or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4fbf1c06-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/a/4\"><num value=\"4\">(4)</num><chapeau> a court determines that such testimony or disclosure is necessary to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4fbf1c07-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/a/4/A\"><num value=\"A\">(A)</num><content> prevent a manifest injustice;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4fc18c08-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/a/4/B\"><num value=\"B\">(B)</num><content> help establish a violation of law; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4fc18c09-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/a/4/C\"><num value=\"C\">(C)</num><content> prevent harm to the public health or safety,</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">of sufficient magnitude in the particular case to outweigh the integrity of dispute resolution proceedings in general by reducing the confidence of parties in future cases that their communications will remain confidential.</continuation>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id4fc18c0a-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/b\"><num value=\"b\">(b)</num><chapeau> A party to a dispute resolution proceeding shall not voluntarily disclose or through discovery or compulsory process be required to disclose any dispute resolution communication, unless—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4fc18c0b-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/b/1\"><num value=\"1\">(1)</num><content> the communication was prepared by the party seeking disclosure;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4fc18c0c-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/b/2\"><num value=\"2\">(2)</num><content> all parties to the dispute resolution proceeding consent in writing;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4fc18c0d-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/b/3\"><num value=\"3\">(3)</num><content> the dispute resolution communication has already been made public;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4fc18c0e-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/b/4\"><num value=\"4\">(4)</num><content> the dispute resolution communication is required by statute to be made public;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4fc18c0f-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/b/5\"><num value=\"5\">(5)</num><chapeau> a court determines that such testimony or disclosure is necessary to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4fc18c10-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/b/5/A\"><num value=\"A\">(A)</num><content> prevent a manifest injustice;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4fc18c11-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/b/5/B\"><num value=\"B\">(B)</num><content> help establish a violation of law; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4fc18c12-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/b/5/C\"><num value=\"C\">(C)</num><content> prevent harm to the public health and safety,</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">of sufficient magnitude in the particular case to outweigh the integrity of dispute resolution proceedings in general by reducing the confidence of parties in future cases that their communications will remain confidential;</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4fc18c13-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/b/6\"><num value=\"6\">(6)</num><content> the dispute resolution communication is relevant to determining the existence or meaning of an agreement or award that resulted from the dispute resolution proceeding or to the enforcement of such an agreement or award; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4fc18c14-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/b/7\"><num value=\"7\">(7)</num><content> except for dispute resolution communications generated by the neutral, the dispute resolution communication was provided to or was available to all parties to the dispute resolution proceeding.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id4fc18c15-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/c\"><num value=\"c\">(c)</num><content> Any dispute resolution communication that is disclosed in violation of subsection (a) or (b), shall not be admissible in any proceeding relating to the issues in controversy with respect to which the communication was made.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id4fc18c16-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/d\"><num value=\"d\">(d)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id4fc18c17-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/d/1\"><num value=\"1\">(1)</num><content> The parties may agree to alternative confidential procedures for disclosures by a neutral. Upon such agreement the parties shall inform the neutral before the commencement of the dispute resolution proceeding of any modifications to the provisions of subsection (a) that will govern the confidentiality of the dispute resolution proceeding. If the parties do not so inform the neutral, subsection (a) shall apply.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id4fc18c18-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/d/2\"><num value=\"2\">(2)</num><content> To qualify for the exemption established under subsection (j), an alternative confidential procedure under this subsection may not provide for less disclosure than the confidential procedures otherwise provided under this section.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id4fc18c19-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/e\"><num value=\"e\">(e)</num><content> If a demand for disclosure, by way of discovery request or other legal process, is made upon a neutral regarding a dispute resolution communication, the neutral shall make reasonable efforts to notify the parties and any affected nonparty participants of the demand. Any party or affected nonparty participant who receives such notice and within 15 calendar days does not offer to defend a refusal of the neutral to disclose the requested information shall have waived any objection to such disclosure.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id4fc18c1a-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/f\"><num value=\"f\">(f)</num><content> Nothing in this section shall prevent the discovery or admissibility of any evidence that is otherwise discoverable, merely because the evidence was presented in the course of a dispute resolution proceeding.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id4fc18c1b-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/g\"><num value=\"g\">(g)</num><content> Subsections (a) and (b) shall have no effect on the information and data that are necessary to document an agreement reached or order issued pursuant to a dispute resolution proceeding.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id4fc18c1c-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/h\"><num value=\"h\">(h)</num><content> Subsections (a) and (b) shall not prevent the gathering of information for research or educational purposes, in cooperation with other agencies, governmental entities, or dispute resolution programs, so long as the parties and the specific issues in controversy are not identifiable.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id4fc18c1d-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/i\"><num value=\"i\">(i)</num><content> Subsections (a) and (b) shall not prevent use of a dispute resolution communication to resolve a dispute between the neutral in a dispute resolution proceeding and a party to or participant in such proceeding, so long as such dispute resolution communication is disclosed only to the extent necessary to resolve such dispute.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id4fc18c1e-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s574/j\"><num value=\"j\">(j)</num><content> A dispute resolution communication which is between a neutral and a party and which may not be disclosed under this section shall also be exempt from disclosure under section 552(b)(3).</content>\n</subsection>\n<sourceCredit id=\"id4fc18c1f-f67c-11e5-87ee-a95dc0577289\">(Added <ref href=\"/us/pl/101/552\">Pub.
