<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id5923fcf6-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s701"><num value="701">§ 701.</num><heading> Application; definitions</heading><subsection style="-uslm-lc:I11" class="indent0" id="id5923fcf7-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s701/a"><num value="a">(a)</num><chapeau> This chapter applies, according to the provisions thereof, except to the extent that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id5923fcf8-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s701/a/1"><num value="1">(1)</num><content> statutes preclude judicial review; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5923fcf9-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s701/a/2"><num value="2">(2)</num><content> agency action is committed to agency discretion by law.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id5923fcfa-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s701/b"><num value="b">(b)</num><chapeau> For the purpose of this chapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id5923fcfb-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s701/b/1"><num value="1">(1)</num><chapeau> “agency” means each authority of the Government of the United States, whether or not it is within or subject to review by another agency, but does not include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id5923fcfc-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s701/b/1/A"><num value="A">(A)</num><content> the Congress;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5923fcfd-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s701/b/1/B"><num value="B">(B)</num><content> the courts of the United States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5923fcfe-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s701/b/1/C"><num value="C">(C)</num><content> the governments of the territories or possessions of the United States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5924240f-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s701/b/1/D"><num value="D">(D)</num><content> the government of the District of Columbia;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id59242410-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s701/b/1/E"><num value="E">(E)</num><content> agencies composed of representatives of the parties or of representatives of organizations of the parties to the disputes determined by them;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id59242411-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s701/b/1/F"><num value="F">(F)</num><content> courts martial and military commissions;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id59242412-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s701/b/1/G"><num value="G">(G)</num><content> military authority exercised in the field in time of war or in occupied territory; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id59242413-d2f2-11e9-8bc3-c6fdab7b720a" identifier="/us/usc/t5/s701/b/1/H"><num value="H">(H)</num><content> functions conferred by sections 1738, 1739, 1743, and 1744 of title 12; subchapter II of chapter 471 of title 49; or sections 1884, 1891–1902, and former section 1641(b)(2), of title 50, appendix; <ref class="footnoteRef" idref="fn002020">1</ref><note type="footnote" id="fn002020"><num>1</num> See References in Text note below.</note> and</content>
</subparagraph>
</paragraph>
