<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id50af9690-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8109"><num value="8109">§ 8109.</num><heading> Beneficiaries of awards unpaid at death; order of precedence</heading><subsection style="-uslm-lc:I11" class="indent0" id="id50af9691-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8109/a"><num value="a">(a)</num><chapeau> If an individual—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id50af9692-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8109/a/1"><num value="1">(1)</num><content> has sustained disability compensable under <ref href="/us/usc/t5/s8107/a">section 8107(a) of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id50af9693-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8109/a/2"><num value="2">(2)</num><content> has filed a valid claim in his lifetime; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id50af9694-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8109/a/3"><num value="3">(3)</num><content> dies from a cause other than the injury before the end of the period specified by the schedule;</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">the compensation specified by the schedule that is unpaid at his death, whether or not accrued or due at his death, shall be paid—</continuation>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id50af9695-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8109/a/A"><num value="A">(A)</num><content> under an award made before or after the death;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id50af9696-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8109/a/B"><num value="B">(B)</num><content> for the period specified by the schedule;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id50af9697-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8109/a/C"><num value="C">(C)</num><content> to and for the benefit of the persons then in being within the classes and proportions and on the conditions specified by this section; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id50af9698-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8109/a/D"><num value="D">(D)</num><chapeau> in the following order of precedence:</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id50af9699-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8109/a/D/i"><num value="i">(i)</num><content> If there is no child, to the widow or widower.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id50af969a-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8109/a/D/ii"><num value="ii">(ii)</num><content> If there are both a widow or widower and a child or children, one-half to the widow or widower and one-half to the child or children.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id50af969b-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8109/a/D/iii"><num value="iii">(iii)</num><content> If there is no widow or widower, to the child or children.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id50af969c-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8109/a/D/iv"><num value="iv">(iv)</num><content> If there is no survivor in the above classes, to the parent or parents wholly or partly dependent for support on the decedent, or to other wholly dependent relatives listed by <ref href="/us/usc/t5/s8133/a/5">section 8133(a)(5) of this title</ref>, or to both in proportions provided by regulation.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id50af969d-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8109/a/D/v"><num value="v">(v)</num><content> If there is no survivor in the above classes and no burial allowance is payable under <ref href="/us/usc/t5/s8134">section 8134 of this title</ref>, an amount not exceeding that which would be expendable under <ref href="/us/usc/t5/s8134">section 8134 of this title</ref> if applicable shall be paid to reimburse a person equitably entitled thereto to the extent and in the proportion that he has paid the burial expenses, but a compensated insurer or other person obligated by law or contract to pay the burial expenses or a State or political subdivision or entity is deemed not equitably entitled.</content>
</clause>
</subparagraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id50af969e-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8109/b"><num value="b">(b)</num><content> Payments under subsection (a) of this section, except for an amount payable for a period preceding the death of the individual, are at the basic rate of compensation for permanent disability specified by <ref href="/us/usc/t5/s8107/a">section 8107(a) of this title</ref> even if at the time of death the individual was entitled to the augmented rate specified by <ref href="/us/usc/t5/s8110">section 8110 of this title</ref>.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id50af969f-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8109/c"><num value="c">(c)</num><content> A surviving beneficiary under subsection (a) of this section, except one under subsection (a)(D)(v), does not have a vested right to payment and must be alive to receive payment.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id50af96a0-f67c-11e5-87ee-a95dc0577289" identifier="/us/usc/t5/s8109/d"><num value="d">(d)</num><content> A beneficiary under subsection (a) of this section, except one under subsection (a)(D)(v), ceases to be entitled to payment on the happening of an event which would terminate his right to compensation for death under <ref href="/us/usc/t5/s8133">section 8133 of this title</ref>. When that entitlement ceases, compensation remaining unpaid under subsection (a) of this section is payable to the surviving beneficiary in accordance with subsection (a) of this section.</content>
