\"a\">(a)</num><chapeau> For the purpose of this subchapter, except section 3504—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id500dafee-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s3501/a/1\"><num value=\"1\">(1)</num><content> “active service” has the meaning given it by <ref href=\"/us/usc/t37/s101\">section 101 of title 37</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id500dafef-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s3501/a/2\"><num value=\"2\">(2)</num><content> “a retired member of a uniformed service” means a member or former member of a uniformed service who is entitled, under statute, to retired, retirement, or retainer pay on account of his service as such a member; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id500daff0-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s3501/a/3\"><num value=\"3\">(3)</num><chapeau> a preference eligible employee who is a retired member of a uniformed service is considered a preference eligible only if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id500daff1-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s3501/a/3/A\"><num value=\"A\">(A)</num><chapeau> his retirement was based on disability—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id500daff2-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s3501/a/3/A/i\"><num value=\"i\">(i)</num><content> resulting from injury or disease received in line of duty as a direct result of armed conflict; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id500daff3-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s3501/a/3/A/ii\"><num value=\"ii\">(ii)</num><content> caused by an instrumentality of war and incurred in the line of duty during a period of war as defined by sections 101 and 1101 of title 38;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id500daff4-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s3501/a/3/B\"><num value=\"B\">(B)</num><content> his service does not include twenty or more years of full-time active service, regardless of when performed but not including periods of active duty for training; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id500daff5-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s3501/a/3/C\"><num value=\"C\">(C)</num><content> on <date date=\"1964-11-30\">November 30, 1964</date>, he was employed in a position to which this subchapter applies and thereafter he continued to be so employed without a break in service of more than 30 days.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id500daff6-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s3501/b\"><num value=\"b\">(b)</num><content> Except as otherwise provided by this subsection and <ref href=\"/us/usc/t5/s3504\">section 3504 of this title</ref>, this subchapter applies to each employee in or under an Executive agency. This subchapter does not apply to an employee whose appointment is required by Congress to be confirmed by, or made with the advice and consent of, the Senate or to a member of the Senior Executive Service or the Federal Bureau of Investigation and Drug Enforcement Administration Senior Executive Service.</content>\n</subsection>\n<sourceCredit id=\"id500daff7-f67c-11e5-87ee-a95dc0577289\">(<ref href=\"/us/pl/89/554\">Pub. The definition of “civilian office” is omitted as unnecessary as subsection (b) of this section states the application of this subchapter.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">In subsection (a)(3), the words “Notwithstanding any other provision of this Act” are omitted as unnecessary. The words “preference eligible employee” are coextensive with and substituted for “employee * * * included under section 2 of this Act” in view of the definition of preference eligible in section 2108.
