<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id4fbf1b79-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s564"><num value="564">§ 564.</num><heading> Publication of notice; applications for membership on committees</heading><subsection style="-uslm-lc:I11" class="indent0" id="id4fbf1b7a-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s564/a"><num value="a">(a)</num><heading> <inline class="small-caps">Publication of Notice</inline>.—</heading><chapeau>If, after considering the report of a convener or conducting its own assessment, an agency decides to establish a negotiated rulemaking committee, the agency shall publish in the Federal Register and, as appropriate, in trade or other specialized publications, a notice which shall include—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id4fbf1b7b-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s564/a/1"><num value="1">(1)</num><content> an announcement that the agency intends to establish a negotiated rulemaking committee to negotiate and develop a proposed rule;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4fbf1b7c-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s564/a/2"><num value="2">(2)</num><content> a description of the subject and scope of the rule to be developed, and the issues to be considered;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4fbf1b7d-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s564/a/3"><num value="3">(3)</num><content> a list of the interests which are likely to be significantly affected by the rule;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4fbf1b7e-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s564/a/4"><num value="4">(4)</num><content> a list of the persons proposed to represent such interests and the person or persons proposed to represent the agency;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4fbf1b7f-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s564/a/5"><num value="5">(5)</num><content> a proposed agenda and schedule for completing the work of the committee, including a target date for publication by the agency of a proposed rule for notice and comment;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4fbf1b80-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s564/a/6"><num value="6">(6)</num><content> a description of administrative support for the committee to be provided by the agency, including technical assistance;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4fbf1b81-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s564/a/7"><num value="7">(7)</num><content> a solicitation for comments on the proposal to establish the committee, and the proposed membership of the negotiated rulemaking committee; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4fbf1b82-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s564/a/8"><num value="8">(8)</num><content> an explanation of how a person may apply or nominate another person for membership on the committee, as provided under subsection (b).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4fbf1b83-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s564/b"><num value="b">(b)</num><heading> <inline class="small-caps">Applications for Membership or </inline><ref class="footnoteRef" idref="fn002012">1</ref><note type="footnote" id="fn002012"><num>1</num> So in original. Probably should be “on”.</note><inline class="small-caps"> Committee</inline>.—</heading><chapeau>Persons who will be significantly affected by a proposed rule and who believe that their interests will not be adequately represented by any person specified in a notice under subsection (a)(4) may apply for, or nominate another person for, membership on the negotiated rulemaking committee to represent such interests with respect to the proposed rule. Each application or nomination shall include—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id4fbf1b84-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s564/b/1"><num value="1">(1)</num><content> the name of the applicant or nominee and a description of the interests such person shall represent;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4fbf1b85-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s564/b/2"><num value="2">(2)</num><content> evidence that the applicant or nominee is authorized to represent parties related to the interests the person proposes to represent;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4fbf1b86-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s564/b/3"><num value="3">(3)</num><content> a written commitment that the applicant or nominee shall actively participate in good faith in the development of the rule under consideration; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4fbf1b87-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s564/b/4"><num value="4">(4)</num><content> the reasons that the persons specified in the notice under subsection (a)(4) do not adequately represent the interests of the person submitting the application or nomination.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4fbf1b88-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s564/c"><num value="c">(c)</num><heading> <inline class="small-caps">Period for Submission of Comments and Applications</inline>.—</heading><content>The agency shall provide for a period of at least 30 calendar days for the submission of comments and applications under this section.</content>
