<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id42ac5abd-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502"><num value="6502">§ 6502.</num><heading> Executive agencies telework requirement</heading><subsection style="-uslm-lc:I11" class="indent0" id="id42ac5abe-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/a"><num value="a">(a)</num><heading> <inline class="small-caps">Telework Eligibility.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id42ac5abf-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this chapter, the head of each executive agency shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id42ac5ac0-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/a/1/A"><num value="A">(A)</num><content> establish a policy under which eligible employees of the agency may be authorized to telework;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id42ac5ac1-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/a/1/B"><num value="B">(B)</num><content> determine the eligibility for all employees of the agency to participate in telework; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id42ac5ac2-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/a/1/C"><num value="C">(C)</num><content> notify all employees of the agency of their eligibility to telework.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id42ac5ac3-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/a/2"><num value="2">(2)</num><heading> <inline class="small-caps">Limitation</inline>.—</heading><chapeau>An employee may not telework under a policy established under this section if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id42ac5ac4-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/a/2/A"><num value="A">(A)</num><content> the employee has been officially disciplined for being absent without permission for more than 5 days in any calendar year; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id42ac5ac5-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/a/2/B"><num value="B">(B)</num><content> the employee has been officially disciplined for violations of subpart G of the Standards of Ethical Conduct for Employees of the Executive Branch for viewing, downloading, or exchanging pornography, including child pornography, on a Federal Government computer or while performing official Federal Government duties.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id42ac5ac6-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/b"><num value="b">(b)</num><heading> <inline class="small-caps">Participation</inline>.—</heading><chapeau>The policy described under subsection (a) shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id42ac5ac7-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/b/1"><num value="1">(1)</num><content> ensure that telework does not diminish employee performance or agency operations;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id42ac5ac8-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/b/2"><num value="2">(2)</num><chapeau> require a written agreement that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id42ac5ac9-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/b/2/A"><num value="A">(A)</num><content> is entered into between an agency manager and an employee authorized to telework, that outlines the specific work arrangement that is agreed to; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id42ac5aca-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/b/2/B"><num value="B">(B)</num><content> is mandatory in order for any employee to participate in telework;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id42ac5acb-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/b/3"><num value="3">(3)</num><content> provide that an employee may not be authorized to telework if the performance of that employee does not comply with the terms of the written agreement between the agency manager and that employee;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id42ac5acc-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/b/4"><num value="4">(4)</num><chapeau> except in emergency situations as determined by the head of an agency, not apply to any employee of the agency whose official duties require on a daily basis (every work day)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id42ac5acd-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/b/4/A"><num value="A">(A)</num><content> direct handling of secure materials determined to be inappropriate for telework by the agency head; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id42ac5ace-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/b/4/B"><num value="B">(B)</num><content> on-site activity that cannot be handled remotely or at an alternate worksite;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id42ac5acf-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/b/5"><num value="5">(5)</num><content> be incorporated as part of the continuity of operations plans of the agency in the event of an emergency; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id42ac5ad0-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/b/6"><num value="6">(6)</num><content> enumerate the circumstances under which employees may be permitted to temporarily perform work requirements and duties from approved overseas locations, provided that, except in emergency situations as determined by the head of the agency, such circumstances shall not include a situation in which an employee’s official duties require on at least a monthly basis the direct handling of secure materials determined to be inappropriate for telework by the agency head.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id42ac5ad1-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/c"><num value="c">(c)</num><heading> <inline class="small-caps">Required Telework</inline>.—</heading><chapeau>If an agency places an employee in investigative leave under section 6329b, the agency may require the employee to, through telework, perform duties similar to the duties that the employee performs on-site if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id42ac5ad2-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/c/1"><num value="1">(1)</num><chapeau> the agency determines that such a requirement would not—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id42ac5ad3-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/c/1/A"><num value="A">(A)</num><content> pose a threat to the employee or others;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id42ac5ad4-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/c/1/B"><num value="B">(B)</num><content> result in the destruction of evidence relevant to an investigation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id42ac5ad5-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/c/1/C"><num value="C">(C)</num><content> result in the loss of or damage to Government property; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id42ac5ad6-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/c/1/D"><num value="D">(D)</num><content> otherwise jeopardize legitimate Government interests;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id42ac5ad7-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/c/2"><num value="2">(2)</num><content> the employee is eligible to telework under subsections (a) and (b) of this section; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id42ac5ad8-ee6d-11ec-b35f-ad66c305e617" identifier="/us/usc/t5/s6502/c/3"><num value="3">(3)</num><content> the agency determines that it would be appropriate for the employee to perform the duties of the employee through telework.</content>
