<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id599b4fdd-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s5366"><num value="5366">§ 5366.</num><heading> Appeals</heading><subsection style="-uslm-lc:I11" class="indent0" id="id599b4fde-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s5366/a"><num value="a">(a)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id599b4fdf-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s5366/a/1"><num value="1">(1)</num><content> In the case of the termination of any benefits available to an employee under this subchapter on the grounds such employee declined a reasonable offer of a position the grade or pay of which was equal to or greater than his retained grade or pay, such termination may be appealed to the Office of Personnel Management under procedures prescribed by the Office.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id599b76f0-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s5366/a/2"><num value="2">(2)</num><chapeau> Nothing in this subchapter shall be construed to affect the right of any employee to appeal—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id599b76f1-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s5366/a/2/A"><num value="A">(A)</num><content> under section 5112(b) or 5346(c) of this title, or otherwise, any reclassification of a position; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id599b76f2-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s5366/a/2/B"><num value="B">(B)</num><content> under procedures prescribed by the Office of Personnel Management, any reduction-in-force action.</content>

</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id599b76f3-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s5366/b"><num value="b">(b)</num><chapeau> For purposes of any appeal procedures (other than those described in subsection (a) of this section) or any grievance procedure negotiated under the provisions of chapter 71 of this title—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id599b76f4-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s5366/b/1"><num value="1">(1)</num><content> any action which is the basis of an individual’s entitlement to benefits under this subchapter, and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id599b76f5-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s5366/b/2"><num value="2">(2)</num><content> any termination of any such benefits under this subchapter,</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">shall not be treated as appealable under such appeals procedures or grievable under such grievance procedure.</continuation>
