<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida295bae6-c0af-11e6-bb1b-dd768f7348e8" identifier="/us/usc/t5/s4802"><num value="4802">§ 4802.</num><heading> Securities and Exchange Commission</heading><subsection style="-uslm-lc:I11" class="indent0" id="ida295bae7-c0af-11e6-bb1b-dd768f7348e8" identifier="/us/usc/t5/s4802/a"><num value="a">(a)</num><content> In this section, the term “Commission” means the Securities and Exchange Commission.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="ida295bae8-c0af-11e6-bb1b-dd768f7348e8" identifier="/us/usc/t5/s4802/b"><num value="b">(b)</num><content> The Commission may appoint and fix the compensation of such officers, attorneys, economists, examiners, and other employees as may be necessary for carrying out its functions under the securities laws as defined under section 3 of the Securities Exchange Act of 1934 (<ref href="/us/usc/t15/s78c">15 U.S.C. 78c</ref>).</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="ida295bae9-c0af-11e6-bb1b-dd768f7348e8" identifier="/us/usc/t5/s4802/c"><num value="c">(c)</num><content> Rates of basic pay for all employees of the Commission may be set and adjusted by the Commission without regard to the provisions of chapter 51 or subchapter III of chapter 53.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="ida295baea-c0af-11e6-bb1b-dd768f7348e8" identifier="/us/usc/t5/s4802/d"><num value="d">(d)</num><content> The Commission may provide additional compensation and benefits to employees of the Commission if the same type of compensation or benefits are then being provided by any agency referred to under section 1206 of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (<ref href="/us/usc/t12/s1833b">12 U.S.C. 1833b</ref>) or, if not then being provided, could be provided by such an agency under applicable provisions of law, rule, or regulation. In setting and adjusting the total amount of compensation and benefits for employees, the Commission shall consult with, and seek to maintain comparability with, the agencies referred to under section 1206 of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (<ref href="/us/usc/t12/s1833b">12 U.S.C. 1833b</ref>).</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="ida295baeb-c0af-11e6-bb1b-dd768f7348e8" identifier="/us/usc/t5/s4802/e"><num value="e">(e)</num><content> The Commission shall consult with the Office of Personnel Management in the implementation of this section.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="ida295baec-c0af-11e6-bb1b-dd768f7348e8" identifier="/us/usc/t5/s4802/f"><num value="f">(f)</num><content> This section shall be administered consistent with merit system principles.</content>

<paragraph style="-uslm-lc:I21" class="indent0"><num value="2">“(2)</num><heading> Implementation report.—</heading><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Before implementing the plan developed under paragraph (1), the Securities and Exchange Commission shall submit a report to the Committee on Governmental Affairs [now Committee on Homeland Security and Governmental Affairs] and the Committee on Banking, Housing, and Urban Affairs of the Senate, the Committee on Government Reform [now Committee on Oversight and Government Reform] and the Committee on Financial Services of the House of Representatives, and the Office of Personnel Management on the details of the plan.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><heading> <inline class="small-caps">Content</inline>.—</heading><chapeau>The report under this paragraph shall include—</chapeau><clause style="-uslm-lc:I23" class="indent2"><num value="i">“(i)</num><content> evidence and supporting documentation justifying the plan; and</content>
