<chapeau style="-uslm-lc:I11" class="indent0">It is the policy of Congress that Federal pay fixing for employees under the General Schedule be based on the principles that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7b00aba0-8841-11e3-a17e-af2311883083" identifier="/us/usc/t5/s5301/1"><num value="1">(1)</num><content> there be equal pay for substantially equal work within each local pay area;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7b00aba1-8841-11e3-a17e-af2311883083" identifier="/us/usc/t5/s5301/2"><num value="2">(2)</num><content> within each local pay area, pay distinctions be maintained in keeping with work and performance distinctions;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7b00aba2-8841-11e3-a17e-af2311883083" identifier="/us/usc/t5/s5301/3"><num value="3">(3)</num><content> Federal pay rates be comparable with non-Federal pay rates for the same levels of work within the same local pay area; and</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> any legislation needed to implement the systems should be enacted in a timely fashion so as to permit implementation of the system by <date date="1993-10-01">October 1, 1993</date>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Establishment</inline>.—</heading><content>The Office of Personnel Management shall establish a Pay-for-Performance Labor-Management Committee to advise the Office on the design and establishment of systems for strengthening the linkage between the performance of General Schedule employees and their pay.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Membership</inline>.—</heading><chapeau>The members of the Committee shall be—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> a Chairman, who shall be appointed by the Director of the Office of Personnel Management on the basis of the appointee’s education, training, and experience as an expert in compensation practices, and after consultation with the Committee on Governmental Affairs [now Committee on Homeland Security and Governmental Affairs] of the Senate and the Committee on Post Office and Civil Service of the House of Representatives, respectively;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> an employee of the Office of Personnel Management, designated by the Director of such Office;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> an employee of the Department of Defense, designated by the Secretary of Defense;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> 3 individuals, each of whom shall be an employee designated by the head of each of 3 other departments or agencies selected by the Director of the Office of Personnel Management from among departments and agencies having substantial numbers of General Schedule employees; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> 6 individuals appointed by the Director of the Office of Personnel Management to serve as representatives of employee organizations which represent substantial numbers of General Schedule employees, and who shall be selected with due consideration to such factors as the relative numbers of General Schedule employees represented by the various organizations, except that not more than 3 members of the Committee at any one time shall be from a single employee organization, council, federation, alliance, association, or affiliation of employee organizations.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Pay for Members</inline>.—</heading><content>The Chairman shall be paid at a rate of basic pay for the Senior Executive Service, to be determined by the Director of the Office of Personnel Management. The members of the Committee who are otherwise employees of the Federal Government shall not receive any additional pay by reason of their service on the Committee. The members of the Committee who are not otherwise employees of the Federal Government shall not be paid for their service on the Committee and shall not be considered employees of the Federal Government for any purpose by reason of their service on the Committee.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Administrative Support</inline>.—</heading><content>The Office of Personnel Management may provide staff and administrative support for the Committee.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Functions</inline>.—</heading><content>The Committee shall review available reports and studies on performance evaluation and performance-based pay systems (including a report to be prepared by the National Academy of Sciences) and any other pertinent information.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="g">“(g)</num><heading> <inline class="small-caps">Report to the Office of Personnel Management</inline>.—</heading><chapeau>No later than 1 year after the date of enactment of this Act [<date date="1990-11-05">Nov. 5, 1990</date>], the Committee shall submit a report to the Director of the Office of Personnel Management, which shall include recommendations as to—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> the types of pay raises to be covered;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> guidelines for pay-for-performance systems, including the criteria to be used in determining eligibility for and the amount of increases in basic pay above the midpoint of the pay range;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> the role organization performance should play in pay-for-performance systems;</content>

<p style="-uslm-lc:I21" class="indent0">By the authority vested in me as President by the Constitution and the laws of the United States of America, including the Federal Employees Pay Comparability Act of 1990 (hereinafter “FEPCA”), as incorporated in <ref href="/us/pl/101/509/s529">section 529 of Public Law 101–509</ref> [see Short Title of 1990 Amendment note above], and sections 3301 and 3302 of title 5, United States Code, it is hereby ordered as follows:</p>
<p style="-uslm-lc:I21" class="indent0"><inline class="small-caps">Section</inline> 1. <i>Annual Adjustments to Pay Schedules</i>. The following agencies are designated under <ref href="/us/usc/t5/s5303/g">section 5303(g) of title 5</ref>, United States Code, as amended by FEPCA, to prescribe conversion rules for the initial adjustment of rates of pay to be applied during each annual adjustment of pay schedules under <ref href="/us/usc/t5/s5303">section 5303 of title 5</ref>, United Stated Code:</p>
<p style="-uslm-lc:I21" class="indent0">(a) the Office of Personnel Management, for the General Schedule;</p>
<p style="-uslm-lc:I21" class="indent0">(b) the Department of State, for the Foreign Service Schedule; and</p>
<p style="-uslm-lc:I21" class="indent0">(c) the Department of Veterans Affairs, for the Veterans Health Services and Research Administration Schedules.</p>
<p style="-uslm-lc:I21" class="indent0"><inline class="small-caps">Sec</inline>. 2. <i>Locality-based Comparability Payments</i>. (a) The Secretary of Labor, the Director of the Office of Management and Budget, and the Director of the Office of Personnel Management are hereby designated under <ref href="/us/usc/t5/s5304/d/1">section 5304(d)(1) of title 5</ref>, United States Code, as amended by FEPCA, to serve jointly as the President’s agent under <ref href="/us/usc/t5/s5304">section 5304 of title 5</ref>, United States Code, and shall be known in this capacity as the President’s Pay Agent.</p>
<p style="-uslm-lc:I21" class="indent0">(b) The head of each executive agency employing personnel under a statutory pay system, as defined in <ref href="/us/usc/t5/s5302/1">section 5302(1) of title 5</ref>, United States Code, as amended by FEPCA, shall provide such information and assistance as may be requested by the President’s Pay Agent in carrying out the provisions of <ref href="/us/usc/t5/s5304">section 5304 of title 5</ref>, United States Code.</p>
<p style="-uslm-lc:I21" class="indent0">(c) The President’s Pay Agent, as designated in subsection (a), is hereby authorized and designated to exercise the authorities of the President under section 5304(g)–(h) [<ref href="/us/usc/t5/s5304/g">5 U.S.C. 5304(g)</ref>, (h)] concerning the extension of locality-based comparability payments to certain categories of positions not otherwise covered.</p>
<p style="-uslm-lc:I21" class="indent0"><inline class="small-caps">Sec</inline>. 3. <i>Previous Order Revoked</i>. Executive Order No. 11721, as amended, is revoked.</p>
<p style="-uslm-lc:I21" class="indent0"><inline class="small-caps">Sec</inline>. 4. <i>Advance Payments for New Appointees</i>. Section 2(b) of Executive Order No. 10982, as amended [<ref href="/us/usc/t5/s5527">5 U.S.C. 5527</ref> note], is further amended to read as follows:</p>
<p style="-uslm-lc:I21" class="indent0">“(b) The Office of Personnel Management is hereby designated and empowered to perform the functions conferred upon the President by the provisions of <ref href="/us/usc/t5/s5527">section 5527 of title 5</ref>, United States Code, with respect to allotments and assignments authorized by <ref href="/us/usc/t5/s5525">section 5525 of title 5</ref>, United States Code, and advance payments to new appointees authorized by <ref href="/us/usc/t5/s5524a">section 5524a of title 5</ref>, United States Code, as added by section 107(a) of the Federal Employees Pay Comparability Act of 1990, as incorporated in <ref href="/us/pl/101/509/s529">section 529 of Public Law 101–509</ref>.”</p>
<p style="-uslm-lc:I21" class="indent0"><inline class="small-caps">Sec</inline>. 5. <i>Staffing Differentials</i>. The Office of Personnel Management is hereby designated and empowered to exercise the authority of the President under section 209 of FEPCA [<ref href="/us/usc/t5/s5305">5 U.S.C. 5305</ref> note] to establish staffing differentials.</p>
<p style="-uslm-lc:I21" class="indent0"><inline class="small-caps">Sec</inline>. 6. <i>Executive Assignment System</i>. (a) Civil Service Rule 9 (5 CFR Part 9), as established by Executive Order No. 11315, as amended, is revoked.</p>
<p style="-uslm-lc:I21" class="indent0">(b) The Office of Personnel Management shall take such actions as the Office may determine to be necessary to provide for the orderly termination of the Executive Assignment System.</p>
<p style="-uslm-lc:I21" class="indent0"><inline class="small-caps">Sec</inline>. 7. <i>Effective Dates</i>. (a) Except as otherwise provided by <ref href="/us/pl/101/509">Public Law 101–509</ref>, the provisions of subchapter I of chapter 53 of title 5, United States Code, as amended by section 101 of FEPCA [this subchapter], and the provisions of sections 1 through 4 of this order shall take effect on <date date="1991-02-03">February 3, 1991</date>.</p>
<p style="-uslm-lc:I21" class="indent0">(b) Except as otherwise provided by <ref href="/us/pl/101/509">Public Law 101–509</ref>, the remaining provisions of FEPCA and of this order shall take effect on <date date="1991-05-04">May 4, 1991</date>, except that the Office of Personnel Management may establish an earlier effective date, but not earlier than <date date="1991-02-03">February 3, 1991</date>, for any such provisions with respect to which the Office determines an earlier effective date is appropriate.
