<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id50955725-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s6503"><num value="6503">§ 6503.</num><heading> Training and monitoring</heading><subsection style="-uslm-lc:I11" class="indent0" id="id50955726-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s6503/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><chapeau>The head of each executive agency shall ensure that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id50955727-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s6503/a/1"><num value="1">(1)</num><chapeau> an interactive telework training program is provided to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id50955728-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s6503/a/1/A"><num value="A">(A)</num><content> employees eligible to participate in the telework program of the agency; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id50955729-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s6503/a/1/B"><num value="B">(B)</num><content> all managers of teleworkers;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5095572a-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s6503/a/2"><num value="2">(2)</num><content> except as provided under subsection (b), an employee has successfully completed the interactive telework training program before that employee enters into a written agreement to telework described under section 6502(b)(2);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5095572b-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s6503/a/3"><num value="3">(3)</num><chapeau> teleworkers and nonteleworkers are treated the same for purposes of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id5095572c-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s6503/a/3/A"><num value="A">(A)</num><content> periodic appraisals of job performance of employees;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5095572d-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s6503/a/3/B"><num value="B">(B)</num><content> training, rewarding, reassigning, promoting, reducing in grade, retaining, and removing employees;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5095572e-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s6503/a/3/C"><num value="C">(C)</num><content> work requirements; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5095572f-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s6503/a/3/D"><num value="D">(D)</num><content> other acts involving managerial discretion; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id50955730-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s6503/a/4"><num value="4">(4)</num><content> when determining what constitutes diminished employee performance, the agency shall consult the performance management guidelines of the Office of Personnel Management.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id50955731-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s6503/b"><num value="b">(b)</num><heading> <inline class="small-caps">Training Requirement Exemptions</inline>.—</heading><content>The head of an executive agency may provide for an exemption from the training requirements under subsection (a), if the head of that agency determines that the training would be unnecessary because the employee is already teleworking under a work arrangement in effect before the date of enactment of this chapter.</content>
