C, title XXXV, § 3548(a)(9), Sept. 23, 1996, 110 Stat. 2869.)","seq_in_title":754,"parent_identifier":"/us/usc/t5/ptIII/sptF/ch79","ancestors":[{"identifier":"/us/usc/t5","level":"title","num":"Title 5—","heading":"GOVERNMENT ORGANIZATION AND EMPLOYEES","status":null,"is_section":false},{"identifier":"/us/usc/t5/ptIII","level":"part","num":"PART III—","heading":"EMPLOYEES","status":null,"is_section":false},{"identifier":"/us/usc/t5/ptIII/sptF","level":"subpart","num":"Subpart F—","heading":"Labor-Management and Employee Relations","status":null,"is_section":false},{"identifier":"/us/usc/t5/ptIII/sptF/ch79","level":"chapter","num":"CHAPTER 79—","heading":"SERVICES TO EMPLOYEES","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id50aadb62-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s7901\"><num value=\"7901\">§ 7901.</num><heading> Health service programs</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id50aadb63-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s7901/a\"><num value=\"a\">(a)</num><content> The head of each agency of the Government of the United States may establish, within the limits of appropriations available, a health service program to promote and maintain the physical and mental fitness of employees under his jurisdiction.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id50aadb64-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s7901/b\"><num value=\"b\">(b)</num><chapeau> A health service program may be established by contract or otherwise, but only—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id50aadb65-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s7901/b/1\"><num value=\"1\">(1)</num><content> after consultation with the Secretary of Health, Education, and Welfare and consideration of its recommendations; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id50aadb66-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s7901/b/2\"><num value=\"2\">(2)</num><content> in localities where there are a sufficient number of employees to warrant providing the service.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id50aadb67-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s7901/c\"><num value=\"c\">(c)</num><chapeau> A health service program is limited to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id50aadb68-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s7901/c/1\"><num value=\"1\">(1)</num><content> treatment of on-the-job illness and dental conditions requiring emergency attention;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id50aadb69-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s7901/c/2\"><num value=\"2\">(2)</num><content> preemployment and other examinations;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id50aadb6a-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s7901/c/3\"><num value=\"3\">(3)</num><content> referral of employees to private physicians and dentists; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id50aadb6b-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s7901/c/4\"><num value=\"4\">(4)</num><content> preventive programs relating to health.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id50aadb6c-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s7901/d\"><num value=\"d\">(d)</num><content> The Secretary of Health, Education, and Welfare, on request, shall review a health service program conducted under this section and shall submit comment and recommendations to the head of the agency concerned.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id50aadb6d-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s7901/e\"><num value=\"e\">(e)</num><content> When this section authorizes the use of the professional services of physicians, that authorization includes the use of the professional services of surgeons and osteopathic practitioners within the scope of their practice as defined by State law.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id50aadb6e-f67c-11e5-87ee-a95dc0577289\" identifier=\"/us/usc/t5/s7901/f\"><num value=\"f\">(f)</num><content> The health programs conducted by the Tennessee Valley Authority are not affected by this section.</content>\n</subsection>\n<sourceCredit id=\"id50aadb6f-f67c-11e5-87ee-a95dc0577289\">(<ref href=\"/us/pl/89/554\">Pub.
