<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ided79246c-d96f-11ed-8d45-c0cfa744ead1" identifier="/us/usc/t5/s8121"><num value="8121">§ 8121.</num><heading> Claim</heading>
<chapeau style="-uslm-lc:I11" class="indent0">Compensation under this subchapter may be allowed only if an individual or someone on his behalf makes claim therefor. The claim shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ided79246d-d96f-11ed-8d45-c0cfa744ead1" identifier="/us/usc/t5/s8121/1"><num value="1">(1)</num><content> be made in writing within the time specified by <ref href="/us/usc/t5/s8122">section 8122 of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ided79246e-d96f-11ed-8d45-c0cfa744ead1" identifier="/us/usc/t5/s8121/2"><num value="2">(2)</num><content> be delivered to the office of the Secretary of Labor or to an individual whom the Secretary may designate by regulation, or deposited in the mail properly stamped and addressed to the Secretary or his designee;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ided79246f-d96f-11ed-8d45-c0cfa744ead1" identifier="/us/usc/t5/s8121/3"><num value="3">(3)</num><content> be on a form approved by the Secretary;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ided792470-d96f-11ed-8d45-c0cfa744ead1" identifier="/us/usc/t5/s8121/4"><num value="4">(4)</num><content> contain all information required by the Secretary;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ided792471-d96f-11ed-8d45-c0cfa744ead1" identifier="/us/usc/t5/s8121/5"><num value="5">(5)</num><content> be sworn to by the individual entitled to compensation or someone on his behalf; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ided792472-d96f-11ed-8d45-c0cfa744ead1" identifier="/us/usc/t5/s8121/6"><num value="6">(6)</num><content> except in case of death, be accompanied by a certificate of the physician of the employee stating the nature of the injury and the nature and probable extent of the disability.</content>
