<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id0339b7ce-b872-11ed-9817-83c152083139" identifier="/us/usc/t5/s562"><num value="562">§ 562.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">For the purposes of this subchapter, the term—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id0339b7cf-b872-11ed-9817-83c152083139" identifier="/us/usc/t5/s562/1"><num value="1">(1)</num><content> “agency” has the same meaning as in <ref href="/us/usc/t5/s551/1">section 551(1) of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0339b7d0-b872-11ed-9817-83c152083139" identifier="/us/usc/t5/s562/2"><num value="2">(2)</num><chapeau> “consensus” means unanimous concurrence among the interests represented on a negotiated rulemaking committee established under this subchapter, unless such committee—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id033c01c1-b872-11ed-9817-83c152083139" identifier="/us/usc/t5/s562/2/A"><num value="A">(A)</num><content> agrees to define such term to mean a general but not unanimous concurrence; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id033c01c2-b872-11ed-9817-83c152083139" identifier="/us/usc/t5/s562/2/B"><num value="B">(B)</num><content> agrees upon another specified definition;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id033c01c3-b872-11ed-9817-83c152083139" identifier="/us/usc/t5/s562/3"><num value="3">(3)</num><content> “convener” means a person who impartially assists an agency in determining whether establishment of a negotiated rulemaking committee is feasible and appropriate in a particular rulemaking;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id033c01c4-b872-11ed-9817-83c152083139" identifier="/us/usc/t5/s562/4"><num value="4">(4)</num><content> “facilitator” means a person who impartially aids in the discussions and negotiations among the members of a negotiated rulemaking committee to develop a proposed rule;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id033c01c5-b872-11ed-9817-83c152083139" identifier="/us/usc/t5/s562/5"><num value="5">(5)</num><content> “interest” means, with respect to an issue or matter, multiple parties which have a similar point of view or which are likely to be affected in a similar manner;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id033c01c6-b872-11ed-9817-83c152083139" identifier="/us/usc/t5/s562/6"><num value="6">(6)</num><content> “negotiated rulemaking” means rulemaking through the use of a negotiated rulemaking committee;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id033c01c7-b872-11ed-9817-83c152083139" identifier="/us/usc/t5/s562/7"><num value="7">(7)</num><content> “negotiated rulemaking committee” or “committee” means an advisory committee established by an agency in accordance with this subchapter and chapter 10 of this title to consider and discuss issues for the purpose of reaching a consensus in the development of a proposed rule;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id033c01c8-b872-11ed-9817-83c152083139" identifier="/us/usc/t5/s562/8"><num value="8">(8)</num><content> “party” has the same meaning as in <ref href="/us/usc/t5/s551/3">section 551(3) of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id033c01c9-b872-11ed-9817-83c152083139" identifier="/us/usc/t5/s562/9"><num value="9">(9)</num><content> “person” has the same meaning as in <ref href="/us/usc/t5/s551/2">section 551(2) of this title</ref>;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id033c01ca-b872-11ed-9817-83c152083139" identifier="/us/usc/t5/s562/10"><num value="10">(10)</num><content> “rule” has the same meaning as in <ref href="/us/usc/t5/s551/4">section 551(4) of this title</ref>; and</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id033c01cb-b872-11ed-9817-83c152083139" identifier="/us/usc/t5/s562/11"><num value="11">(11)</num><content> “rulemaking” means “rule making” as that term is defined in <ref href="/us/usc/t5/s551/5">section 551(5) of this title</ref>.</content>
